Present: Harry Edwards, Subcommittee Chairperson; Maria Martinez, Subcommittee Vice Chairperson;
Glenn Strunk, Subcommittee Member; Charlie Greeb, Subcommittee Substitute Member, Brian
Carroll, David Evans, and Dennis Baker, Citizen Review Board Members; Greg Tempel, Senior

Call to Harry Edwards called the meeting to order at 6:30 p.m.
Order:
Case No. Mr. Edwards advised that, pursuant to the provisions of Section 2-138 et seq. of the Code
IA 2006-02: of the City of Fort Collins, the Citizen Review Board Subcommittee will undertake a review of an
internal affairs administrative investigation conducted by the Office of Police Services, Case No.
IA 2006-02, relating to use of deadly force by police officers on January 31, 2006.
• Mr. Edwards requested that all parties wishing to address the Subcommittee be identified and
inform the Subcommittee of the form of materials to be presented and the time required for such
presentations. Prior to going into executive session, Mr. Edwards advised that no final policy
decision will be made, nor will any resolution be passed or other formal action taken by the
Subcommittee while in executive session. Mr. Edwards advised that Fort Collins Police Services
personnel will give a multimedia presentation for all members of the Citizen Review Board, after
which case notebooks will be distributed to Subcommittee members. Mr. Edwards also advised
that members of the decedent's family will attend the Subcommittee meeting in July.
Executive Ms. Martinez entered the following motion: "As authorized by City Code section 2-71(dx2)
Session: and 2-3l(ax2), I move to go into executive session for the purpose of receiving and considering
evidence relating to internal investigation number 2006-02 conducted by Police Services, and for
the purpose of meeting with the City Attorney to receive legal advice regarding the manner in
which the subcommittee's actions may be affected by existing law. Additionally, Fort Collins
Police Services personnel and all CRB members will be present for the executive session." Mr.
Strunk seconded the motion. There was no discussion, and the motion carried 3-0. The executive
session commenced at 6:35 p.m.
Mr. Stunk moved to return to open session. Ms. Martinez seconded the motion. There was no
discussion, and the motion carried 3-0.
Open Mr. Edwards reconvened the open session at 7:55 p.m.

Adjourn: Ms. Martinez moved to adjourn. Mr. Strunk seconded the motion. The motion carried 3-0.
Mr. Edwards adjourned the meeting at 8:05 pm.

Mr. Strunk entered the following motion: "I move that the Subcommittee concurs with the finding
of `exonerated' regarding use of force by Officer A (officer who feed his rifle)." Ms. Martinez
seconded the motion. After some discussion, the motion carried 3-0.
Mr. Strunk entered the following motion: "I move that the Subcommittee concurs with the finding
of `exonerated' regarding use of force by Officer B (officer who fired his pistol)." Ms. Martinez
seconded the motion. There was no discussion, and the motion carried 3-0.
Recommen-
Mr. Strunk entered the following motion: "I move that the Subcommittee recommends expanding

Mr. Edwards entered the following motion: "I move that the Subcommittee recommends

improving on -scene management of personnel and resources. In this case, the Subcommittee finds
that there was some confusion concerning who was in charge of on -scene activities." Mr. Strunk
seconded the motion. There was no discussion, and the motion carved 3-0.

Mr. Strunk entered the following motion: "I move that we encourage looking into expanding the
policy of the use of less lethal weapons in suicidal situations where a weapon is involved, to insure
maximum usage of less lethal weapons whenever possible." Ms. Martinez seconded the motion.
There was no discussion, and the motion carried 3-0.
Mr. Strunk entered the following motion: "I move that the Subcommittee notes that a witness
officer should not act as either a gatekeeper or a transporter of a subject officer. Moreover,
dispatch should follow protocol in making follow-up calls to informants. In this case, dispatch
called the wrong number while attempting to talk to the informant. The IA investigation did not
adequately deal with these errors." Mr. Edwards seconded the motion. There was no discussion,
and the motion carried 3-0.
Mr. Edwards entered the following motion: "I move that the Subcommittee concurs with the Use
of Force Board regarding the inappropriate detention of a member the decedent's family in a
patrol car parked at the decedent's residence." Mr. Strunk seconded the motion. There was no
discussion, and the motion carried 3-0.
Mr. Strunk entered the following motion: "I move that the Subcommittee conveys the family's
frustration with not being informed in a timely manner by hospital personnel of the death of the
decedent. Additionally, family members said that FCPS personnel demonstrated a lack of
sensitivity by initiating interrogations too soon after family members were informed of the
decedent's death." Ms. Martinez seconded the motion. There was no discussion, and the motion
carried 3-0.
Adjourn: Ms. Martinez moved to adjourn. Mr. Strunk seconded the motion. The motion carried 3-0.
