Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authoritywas held on February23, 2009 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: JennyLopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated that there were no changes to the agenda as presented. Approval of Minutes Judge Lane approved the minutes from January 26, 2009, June 24, 2002, July 1, 2002, August 19, 2002, September 9, 2002. Show Cause Hearing for Armadillo Club, Inc., dba The Armadillo, 354 Walnut Street, Stipulation Agreement Approved Jerry Schott, regional manager for the Armadillo Club, Inc., described the changes theyhave made. He stated on karaoke nights that they will close 1 hour early. Assistant City Attorney LopezFilkins summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served ($1649.40 paid in lieu of suspension), with 10 days held in abeyance for 1 year for violating CR-S., 12-47-901(1)(h), permitting consumption after hours. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for the Armadillo Club, Inc., dba.The Armadillo, 354 Walnut Street. February 23, 2009 Show Cause Hearing for Janette's Pharmacy, Inc., dba Park Central Liquor, 802 East MulbeM, Hearing Continued to April 20, 2009 Joe Fonfara, attorney representing Janette's Pharmacy, Inc., stated he had just been retained and has not had time to review the case. Assistant City Attorney LopezFilkins stated she did not object to the continuance. Judge Lane continued the Show Cause Hearing for Janette's Pharmacy, Inc., dba Park Central Liquor, 802 East Mulberry to April 20, 2009. Registration of Derek Frodl as Manager of Noodles & Company, 650 South College Avenue, Approved Derek Frodl, manager applicant, stated every patron who orders alcohol is carded. He stated any employee found in violation of the liquor code would likely be terminated. Mr. Frodl stated he does not have a current copy of the liquor code on premise. Judge Lane approved the registration of Derek Frodl as Manager of Noodles & Company, 650 South College Avenue. Transfer of Ownership of Sullivan's, 820 City Park Avenue, from Slips, TMT, LLC to Slow Meaux's, LLC and Trade Name Change to Mo Jeaux's Bar and Grill, Approved Dixon Walne and Joe Wilkinson, representatives for Slow Meaux's, LLC, stated they will close at 1:30 and make sure that the building is cleared out by 1:50 p.m Mr. Walne stated he and Mr. Wilkinson is aware of the previous owner's problems. He stated the third partner, Kelly Walne, is a TIP's certified trainer and will be responsible for training all the employees. In response to a question from Assistant City Attorney LopezFilkins, Mr. Walne stated Poudre Fire Authority has already done an inspection of their premise and that their occupancy is 205. He stated they are only making cosmetic changes to the premises. Judge Lane approved the transfer of ownership of Sullivan's, 820 City Park Avenue, from Slips, TMT, LLC to Slow Meaux's, LLC and Trade Name Change to Mo Jeaux's Bar and Grill. Transfer of Ownership of Genoa Coffee & Wine, 2614 South Timberline Road, C101 from Genoa Coffee, LLC to Kamirojero Holdings, Inc., Approved Bob Christiansen, representative for Kamirojero Holdings, Inc., stated he has not had much experience in the restaurant business. Mr. Christiansen stated he will be involved in the dayto dayoperations. He stated he will attend Liquor Enforcement Officer Younger's trainer. Mr. Christiansen stated many of the employees from the previous owners have stayed on and that his daughter and son-in-law will also February 23, 2009 be involved in the store. He stated they are only making cosmetic changes and that they will not be open late evenings. Mr. Christiansen that any employee found in violation of the liquor code will be immediately terminated. He stated he has a current copy of the liquor code on premise. Mr. Christiansen stated they will card any patron that appear to be 35 years of age or younger. Judge Lane approved the transfer of ownership of Genoa Coffee & Wine, 2614 South Timberline Road, G 101 from Genoa Coffee, LLC to Kamirojero Holdings, Inc. Hearing on a New Application from Dos Payaso, LLC, for a Hotel -Restaurant Liquor License at E1 Monte Grill, 1611 South College Avenue, Approved Stephen Richter and Pat McGaughran, representatives for Dos Payaso, LLC, were sworn. Mr. Richter stated they anticipate 75% of their gross sales will come from the sale of food. He stated he is TIP's certified. Mr. Richter stated this restaurant will not be open past midnight. He stated the entire patio is visible from the host stand and that wait staff will be responsible for monitoring patrons on the patio. Mr. Richter stated that training for his employees will be provided bytraining staff from the Rio Grande Mexican Restaurant. He stated any patron ordering alcohol is carded if they appear to be 35 years of age or younger. Mr. Richter stated any employee found in violation of the liquor code is immediately terminated. He stated he has a current copy of the liquor code on premise. Max Scott, Oedipus, Inc., was sworn. He stated this an exceptionally well received application. Mr. Scott stated residences were aware of this restaurants affiliation with the Rio Grande Restaurants. Judge Lane adopted Resolution 2009-01 approving an application from Dos Payaso, LLC, for a hotel - restaurant liquor license at El Monte Grille, 1611 South College Avenue.
