A regular meeting of the Liquor Licensing Authority was held on June 12, 2006 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated there are no changes to the agenda.
Approval of Minutes
Judge Lane approved the minutes from May 15, 2006.
Show -Cause Hearing for Rich's Aggie Discount Liquor, Inc.,
dba Rich's Aggie Discount Liquor,
429 Canyon Avenue, Stipulation Approved
Richard Schott, representative for Rich's Aggie Discount Liquor, Inc., dba Rich's Aggie Discount
Liquor, stated he admits to the violation.
Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee
has agreed to a 15 day suspension, 5 days served (by paying a fine in lieu of suspension of $5000),
and 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901 (a.5)(I) of the Colorado
Liquor Code, permitting the sale or service of alcohol beverages to a person under the age of 21
years.
Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as
presented for Rich's Aggie Discount Liquor, 429 Canyon Avenue.

dba Thai Pepper,109 East Laurel,
Stipulation Agreement Approved
Forest Orswell, attorney representing Thai Pepper, LLC, stated the employee violating the liquor
code has been terminated.
Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee
has agreed to a 15 day suspension, 5 days served (by paying a fine in lieu of suspension of $200),
and 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901 (a.5)(1) of the Colorado
Liquor Code, permitting the sale or service of alcohol beverages to a person under the age of 21
years.
Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as
presented for Thai Pepper, 109 East Laurel Street.
Judge Lane accepted the admission of violation and set the penalty as recommended by Assistant
City Attorney Ablao.
Show -Cause Hearing for Arts Alive Fort Collins,
dba Arts Alive 218 Linden Street,
Stipulation Agreement Approved
Donna Visocky, representative for Arts Alive Fort Collins, stated they will not allow anyone to be
used without a representative from Arts Alive present to monitor the event.
Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee
has agreed to a 1 day suspension, holding that 1 day in abeyance for 1 year for violating C.R.S. 12-
47-901 (5)(d) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to
a person under the age of 21 years.
Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as
presented for Arts Alive Fort Collins, 218 Linden Street.
Consideration of an Application from
y Arts Alive Fort Collins for
a Special Events Permit at
New Belgium Brewing Co., 500 Linden, Approved
Donna Visocky, representative for Arts Alive Fort Collins, briefly described the event. She stated
all the directors of Arts Alive Fort Collins have been TIPS trained. Ms. Visocky stated they have
not had any problems at these events.
Judge Lane approved the application from Arts Alive Fort Collins for a Special Events Permit at
New Belgium Brewing Co., 500 Linden.

Request from John K Latendresse,
dba The Town Pump to Change, Alter, or Modify
the Licensed Premises at 124 North College Avenue, Approved
Jake Latendresse, owner, stated he has new diagrams. In response to questions from the Judge, Mr.
Latendresse detailed the new diagram. He stated he will have a door person stationed on the patio
whenever the patio is in use. Mr. Latendresse stated the door person will also provide after hours
security for the retail stores in the alley.
Leesa Johnson, general manager, briefly described the petitioning process. She stated everyone she
talked to was supportive of this application.
Judge Lane approved the application from John K. Latendresse, dba The Town Pump to Change,
Alter, Modify the Licensed Premises at 124 North College Avenue.
Hearing on a Change of Location Application from
Wine Ventures, Inc., dba Old Town Wine & Spirits,
to move a Retail Liquor Store License from
105 West Mountain Avenue, to 214 South College Avenue, Approved
Charles Carlson, representative for Wine Ventures, Inc., stated he is requesting his license to be re-
located to 214 South College Avenue. He stated the nature of the business will remain the same.
Mr. Carlson stated he will realize a small increase in square footage and increase in parking
availability. He stated he is active in supporting downtown businesses.
Judge Lane approved the change of location application from Wine Ventures, Inc., dba Old Town
Wine & Spirits, to move a retail liquor store license from 105 West Mountain Avenue, to 214 South
College Avenue.
Transfer of Ownership of Tailgate Tommy's,
145 East Mountain Avenue, from
High Plains Management, LLC to
Nacareme, LLC, Approved
Samuel K. Hammel, representative for the Licensee, briefly described his background. He stated he
will split his time between Fort Collins County Cork and Tailgate Tommy's. Mr. Hammel stated
they will only be making cosmetic changes. He stated there will be no changes in the days and hours
of operation. Mr. Hammel stated he requires all new employees to attend Liquor Enforcement
Officer Younger's class. He stated patrons are carded at the door in the evening. Mr. Hammel stated
he has a current copy of the liquor code on premise. He stated he will have significantly more
security personnel than the previous ownership.
Judge Lane approved the transfer of ownership of Tailgate Tommy's, 145 East Mountain Avenue,
from High Plains Management, LLC to Nacareme, LLC.
