Council Liaison: Ray Martinez Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on July 12, 2004 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Matt Johnson, Fort Collins Police Department Representative Agenda Review Deputy City Clerk Jensen stated that there were no changes to the agenda. Request from Greek Connection, Inc., dba Tony's Restaurant & Lounge to Change, Alter, or Modify the Licensed Premises at 224 South College Avenue, Approved Jimmy Katopodis, representative for Greek Connection, Inc., briefly described the proposed changes and the petitioning process. Judge Lane approved the request from Greek Connection, Inc., dba Tony's Restaurant & Lounge to change, alter or modify the licensed premises at 224 South College Avenue. Show Cause Hearing for Safeway Stores 46, Inc., dba Safeway #1552, 1426 East Harmony Road, Stipulation Agreement Approved Alan Dill, attorney representing Safeway Stores 46, Inc., stated the employee was suspended without pay for two weeks. He stated all employees involved in the sale of alcohol are required to attend quarterly training. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $422), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-901(1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the stipulation agreement as presented. July 12, 2004 Show Cause Hearing for Albertson's, Inc., dba Albertson's Fuel Express #814, 1660 North College Avenue, Stipulation Agreement Approved Alan Dill, attorney representing Albertson's, Inc., stated the employee was suspended without pay. He stated all employees involved in the sale of alcohol are required to attend training on a regular basis. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $200), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-901 (1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the stipulation agreement as presented. Show Cause Hearing for Metro Oil Company, Inc., dba Diamond Shamrock #1152, 4502 Timberline Road, Stipulation Agreement Approved Jon Stonbraker, attorney representing Metro Oil Company, Inc., briefly reviewed the training all employees are required to complete prior to selling alcohol. He stated the employee was terminated. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $200), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-901(1)(a.5), pennitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the stipulation agreement as presented. Registration of Erin Beach as Manager of HuHot Mongolian Grill, Continued to August 9, 2007 Judge Lane continued consideration of this application to August 9, 2007. Transfer of Ownership of Sportscaster Bar & Grill, 165 East Boardwalk, from Hoffer's Sports Bar and Grill, Ltd., to J. Douglas Johnson Investment. Inc., Approved Jeff Johnson, representative for J. Douglas Johnson Investment, hic., stated he conducts DUI classes. He stated that current employees have been working at this restaurant for 6-7 years and has talked to employees about the seriousness of sales and service of alcohol. Judge Lane encouraged Mr. Johnson to contact Bob Younger for training. Mr. Johnson stated he is not making any changes to July 12, 2004 the premise and that previous manager will fill in when Mr. Johnson is not on premise. Mr. Johnson stated they have an incentive program for employees if they catch a fake id. Judge Lane approved the transfer of ownership of Sportscaster Bar & Grill, 165 East Boardwalk, From Hoffers' Sports Bar and Grill, Ltd., to J. Douglas Johnson Investment, Inc., contingent upon the receipt of lease expressly allowing the sale and service of alcohol on the premise. Hearing on a New Application from The Criterion Group, LLC, for a Hotel -Restaurant Liquor License at The Melting Pot, 334 East Mountain Avenue, Approved Kerri Gallant, representative for The Criterion Group, LLC, was swom. She briefly described her background and training she has received. Ms. Gallant stated they will be registering a different manager than is currently listed. She stated the first floor will remain as submitted in the application. In response to questions from the Judge, Ms. Gallant clarified the diagram. She stated their carding policy will be to card anyone who appears to be under 30. Ms. Gallant stated the training provided by The Melting Pot is extensive, however she is planning to attend Officer Younger's training. Ms. Gallant briefly described the petitioning process. She stated the petitions were favorably received. Ms. Gallant stated she gave people the opportunity to sign the petition in opposition to this application. Judge Lane adopted Resolution 2004-09 approving an application from The Criterion Group, LLC, for a hotel -restaurant liquor license at The Melting Pot, 334 East Mountain Avenue, contingent upon employees receiving training prior to the restaurant opening. Hearing on New Application from Pho Duy4, Inc., dba Pho Day, 920 West Drake Street. Suite DI for a Beer and Wine License, Approved Sue Tran, representative for Pho Duy 4, Inc., was sworn. She stated that the emphasis of the restaurant is food. Ms. Tran stated many customers have requested either beer or wine with their meal. She stated she will contact Officer Younger for training for her and her employees. Ms. Tran stated she has no experience in the sale or service of alcohol. She stated she will terminate any employee found in violation of the liquor code. Ms. Tran submitted a new floor diagram. Assistant City Attorney Ablao stipulated to the petitions and summary from Oedipus, Inc. Judge Lane stated the petitions show support for this application. Judge Lane adopted Resolution 2004-07 approving an application from PhoDuy, Inc., for a beer and wine license at Pho Duy, 920 West Drake, Dl. July 12, 2004 Hearing on a New Application from Nyala Ethiopian Cuisine, LLC, for a Hotel -Restaurant Liquor License at Nyala Ethiopian Cuisine, 2900 Harvard Street, Suite A. Approved Menwyelet Atsedu and Etagengehu Asret, representatives for Nyala Ethiopian Cuisine, LLC, were sworn. Mr. Atsedu briefly described their backgrounds. He stated they plan to attend classes thru the Small Business Bureau and the Larimer County Sheriff's office. Mt. Atsedu stated they are planning on opening August 15, 2004. He stated that the emphasis will be on food sales. In response to questions from the Judge, Mr. Atsedu clarified the diagram of the premise. He stated they will have approximately 10 employees. Mt. Atsedu stated they will terminate any employee that is found in violation of the liquor code. Mr. Atsedu briefly described the petitioning process. He stated the overall response was positive. Judge Lane adopted Resolution 2004-12 from Nyala Ethiopian Cuisine, LLC for a hotel -restaurant liquor license at Nyala Ethiopian Cuisine, 2900 Harvard Street, Suite A, contingent upon training of the owners and all employees be completed prior to opening. Hearing on a New Application from Sushi by Kevin, LLC for a Hotel -Restaurant Liquor License at Sushi by Kevin, 126 West Laurel Street, Approved Aaron Vincent and Kevin Muraski, representatives for Sushi by Kevin, LLC were sworn. Mr. Vincent stated he has received extensive training in the sale and service of alcohol. He stated every customer will be carded that orders alcohol. Mr. Vincent stated he has the liquor code on premise. He submitted the training manual all employees will be required to be familiar with. Mr. Vincent stated their seating capacity is 40. He stated that an intentional violation of the liquor code will result in immediate termination. Mr. Vincent stated they do their own compliance checks. Mr. Muraski stated he has experience in the ordering and storage of alcohol. He stated he will be on premise over 40 hours a week. Mr. Vincent briefly reviewed the petitioning process. Mr. Muraski stated that the opposition they received on this application was concern from citizens to their proximity to Colorado State University. Mr. Muraski stated their emphasis will remain food. He stated that currently their food sales is over 80% of their total sales. Judge Lane adopted Resolution 2004-11 from Sushi by Kevin, LLC for a hotel -restaurant liquor license at Sushi by Kevin,126 West Laurel Street contingent upon approval of their training program from Officer Robert Younger, Liquor Enforcement Officer. 4 July 12, 2004 Request from Carraba's/Colorado - I Ltd.; Carrabba's Italian Grill, Inc., dba Carrabba's Italian Grill to Change, Alter, or Modify the Licensed Premises at 1212 Oakridge Drive, Approved Bradley Seymore, representative for Carrabba's Italian Grill, briefly described the changes. He stated that the public could go into the main portion of the restaurant to wait for their order. Mr. Seymore stated there is no seating in the take-out area. He stated they are in compliance with all city codes. Judge Lane approved the request from Carrabba's/Colorado - I Ltd.; Carrabba's Italian Grill, Inc., dba Carrabba's Italian Grill to change, alter or modifythe licensed premises at 1212 Oakridge Drive. Registration of Bradley Seymore as Manager of Carrabba's Italian Grill 1212 Oakridge Drive, Approved Bradley Seymore, manager application, briefly described his training and background. He stated approximately 30 employees are directly involved with the sale and service of alcohol. Mr. Seymore stated he meets with his staff on a monthly basis. He stated he is on premise 60-65 hours a week. Mr. Seymore stated anyone who appears to be under the age of 30 is carded. He stated he has never been in violation of the liquor code. Mr. Seymore stated he has copy of the current liquor code on premise. Judge Lane approved Bradley Seymore as Manager of Carrabba's Italian Grill, 1212 Oakridge Drive. Show Cause Hearing for Carrabba's/Colorado - I Ltd.; Carrabba's Italian Grill, Inc., dba Carrabba's Italian Grill, 1212 Oakridge Drive, Stipulation Agreement Approved Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a $200 fine and written warning, for violating Regulation 47-302 of the Colorado Liquor Code, failing to obtain the written consent of the local and state licensing authorities prior to changing, altering or modifying the licensed premise.
