ROLLCALL The meeting was called to order. 2. APPROVAL OF MINUTES Little made a motion to approve the minutes from the May 31, 2007 meeting. Packard seconded the motion. The motion passed. 3. David Bouts dlb/a Construction Management Solutions: I= introduced this appeal He noted that the appellant was in the process of applying for a C2 license and supervisor certificate and that, according to the City's licensing requirements, to qualify for a Class C2license or supervisor certificate, an applicant must have constructed or supervised the construction of three (3) completed new multi -family buildings, including one building that includes 16 or more units, or that is three or more stories in height. Lee reviewed the projects submitted by the appellant in support of his license request, including: 2532 Raintree Drive, Fort Collins, Colorado— 18-unit apartment building. • 2544 Raintree Drive, Fort Collins, Colorado— 18-unit apartment building. Karla Smith - 6.26 O7.minutes.appvd_pdf Page 2 BRB June 28, 2007 Pg. 2 Lee explained that staffs verification of these projects with the listed reference found that the applicant's role was overall project manager in both instances and NOT the designated on -site supervisor. Although the applicant may have been on -site occasionally, his rolelinvolvement on these projects does not qualify as the required "construction supervisor" defined in the ordinance as: "Supervisor shall mean a person who holds a supervisor certificate as specified in this Article and who is actively working exclusively for a licensed contractor expressly to provide direct, personal and ongoing on - site construction supervision of a construction project undertaken by the contractor..." Based on this information, and the fact that the appellant does not have a third project to submit that qualifies for the C2 license, staff has denied this license request. Lee added that the appellant took the City's C2 exam on April 19, 2007 and scored an 84%. He also noted that the appellant holds a Class DI license with the City of Fort Collins which he obtained on March 19, 2007. According to Lee, the appellant has a pending project at 2002 Raven View which would require a C2 license to complete. The Board heard testimony from the appellant, David Hours. After closing statements, the Board discussed the information that was presented. Little made a motion to approve a C2 license and supervisor certificate that would enable the appellant to complete the pending Fort Collins project based on the appellant's core competencies and experience, both professionally and as documented on the two Raintree projects. He added that approval of an ongoing C2 license and supervisor certificate would be contingent on appeicant's completion of the 2002 raven View project where he will be the owner and on -site supervisor. Smith seconded the motion. Vote: Yeas: Packard, Little, Smilie, Cram, and Smith Nays: None 5. Darin Hunt, dtb/a United Construction, LLC: Lee introduced this appeal. He noted that the appellant is in the process of applying for an E license and supervisor certificate. Lee explained that according to the City's licensing requirements, to qualify for a Class B license or supervisor certificate, an applicant must have constructed or supervised the construction of three (3) completed tenant finish projects. Two of these projects must exceed twenty thousand dollars in total construction value and at least one of the projects must exceed fifty thousand dollars in total construction value. Lee stated that the appellant had submitted projects that meet the experience qualifications. However, he added that the appellant was found working at 3711 JFK Parkway on June 21, 2007 without a valid license or permit and that, according to the Stop Work Order issued, wall framing, sheetrock and electrical work had been completed. Lee reviewed a report which indicated that a number of items were outstanding on this permit, including: • Bldg Insp Plan Review —HOLD —Need lighting wattage worksheet. • Contractor Licensing Karla Smith - 6.28.07.minutes.appvd.pdf T Page 3 BRB June 28, 2007 Pg. 3 • Fire Authority Review —Not yet reviewed • W W W Backflow, Review —Not yet reviewed Lee noted that staff had been somewhat delayed in processing licensing applications; however, that this would not have made a difference in this case since there are other items outstanding that would have kept the permit from being issued. According to Lee, the appellant previously held a Class DI license with the City of Fort Collins which was issued on May 12. 2003, and should have been familiar with contractor licensing and permitting requirements. He noted that this license expired May 12, 2005 and was never renewed. Lee explained that under this license, there were several issues, including: • 2926 Stonehaven Drive -- basement finish work was done prior to obtaining a permit. • 5124 Abbey Road — basement finish work was done prior to obtaining a permit. • 6112 Hamilton Court — two permits erroneously and therefore invalidly issued to the appellant because he had not completed renewal of his license, which expired on May 12, 2005. The permits were issued on June 16, 2005. Lee explained that as part of normal processing, occupancy violation notices were sent out for the projects done at 6112 Hamilton Court since the permits had not been closed. When the appellant came in to reinstate the permits, it was found that his license was expired past the 60- day grace period. The appellant was informed of the items that needed to be completed to get this accomplished and that the permits could not be reinstated until this was finished. The following Hold was then placed on his license account: "DARRIN HUNT WILL NEED TO GO BEFORE THE BOARD BEFORE REINSTATING LICENSE (AS PER FELIX) - HE WAS WORKING WITH EXPIRED (AND THEN INACTIVE) LICENSE - HE CAME IN TO REINSTATE SOME EXPIRED PERMITS (B0502604 & B0502603), IT WAS REALIZED THEN HIS LICENSE WAS INACTIVE AND HE WAS NOTIFIED THAT HE WILL NEED TO RETEST BEFORE GETTING REINSTATED. HOMEOWNER SAID WORK WAS COMPLETED IN AUGUST 2005." Lee next reviewed the licensing ordinance provisions in circumstances where a contractor works without a license or has committed any other violations found in Section 15-162. He explained that the contractor is required to go before the Building Review Board for a determination on his/her fitness to be granted a license or supervisor certificate and that the fine for working without a license is equal to the license fee or $200. He added that this fine has not yet been collected. The Board heard testimony from the appellant, Darin Hunt. After closing statements, the Board discussed the information that had been presented. Little made a motion to approve the E license that was requested with the stipulation that a letter of reprimand be placed in the appellant's contractor file outlining the violations that had occurred as well as noting that any violations occurring in the next twelve months would result in immediate suspension of the license. He added that this license approval was contingent on payment of all outstanding fines and fees. Smilie seconded the motion.
