III. Mary Klopfenstein moved that the 3/11/76 minutes be amended by deleting
the words ". . . and costs for replacement of sod removed to accommodate
gardens" (Section VIII, Part B). The tenant shall be responsible for his
garden, but the Housing Authority will purchase grass seed with money
saved by not putting the sod in allotted areas for those tenants desiring
gardens. Nancy McComb seconded the motion and it passed 3 - 0. Chairman
Sanchez declared the minutes of the 3/11/76 meeting approved.
IV. Executive Director's Report
A. Project Colo. 41-1 is 95% complete with Memorandums of Acceptance ex-
ecuted on the four units on West Street at Site #12 and the Date of
Full Availability form was executed on Marth 31, 1976, to stop interest
on mortgage payments to HUD.

B. The City approved a grant of $6,263.18 for payment of water and sewer
charges for the period 4/10/75 - 4/20/76. The Housing Authority will
assume responsibility for charges after 4/20/76.
C. Annual Contributions Contract Amendment Request
Fiscal year amendment request was approved by HUD changing the ending
date from September 30th to December 31st. The Executive Director re-
quested the Housing Authority's approval. Nancy McComb moved for approv-
al, Mary Klopfenstein seconded the motion, and it passed 3 - 0. The
Chairman executed the Amendment.
A letter has been sent to Hal Knott, Director of the Colorado State
Division of Housing requesting $19,975.62 in assistance to complete
Project Colo. 41-1. (Previously distributed)
The Ft. Collins Housing Authority -received approval from HUD to use in-
terest- earned on investments, -for payment--of-project development -cost-s'. '='-

(See Exhibit "A" attached hereto.) - --- - — ----- -- ---- - -
Retroactive payment of retainage to Howard DeLozier Construction Inc.
was denied by HUD as per D.J. Dirksen's letter of March 29, 1976. (See
Exhibit "B" attached hereto.)
A letter requiring completion of State forms DR513 and DR513A as evi-
dence of payment of sales tax in compliance with the General Conditions
of the contract was sent to Howard Delozier Construction Inc. and Oak-
wood Corporation - A Joint Venture. (Previously distributed)
D. Wayne Taylor reported 74% full occupancy. One unit on Impala is not
yet occupied. Certificates of Occupancy had been issued for Rocky Road.
It was decided by a consensus of the Ft. Collins Housing Authority to
move housing applicants on the waiting list for 2 bedroom units into
available 3 bedroom units.
E. Wayne Taylor proposed an arbitrary 10% increase to "Fair Market Rents"
used to determine eligibility for Section 8 based on Fair Market Rents
as published in the Federal Register (See Exhibit "C" attached hereto),
and informing HUD of our intent. The Section 8 Existing Rent Annual
Contributions Contract is for five years. Agreements with landlords run
from 1 to 3 years. The Housing Authority plan to provide for salaries
for Wayne Taylor and Alicia Schiager, Administrative Receptionist for
the Housing Authority, were outlined in memo form (See Exhibit "D"
attached hereto).
V. Addendums to the Management Agreement as recommended by Al Kruchten were
reviewed as a matter of information. (Previously distributed)

Future addendums to be considered regarding the hiring of Wayne Taylor,
Carlos Ortega, and Alicia Schiager involve self-sufficiency status of the
Housing Authority,or incorporating them as City employees, or incorporating
the Housing Authority and its employees into the City. The members present
expressed support of the latter two options. The Executive Director in-
dicated that he would proceed accordingly and report progress at the next
meeting.
VI. Other Business
A. Mary Klopfenstein moved approval of Roberta Gallego's housing request
based on the following:
1. There will be no problems with insurance (See Exhibit "E" attached
hereto).
2. City building cod e-provisions �for=the handicapped are not applicable .c
to private dwelling- units-andrthuss present=no rest riction's.,:,;(See
Exhibit--"F" attached hereto.) _
3. Roberta's wheelchair does fit through the bathroom door (See Exhibit
"G" attached hereto), and her relatives will provide the necessary
ramps.
4. HUD gave verbal approval based on the Housing Authority's judgements.
5. Roberta's sister also qualified for housing and will be living
next door.
Nancy McComb seconded the motion and it carried 3 - 0.
B. Goals and Objectives had been submitted to Susan Jones. It was decided
to substitute the word "eligible" in place of "deserving" as used in
Objective #2. Chairman Sanchez wanted to see more referral effort and
concentration on Objective #5.
C. Carlos Ortega gave the following report on gardens:
1. Three units on Gallup did not want gardens.
2. No one on Impala wanted gardens.
3. One unit on Ram's Lane wanted a garden.
VII. Meeting adjourned at 6:20 p.m.

development costa. As we are aware of the shortage of funds in
the development budget for project costs, you may use interest

Determination of Minimum Development Coat (ROD 52397) to be sub-
mitted within the next thirty days.

Dear Mr. McGraw:
Your letter of March 17, 1976, requesting approval of retroactive
payment of retainage has-been received.
Please be-advised-that-lhe requirement- of'the =Annual ::Contributions -_

approval to reduce retainage to 5 per cent at the completion of
50 per cent of the job, does not address itself to.thi.s sort of
question.
Accordingly, your letter was referred to HUD Legal Division for
a ruling. Their finding has agreed with this division that retro-
active payment will not be approved. There is no guarantee within
the ACC that retainage will be reduced at the 50 per cent mark.
There is a provision that retainage may be reduced at the 50 per cent
mark, with the approval of HOD.
Since the Local Housing Authority did not elect to request such ap-
proval at that time, the question then becomes moot. Their LHA did
request release of the retainage at payment No. 11, and such release
was granted.
It is also the understanding of this office that your entire project
will be ready for final closing within a very few weeks. This would
seem to make the question raised in your letter irrelevent.

benefits will be -drawn from the preliminary administrative funding portion of
the Annual Contributions Contract until housing assistance payments begin, at
which time 8.5% of the fair market rent per each unit will begin to subsidize
said salaries.
Both positions have been funded as full-time temporary postions until the
current Section 8 Existing Rent Program is fully implemented and additional
annual contributions for additional housing assistance payments can be secured
or until preliminary administration funds are depleted. In the former case,
the positions would be made full-time permanent.

Dear Mr. McGraw:
Thank you for your telephone call yesterday, advising that you had
accepted Project COLO 41-1, Site 13. We bound this coverage and
have requested the endorsement adding it as of March 25th.
We have checked with Gulf Insurance Company, and they have advised
that if you have taken all the precautions which the doctor has re-
commended then you should have no problems concerning the 24 year
old lady in the wheel chair. There will be no problems with the
insurance.
The policy covering your project will be issued and forwarded to
you and the other .project sites will be added by endorsement.

17, 1976 -in regard to -the-,code=provi-s-ions--for the: handicapped .
While the Code does have provisions for the handicapped such as
ramps leading into buildings and special requirements for toilet rooms,
these provisions do not apply to one and two-family dwellings. They
do, however, apply to most commercial types of buildings and occupancies.

Dear Mr. McGraw,
We are writing this in reference to the duplex Ann Dinsmore, RPT, viewed
in February 1976 in order to m4ke it wheelchair accessible for Roberta
Gallegos.
As you know, Roberta is confined to a wheelchair. We originally stated
to Mr. Wayne Taylor that the bathroom door would have to be widened and that
ramps to the front - and -back doors -would -need -to be built.= -It has been
brought to our attention. that. Roberta!s_wheelchair -will fit -through the bath- .
room door and therefore no structural alterations other than building ramps
will be necessary.
As far as we can ascertain at this time, Roberta will be able to
maneuver in the kitchen and bathroom independently. If necessary, Linda
Whitey 0TR, will be able to help her arrange her kitchen so she can function
in it independently.
We sincerely hope that you will be able to get Roberta into one of your
units. If we can be of any assistance to you in this matter, please let
us know.
