Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on September 22, 2008 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Jenny LopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated that the Show Cause Hearing for Sullivan's Sports Tavern, 820 City Park, will be heard after the Consent Agenda. Consent Agenda The Consent Agenda is intended to expedite the meeting and allow the Authorityto spent its time and energy on the important items on a lengthyagenda. Items on the Consent Agenda are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered separately immediately following adoption of the Consent Agenda. 1) Registration of David Cannon as Manager of Smashburger. 2550 East Harmon Judge Lane adopted the Consent Agenda. Show Cause Hearing for Sullivan's Sports Tavern, 820 City Park Avenue, Stipulation Agreement Accepted Michael Hamm and Ronald Harrison, representatives for Slips TMT, LLC, stated they have admitted to the violation. Assistant City Attorney LopezFilkins summarized the stipulation agreement. She stated that the Licensee has agreed to a 25 day suspension, 10 days served (paid fine in lieu of suspension $4047.80), with 15 days held in abeyance for 1 year for violating Colorado Liquor Code Regulation 47-700 (failure to allow inspection) and Regulation 47-900 (permitting loitering of or serving intoxicated persons). Judge lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Slips TMT, LLC, Sullivan's Sport's Tavern, 820 City Park Avenue. September 22, 2008 Hearing on a New Application from Integrated Capital -Fort Collins Sub III, LLC & Residence Inn by Marriott for a beer and wine license at Residence Inn by Marriott, 1127 Oakridge Drive. Approved Adam Stapen, attorney representing Integrated Capital - Fort Collins Sub III, LLC & Residence Inn by Marriott, stated this application is from a stipulation agreement the owners have with the State's Liquor Enforcement Division. Johna Foster Miller, manager of operations, briefly described her job responsibilities. She stated that there are no changes to the operations of the hotel. Ms. Miller stated all employees serving guests are TIP's trained. She stated guests have requested they sell beer and wine. Assistant CityAttomeyLopezF!dm stipulated to the petitions being entered into evidence. Judge Lane adopted Resolution 2008-20 approving an application from integrated Capital -Fort Collins Sub III, LLC, and Residence Inn by Marriott for a beer and wine license at Residence Inn by Marriott 1127 Oakridge Drive. Hearing on a New Application from Integrated Capital -Fort Collins Sub II, LLC & Courtyard by Marriott for a beer and wine license Adam Stapen, attorney representing Integrated Capital - Fort Collins Sub II, LLC, and Courtyard by Marriott, stated this application is from a stipulation agreement the owners have with the State's Liquor Enforcement Division. Chris Davis, Assistant General Manager, briefly described his job duties. He stated he requires all employees that serve the beer and wine to be TIP's trained. Mr. Davis stated guests have requested that they serve beer and wine. Assistant City Attorney LopezFMdm stipulated to the petitions being entered into evidence. Judge Lane adopted Resolution 2008 - 21 approving an application from Integrated Capital - Fort Collins Sub II, LLC, and Courtyard by Marriott for a beer and wine license at Courtyard by Marriott, 1200 Oakridge Drive. Hearing on a New Application from K&L, Inc., for a hotel -restaurant liquor license at Louis Chagolla, representative for K&L, Inc., was sworn. He stated theyare a restaurant, not a bar and will have approximately 35 employees. Mr. Chagolla stated the restaurant will seat 135 people. He stated he will be involved in the dayto dayoperations of this establishment. Mr. Chagolla stated he has 2 September 22, 2008 a hotel -restaurant liquor license in Greeley and have never had a liquor code violation. He stated patrons appearing to be under the age of 35 will be carded. Mr. Cagolla stated he has been in the restaurant for 25 years. Judge Lane adopted Resolution 2008 - 19 approving an application from K&L, Inc., for a hotel - restaurant liquor license at Zquila Mexican Restaurant, 2400 East Harmony, Suite 101.
