Regular Meeting - September 13, 2004

A regular meeting of the Liquor Licensing Authority was held on September 13, 2004 in Municipal
Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Bob Younger, Liquor Enforcement Officer
Agenda Review
Deputy City Clerk Jensen stated there are no changes to the agenda.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time
and energy on the important items on a lengthy agenda. Items on the Consent Agenda are (1) routine
items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off
the Consent Agenda and considered separately. Items pulled from the Consent Agenda will be
considered separately immediately following adoption of the Consent Agenda.
a. Transfer of Ownership of Black -Eyed Pea, 4312 South College Avenue. from Colorado
Restaurant Management. Inc.. to BEP Colorado Restaurants, LLC.
Judge Lane adopted the Consent Agenda.
Show Cause Hearing for SGC&C, Inc.,
dba Tailgate Tommy's,145 East Mountain Avenue,
Stipulation Agreement Approved
Zach Wilson, attorney representing SGC&C, Inc., stated he has discussed the stipulation agreement
with his client.
Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the
Licensee has agreed to a 50 day suspension, 20 days served (holdover from previous violation
included), with 30 days held in abeyance for 1 year for violating Regulation 47-900 of the Colorado
Liquor Code, Conduct of Establishment, to wit: "each person licensed...... and any employee or agent

of such shall conduct the licensed premises in a decent, orderly and respectable manner; and shall
not permit on the licensed premises the serving and loitering of a visibly intoxicated person ..... nor
shall the licensee, his employee or agent knowingly permit any activity or acts of disorderly
conduct......:" and City Code Section 3-81(a) which requires a licensee, manager or employee to
"immediately report to Police Services any unlawful or disorderly conductor disturbance committed
in or upon the licensed premises".
Judge Lane approved the stipulation agreement as presented.
Registration of Valerie Bostic as
Manager of Black -Eyed Pea, 4312 South College Avenue, Approved
Valerie Bostic, manager applicant, briefly described her background and training. She stated they
have secret shoppers test their establishment for compliance with liquor laws and are rated. Ms.
Bostic stated staff is required to card patrons that appear to be under 40 years of age. She stated any
employee found in violation of the liquor code is immediately terminated. Ms. Bostic stated she has
a current copy of the liquor code on premise.
Judge Lane approved the registration of Valerie Bostic as manager of Black -Eyed Pea, 4312 South
College Avenue.
Registration of Eric Horvat as Manager of
Boston's The Gourmet Pizza, 1526 Oakridge Drive,
Continued to September 27, 2004
Judge Lane continued consideration of this application to September 27, 2004.
