A regular meeting of the Liquor Licensing Authoritywas held on October 20, 2008 in Municipal Court,
215 North Mason. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated that there are no changes to the agenda.
Approval of Minutes
Judge Lane approved the minutes from September 22, 2008.
Show Cause Hearing for
Steak and Ale of Colorado, Inc.,
dba Bennigan's, 2203 South College Avenue
Order to Revoke Signed
Assistant City Attorney LopezFilkins stated she has been in contact with the licensee's representative
regarding this show cause hearing. She briefly reviewed the Motion to Revoke or Suspend License.
Assistant CityAttomeyLopezFilkins stated the Bankruptcy Trustee was unwilling to incur the expense
of surrendering the hotel -restaurant liquor license. She stated UniversityPlaza 02, LLC (landlord) has
provided the Authoritywith a swom affidavit stating that the Licensee no longer is in possession of the
premises.
Judge Lane ordered that the hotel -restaurant liquor license held bySteak and Ale of Colorado, Inc., dba
Bennigan's, 2203 South College Avenue be revoked effective immediately.
Registration of Kirk Silos as Manager
of Enzio's Italian Kitchen,
126 West Mountain Avenue, Approved
Kirk Silos, manager applicant, briefly described his background. He stated he has been with Front
Range Restaurants for 5 years. Mr. Silos stated he has 13 employees involved in the sale and service of
alcohol. He stated there is at least one assistant manager on premise if he is not. Mr. Silos stated any
employee found in violation of the liquor code is immediately terminated.

Registration of Jeremy Kempter
as Manager of Luscious Nectar,
222 Linden Street, Approved
JeremyKempter, owner and manager applicant, stated he is on premise everyday. He stated when he
is not on premise he has two bartenders as assistant managers. Mr. Kempter stated he is responsible
for the training of his employees. He stated he does not have a training manual and instructs his
employees to check any patrons who appear to be under 40. Mr. Kempter stated after 9:30 p.m, all
patrons must be at least 21 years of age. He stated any employee found in violation of the liquor code
would be immediatelyterminated.
Judge Lane approved Jeremy Kempter as manager of Luscious Nectar, 222 Linden Street.
Registration of Steven Saks as
Manager of La Luz Mexican Grill,
222 Linden Street. Approved
Steven Saks, manager applicant, briefly described his background. He stated he has been in the
restaurant business for 17 years. Mr. Saks stated he has only 3 employees involved in the sale and
service of alcohol and that they only sell 5 beers a day. He stated he is on premise 40-50 hours a week.
Mr. Saks stated when he is not on premise, he has an assistant manager. He stated any -employee found
in violation of the liquor code is immediately terminated.
Judge Lane approved Steven Saks as Manager of La Luz Mexican Grill, 222 Linden Street.
Transfer of Ownership of Nico's Catacombs,
115 South College Avenue from Zentveld, Inc., to FTC Steakhouse, LLC
and Trade Name Change to Sonny Lubick Steakhouse, Approved
Toby Sheppard and Rick Callan, representatives for FTC Steakhouse, LLC, stated that they are not
making any significant changes to the premise. Mr. Sheppard stated that Poudre Fire Authority and
Building Inspection have reviewed the changes theyare making. He stated theywill be closing around
10:00 p.m. Mr. Sheppard stated approximate 12 employees will be involved in the sale and service of
alcohol. He stated any employee found in violation of the liquor code will be immediately terminated.
Mr. Sheppard stated he will require all his employees to be TIP's trained.
Judge Lane approved the transfer of ownership of Nico's Catacombs,115 South College Avenue from
Zentveld, Inc., to FTC Steakhouse, LLC and Trade Name Change to Sonny Lubick Steakhouse.

Hearing on a New Application from Mountain Creole, Inc.,
for a hotel -restaurant liquor license at
Lucile's, 400 South Meldrum, Approved
Tony Hanks, representative for Mountain Creole, LLC, stated Lucile's is primarily a restaurant. He
described the premise and that patrons would enter the restaurant on the west side. Mr. Hanks stated
he and all his staff have attended Liquor Enforcement Officer Younger's training prior to serving
alcohol. He stated he will be responsible for training any new employees. Mr. Hanks stated he is on
premise 30-40 hours a week He stated he has assistant managers on premise when he is not. Mr.
Hanks stated any -employee found in violation of the liquor code is immediatelyterminated. He stated
he has a current copy of the liquor code on premise.
Judge Lane marked the petitions as Exhibit 1.
Judge Lane adopted Resolution 2008-23 approving an application from Mountain Creole, Inc., for a
hotel -restaurant liquor license at Lucite's, 400 South Meldrum.
Hearing on a New Application from
Wing & Tong, Inc., for a hotel -restaurant liquor license
at East Moon Asian Bistro & Hibachi,
2400 East Harmony Road, Unit 102, Approved
Kris Hoeltgen, attorney representing Wing & Tong, Inc., called her first witness. Gino Campana,
landlord of the building, was sworn. He stated this is the last full service restaurant to open in this
development.
Max Scott, representative for Oedipus, Inc., was sworn. He briefly described the petitioning process,
stating that these petitions indicate strong support for this application.
Attorney Hoeltgen called Chi Wing Chan, representative for Wing & Tong, Inc., to testify. He was
swom. Mr. Chan stated at least 90% of his gross sales will come from the sale of food. He stated any
employee found in violation of the liquor code will be immediatelyterminated. Mr. Chan stated he will
be open in 2 weeks. He stated any patron who appears to be under the age of 35 will be carded.
AttorneyHoehgen called Guo Tong Zhou, representative for Wing & Tong, Inc., to testify. He stated
Mr. Chan only recently became an owner in the East Moon Asian Bistro on 1624 South LemayAugust
2008.
Judge Lane adopted Resolution 2008-18 approving an application from Wing & Tong, Inc., for a hotel -
restaurant liquor license at East Moon Asian Bistro & Hibachi, 2400 East Harmony Road, Unit 102.
