I. The meeting was called to order by Chairman, Harry Tr.oxell, at 4:00 p.m.
in the Local Housing Authority Office located at 220 N. Meldrum.

Jack Walen presented to the Housing Authority the following chronological.
outline on the progress toward construction:
1. Architect's Contract - Approved
2. Architect's Cost Estimate - Approved
3. Development Cost Budget - Approved
4. Application for Revised ACC- Has been verbally.
ok'd by Washington but awaiting final approval
5. Reproduce Plans and Specifications - Mr. Lantz
is presently working on them now andthey should
be ready by the beginning, of February
6. Advertise for Bids- Anticipate to bid for 30 days

Harry Troxell asked when the job position for Clerk of the Works would be
advertised.
Jack Walen in answer said that when the plans and specs are out for bid,
in February, there will be advertising for that position.
Mr. Walen reported that he had discussed with HUD a question brought up at
the FCHA's last meeting of December 5, 1975, the question being whether
Miles Lantz should separately bill the FCHA for $5,000.00 for services rendered
under the old Turnkey architects contract or tack that amount on to the new
proposed architects contract of $43,000.00. "HUD has recommended that the
Housing Authority be billed separately for the $5,000.00 by Mr. Lantz to keep
the old architect's contract separate from the new contract," Mr. Walen said.
Mr. McCraw presented to the FCHA the architects agreement between the Housing
Authority and Miles Lantz and Architects. The agreement was signed on December 13,
1974.
Al Kruchten raised on objection, he said, "It was my understanding, the FCHA
would be given a proposed copy of the architects agreement to be ready for their
approval and not already signed."
Mr. Kruchten also asked that the minutes of this meeting reflect that no member of
the Housing Authority had an opportunity to review the contract with the architect
before it was executed.
Shelley Domann, Secretary to the FCHA, was requested to read Resolution #34 passed
at the Housing Authority's last meeting of December 5, 1974, concerning the proposed
architects contract.
Resolution #34 was read as follows:
"The City of Fort Collins Housing Authority hereby approves
the Architect's Contract between Miles Lantz and Architects
and the City of Fort Collins Housing Authority for the amount
of $48,000.00 and contingent upon the Department of Housing and
Urban Development's approval."
Al Kruchten added that a draftsman's wage is considerably less than $25.00 per
hour in the Fort Collins area. It was his feeling that this architect's commission -
required only some changing of existing plans and that most of the work was to be
done by draftsmen as indicated by Mr. Walen.
Mr. Walen rcpli.ed,"Arti.cle 1-10 on the itemization of Architect Fees for Con-
version to Conventional was merely a method for me to arrive at atotal." "Some
articles may exceed the amount approximated. "Some may be less than was approxi-
mated."
Mr. Walen then informed the. Authority they may negate the agreement to search
for another architect who perhaps is able to offer. services at a lower cost.
Irvine Wilson asked, "What are the chances the agreement may exceed the amount
of $43,000.007"
Mr. Vision said, "There is always that possibility." "If the Housing Authority

asks for additional. services above and beyond our plans, then the FCHA is
obligated to pay for these additional services." "If the bids are high or
if the contractor runs into needed additional services, which are not included
into our plans and specs, then it is Mr. Lantz'es obligation to redesign
down the plans and specs, and at no additional cost to the Authority." "If
the contractor defaults, there would be additional costs and services involved
which would be neither your fault nor ours and would call for negotiation."
The Authority members expressed concern over Article 6,,"Reimbursable Expenses",
of the architect's contract, which they felt left them too open for additional
expenses.
Mr. Walen reassured the Authority that the only additional services the Authority
may have to pay are specifically covered under Article 3, "Additional Services",
of the architects contract. "In order for us to charge you for any additional
services, we first need approval from you to perform the service."
Many of the Housing Authority members felt thatthey would like to request a
letter from Miles Lantz stating that the $43,000.00 is firm.
Ramsey Myatt said that to his recollection of the LHA's last meeting of December 5,
1975, Miles Lantz made the statement that the $43,000.00 was firm and any extra
charges or shortcomings were his responsibility. Mr. Myatt also stressed that
because Mr. Lantz said this, he is bound by his statement and because the item-
ization of architect ices proposed by Miles Lantz to the Housing Authority is
Included in the minutes of. November 26, 1974, the Housing Authority should be
assured thatthere will be no extra charges unless they authorize theneed for
the extra charge.
Jack Walen said, "If there is cause for amending the contract, we can do so
when the time comes.,,
V. Other Business
An up -date of the FCHA budget,as requested by Irvine Wilson at the last mect.ing
of December 5, 1974, was presented to the FCHA for their information.
Harry Troxell informed the Authority that Bill Davis of Public Service has.
notified him that Progressive Housing is presently trying to re-claim the
$8,400.00 down payment for gas taps, which have already been paid for by
the LHA to Andrew Willis at the closing of the contract.
Mr. Troxell suggested that Public Service should have some papers drawn up
by their legal attorneys saying we have no liability to Progressive Housing
regarding the $8,400.00 down payment for gas taps.
Air. McGraw said that. "Under the Assignment Agreement, Andrew Willis was to
pay to Progressive, $8,400.00 to take over Progressive's ownership of the
gas tapdown payment.. "Mr. Willis has said that he has paid Progressive for
these taps," Mr. McGraw added.
Mr. McGraw informed the FCHA that they have been requested by Ted Rodenback of
HUD to attend a meeting on the City Housing and Community Development Act,
scheduled for December 1.3, 1975 at 3:00 p.m. and 7:00 p.m. in the Student
Center at CSU. Nancy McComb and Alvin Kruchten expressed their witlinf;ne_ss
to attend the meetings.

at 4:00 p.m., in the office of the FCHA, located at 220 N. Meldrum.
