Regular Meeting - January 26, 2004

A regular meeting of the Liquor Licensing Authority was held on January 26, 2004 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated there were no changes to the agenda.
Show Cause Hearing for Kevin's Pub,
1609 South College Avenue, Stipulation Agreement Approved
Kevin and Lorraine Archer, representatives for Kevin's Pub, Inc., stated they are familiar with the
stipulation agreement.
Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the
Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $242), with
10 days held in abeyance for 1 year for violating C.R.S., 12-47-901(1)(a.5), permitting the sale or service
of alcohol beverages to a person under the age of 21 years.
Judge Lane approved the stipulation agreement as presented.
Show Cause Hearing for Pizza Hut Restaurant,
1075 Pennock Place, Stipulation Agreement Approved
Stephen Lee, attorney representing Mountain View Pizza, LLC, stated he is familiar with the stipulation
agreement. Mr. Robert Swisher (area manager) and Mr. Mike Kuntz (on -site manager) stated that this
is their first liquor code violation. Mr. Kuntz briefly described the changes they have made.
Judge Lane stated they must provide proof of training by April 30, 2004.
Judge Lane approved the stipulation agreement as presented.

Transfer of Ownership of County Cork Pub,
313 West Drake Avenue, from County Cork Inc.,
to Athenian Gardens. LLC and Trade Name Change to Athenian Gardens, Approved
Steve Flevotomos, representative for Athenian Gardens, LLC briefly described his background. He
stated he has an employee at the front door checking id's in the evening. Mr. Flevotomos stated he is
on premise every day.
Elena Flevotomos, representative for Athenian Gardens, LLC stated she has experience in the sale and
service of alcohol. She stated they do not allow anyone under 21 in the establishment after 8:00 p.m.
Ms. Flevotomos stated she is on site every day. She stated she has not made any changes to the interior
of the establishment. Ms. Flevotomos stated they card anyone who appears to be 45 years of age or
younger. She stated that if any employee is found in violation of the liquor code will be terminated.
Judge Lane approved the transfer of ownership of County Cork Pub, 313 West Drake Avenue, from
County Cork, Inc., to Athenian Gardens, LLC and Trade Name Change to Athenian Gardens.
Transfer of Ownership of Pobre Panchos Restaurant
from Frank and Mary Perez, to Pobre Pancho's Restaurant, LLC
at 1802 North College Avenue, Approved
Frank and Mary Perez, representatives for Pobre Pancho's Restaurant, LLC, stated they have been
working the restaurant for 35 years. Mr. Perez stated the premise is staying the same, they are just
changing the legal entity.
Judge Lane approved the transfer of ownership of Pobre Panchos Restaurant from Frank and Mary
Perez to Pobre Pancho's Restaurant, LLC at 1802 North College Avenue.
Transfer of Ownership of China Palace Restaurant,
117 South College Avenue from Amy H. Huang, to
China Palace Restaurant, Inc., Approved
Shen Chou Chang, representative for China Palace Restaurant, Inc., stated he has been working in this
restaurant for 17 years. He stated he has not had any liquor code violations. Mr. Chang stated he trains
all the employees. He stated he is not changing the interior of the restaurant. Mr. Chang stated the
previous owner is no longer working the restaurant. He stated 6-7 employees are directly involved with
the sale and service of alcohol. Mr. Chang stated he is on premise every day. He stated he has the
liquor code on premise.
Judge Lane approved the transfer of ownership of China Palace Restaurant,117 South College Avenue
from Amy H. Huang, to China Palace Restaurant, Inc.

Transfer of Ownership of Island Grill,
2601 South Lemay Avenue from Island Grill, Inc., to Tivine. LLC. Approved
Kenneth Kuk, representative for Tivine, LLC, briefly described his background. He stated he is T.I.P.'s
and Barcode certified. Mr. Kuk stated they have not changed the premise other than paint. He stated
they have been open since January 2, 2004. He stated they have a total of 16 employees of which 11
are involved in the sale and service of alcohol. Mr. Kuk stated they card patrons that appear to be 35
years of age or younger. He stated patrons are only carded if they order alcohol. Mr. Kuk stated the
emphasis of this establishment is food.
Harold Walker, representative for Tivine, LLC, briefly described his background. He stated he is also
T.I.P.'s and Barcode certified. Mr. Walker stated they have the liquor code on premise. He stated they
are aware they must provide full meals after midnight.
Judge Lane approved the transfer of ownership of Island Grill, 2601 South Lemay Avenue from Island
Grill, Inc., to Tivine, LLC, contingent upon receipt of proof of training within 60 days.
Transfer of Ownership of Goff's Golf Shop @ City Park Nine,
411 South Bryan, from Mike William Goff, to DMAC Golf, LLC
and Trade Name Change to City Park Nine Golf Course, Approved
David McCleave, representative for DMAC Golf, LLC, stated he intends to attend Officer Younger's
training. He stated he is not making any changes to the premise. Mr. McCleave stated he will make sure
his employees receive proper training. He stated he has current copy of the liquor code on premise.
Judge Lane approved the transfer of ownership of Gofi's Golf Shop @ City Park Nine, 411 South
Bryan, from Mike William Goff, to DMAC Golf, LLC and Trade Name Change to City Park Nine Golf
Course.
