HomeMy WebLinkAboutBuilding Review Board - Minutes - 03/29/2007FORT COLLINS BUILDING REVIEW BOARD Regular Meeting — March 29, 2007 A regular meeting of the Building Review Board was held on Thursday, March 29, 2007 in the Council Chambers of the Fort Collins Municipal Building at 300 LaPorte Avenue, Fort Collins, Colorado. David Carr Alan Cram Mike Gust Gene Little Michael Smilie, Chair George Smith ABSENT: lim Packard Felix Lee, Neighborhood & Building Services Director Paul Eckman, Deputy City Attorney Delynn Coldiron, Contractor Licensing & Admin Services Coordinator AGENDA: 1. ROLLCALL The meeting was called to order and roll call was taken. 2. APPROVAL OF MINUTES Carr noted a couple of corrections for the draft minutes. He then made a motion to approve the minutes from the February 22, 2007 meeting, as amended. Little seconded the motion. The motion passed. 3. Rental Housing Standards Appeal Hearing — Peter Schultz, Appellant — 505 Locust Street Attorney Eckman provided some instructions regarding the Resolution that had been drafted for this case. Board Members discussed the Resolution and offered a small change. Cram made a motion to approve the Resolution, as amended. Little seconded the motion. The motion passed. Vote: Yeas: Carr, Little, Smilie, Cram, Smith and Gust Nays: None Bn Match 29, 2007 Pg. 2 4. Del Bunker, d/b/a Tuff Shed, Inc.: Lee introduced this appeal. He noted that the appellant was,in the process of applying for a D2 license and supervisor certificate. He explained that, according to the City's licensing requirements, to qualify for a Class D2 license or supervisor certificate, an applicant must have constructed or supervised the construction of three (3) completed projects, each with a construction value of not less than fifteen thousand dollars ($15,000.) and each of which entailed the significant structural alteration of or the addition to a single-family home or equivalent structure as determined by the Building Official. Lee stated that the appellant's company performs work sufficient for the D2 license. However, the appellant, in his role as Product Manager and Assistant Secretary, is responsible for testing and maintaining all company contractor licenses and never performs construction site supervision. Therefore, Lee explained, the appellant is unable to obtain three project verification forms that document his involvement as a construction site supervisor. Lee added that the appellant did take the City's D2 exam on March 15, 2007 and scored a 93%, The Board heard testimony from the appellant, Del Bunker. After closing statements, the Board discussed the information that was presented Carr made a motion to deny the request for a D2 license and suggested that specific projects be submitted to the Board on a case by case basis for approval. There being no second, the motion was withdrawn. Little made a motion to approve the D2 license requested, accepting the appellant's testimony as sufficient experience, with the condition that he provide on -site supervision until such time that the company gets another supervisor tested and approved by the City. Smith seconded the motion. After further discussion, this motion was withdrawn. Gust seconded the motion. Vote: Yeas: Carr, Little, Smilie, and Gust Nays: Cram and Smith 5. David Franklin, d/b/a B & B Contracting: Lee introduced this appeal. He stated that the appellant had applied for a D 1 license and supervisor certificate. Lee explained that, according to the City's licensing requirements, to qualify for a Cass DI license or supervisor certificate, an applicant must have constructed or supervised the construction of three (3) completed new single-family homes or the equivalent thereof as determined by the Building Official. Lee noted that the appellant has one project that meets this licensing criteria; however his remaining projects do not In addition to the construction of a single-family home, the appellant provided documentation on a new commercial building that was construction, as well as a commercial tenant finish. Lee stated that the appellant took the City's D 1 exam on March 15, 2007. He scored a 99%. As well Lee noted that, according to appellaries information, he has a degree from Colorado State BRB March 29, 2007 Pg. 3 R University in Construction Management and has also taken classes in LEED Building Practices and Guidelines. The Board heard testimony from the appellant, David Franklin. After closing statements, the Board discussed the information that had been presented. Little made a motion to approve appellant's request for a DI license. Carr seconded the motion. Vote: Yeas: Can-, Little, Smilie, Cram, and Smith Nays: Gust Other Business Lee provided an update on IBC and Properly Maintenance Code efforts currently undervay. As well, he noted an upcoming meeting for Board & Commission members related to the City's budgeting for outcomes efforts.
