Regular Meeting - August 6, 2007

A regular meeting of the Liquor Licensing Authority was held on August 6, 2007 in Municipal
Court, Justice Center, 215 North Mason. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated there are no changes to the agenda.
Approval of Minutes
Judge Lane approved the minutes from June 18, 2007 and July 9, 2007.
Show Cause Hearing for S & A Restaurant Corporation, dba Bennigan's,
2203 South College Avenue, Stipulation Agreement Approved
Marc Painter, attorney representing the Licensee, stated the Licensee has made numerous changes
at this location to address this last violation. He stated they are in the process of hiring a new general
manager.
Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the
Licensee has agreed to a 20 day suspension,10 days served, with 10 days held in abeyance for 1 year
for violating C.R.S. 12-47-901 (1)(a. 5), permitting the sale or service of alcohol beverages to aperson
under the age of 21 years.
Judge Lane approved the findings, conclusion, and order accepting the stipulation agreement as
presented for Bennigan's, 2203 South College Avenue.

Registration of Chris Chandler as
Manager of Rasta Pasta,
200 Walnut Street, Approved
Chris Chandler, manager applicant, stated anytime an alcoholic beverage is ordered, the patron must
present a valid id. He stated they do not have a bartender. Mr. Chandler stated he is on premise 50
hours a week. He stated all employees sign an agreement stating a violation of the liquor code can
lead to termination. Mr. Chandler stated he does not have a current copy of the liquor code on
premise. He stated he has never had a liquor code violation.
Judge Lane approved the registration of Chris Chandler as manager of Rasta Pasta, 200 Walnut
Street.
Registration of Kelly Anne Williams
as Manager of Hilton Garden Inn,
2821 East Harmony Road, Approved
Kelly Anne Williams, manager applicant, briefly described her background. She stated she has been
in the hotel business for 14 years. Ms. Williams stated any patron who appears to be under 40 will
be carded. She stated any employee found in violation of the liquor code will be immediately
terminated. Ms. Williams stated she has not had a liquor code violation.
Judge Lane approved the registration of Kelly Anne Williams as manager ofHilton Garden hm, 2821
East Harmony Road.
Request from The Criterion Group, LLC
dba The Melting Pot to
Change, Alter, or Modify the Licensed Premises at
334 East Mountain Avenue for August 17 -19, Approved
Ryan Houdek, representative for the licensee, stated the proposed changes are the same as the
previous year. He stated he is creating a three foot gap between the NewWest Fest crowd and the
patio area by adding an additional fence. Mr. Houdek stated he will amend the diagram.
Judge Lane approved the request from The Criterion Group, LLC, dba The Melting Pot to change,
alter, or modify the licensed premises at 334 East Mountain Avenue for August 17, 18, and 19.

Transfer of Ownership of Somi's,
1544 Oakridge Drive from Walter Neuhold, Inc.,
to JCM Enterprises, Inc., and
Trade Name Change to Savoy Brasserie, Approved
Jean and Chantal Martini, representatives for JCM Enterprises, Inc., stated they are only making
cosmetic changes to the premises. Ms. Martini briefly described her background. She stated any
employee found in violation of the liquor code will be immediately terminated. Ms. Martini stated
she has a current copy of the liquor code on premise.
Judge Lane approved the transfer of ownership of Somi's, 1544 Oakridge Drive from Walter
Neuhold, Inc., to JCM Enterprises, Inc., and trade name change to Savoy Brasserie.
Hearing on a New Application from The Old Firehouse Beer & Wine, LLC,
for a Retail Liquor Store License at
Old Firehouse Wine and Beer. 232 Walnut Street, Approved
Doug and Dena Snyder, representatives for The Old Firehouse Beer & Wine, LLC, were sworn. Ms.
Snyder briefly described her background and the type of retail liquor store this will be. She stated
they will do everything they can to discourage irresponsible consumption of alcoholic beverages.
Ms. Snyder stated they are enrolled to attend TIP's training on August 20. Mr. Snyder briefly
described his background. He stated they will open the end of September, beginning of October.
Ms. Snyder stated any employee found in violation of the liquor code will be immediately
terminated.
Senior Assistant City Attorney Ablao stated she is stipulating to the petitions done by Oedipus, Inc.
Mr. Snyder stated the petitions demonstrate a need for this store. Judge Lane entered the petitions
as Exhibit 1.
Ms. Snyder submitted letters of reference for the Judge's consideration and marked as Exhibit 2.
George Buxton, character witness, stated Mr. and Mrs. Snyder will be responsible liquor licensees.
John Marvin, character witness, stated Mr. and Mrs. Snyder will be responsible liquor licensees.
Judge Lane adopted Resolution 2007-15 approving an application from The Old Firehouse Beer &
Wine, LLC, for a retail liquor store license at Old Firehouse Wine & Beer, 232 Walnut Street.

Hearing on a New Application The Chocolate Caf6, Inc.,
for a Hotel -Restaurant Liquor License at The Chocolate Caf6,
102 West Olive, Approved
Tim Dow, attorney representing The Chocolate Caf6, Inc., stated the applicant is ready to proceed.
Steven Levinger, landlord for The Chocolate Caf6, Inc., was sworn. In response to a question from
Tim Dow, Mr. Levinger confirmed he submitted a letter in support of this application.
Kathy Spear, representative for The Chocolate Caf6, Inc., stated she has an extensive background
in the food and beverage industry. She briefly described her duties. Ms. Spear stated she expects
food sales to be at least 70%.
Mr. Del Duca, representative for The Chocolate Caf6, Inc., was sworn. He stated he is the operations
manager. Mr. Del Duca stated he and Ms. Spear are TIP's trained. He stated all patrons ordering
alcohol will be carded. Mr. Del Duca stated any employees found in violation of the liquor code will
be immediately terminated. He briefly described the premise.
In response to questions from Mr. Dow, Mr. Del Duca briefly described the petitioning process. He
stated he received no opposition to this application. Mr. Del Duca stated the results were mixed as
to whether or not an individual's needs were being met by the current liquor licenses within the
neighborhood.
Judge Lane adopted Resolution 2007-14 approving an application from The Chocolate Caf6, Inc.,
for a hotel -restaurant liquor license at The Chocolate Caf6, 102 West Olive.
