Present: Harry Edwards, Subcommittee Chairperson; Charlie Greeb, Subcommittee Vice Chairperson;
Maria Martinez, Subcommittee Member; Dennis Baker, Subcommittee Substitute Member; Greg
Tempel, Senior Assistant City Attorney; Lt. James Broderick and Sgt. Russ Reed, Fort Collins
Police Services.
Call to Harry Edwards called the meeting to order at 6:31 p.m.
Order:
Case No. Mr. Edwards advised that, pursuant to the provisions of Section 2-138 et seq. of the Code
IA 2006-07: of the City of Fort Collins, the Citizen Review Board Subcommittee will undertake a review of an
internal affairs administrative investigation conducted by the Office of Police Services, Case No.
IA 2006-07, relating to use of force by a police officer, use of force reporting, prisoner handling,
and untruthfulness, allegedly in violation of administrative policy, events occurring on and after
June 12, 2006. The complaint was initiated by the subject officer's immediate supervisor. The
internal affairs investigation was submitted to the Citizen Review Board by the Chief of Fort
Collins Police Services per section 2-139(2)(c) of the Code of the City of Fort Collins. The
• internal affairs investigation is to be reviewed in accordance with section 2-140(d).
Ms. Martinez entered the following motion: "Due to the unavailability of Brian Carroll and Dave
Evans, I move that Harry Edwards serve as Chairperson, Charlie Greeb serve as Vice Chairperson,
Maria Martinez serve as Subcommittee Member, and Dennis Baker serve as Subcommittee
Substitute Member." Mr. Greeb seconded the motion. There was no discussion, and the motion
carried 3-0.
Mr. Edwards requested that all parties wishing to address the Subcommittee be identified and
inform the Subcommittee of the form of materials to be presented and the time required for such
presentations. After checking the lobby area, Mr. Edwards reported that no members of the public
were present to address the Subcommittee.
Prior to going into executive session, Mr. Edwards advised that no final policy decision will be
made, nor will any resolution be passed or other formal action taken by the Subcommittee while in
executive session.
Executive Ms. Martinez entered the following motion: "As authorized by City Code section 2-71(d)(2)
Session: and 2-31(a)(2), I move to go into executive session for the purpose of receiving and considering
evidence relating to internal investigation number 2006-07 conducted by Police Services, and for
the purpose of meeting with the City Attorney to receive legal advice regarding the manner in
which the subcommittee's actions may be affected by existing law." Mr. Greeb seconded the
motion. There was no discussion, and the motion carried 3-0. The executive session commenced
at 6:41 p.m.
Ms. Martinez moved to return to open session. Mr. Greeb seconded the motion. There was no
• discussion, and the motion carried 3-0.
Open Mr. Edwards reconvened the open session at 7:28 p.m.

Findings: Ms. Martinez entered the following motion: "I move that the Subcommittee concurs with the
following findings of the investigating and reviewing officers:
Use of Force (A-12): Sustained
Use of Force Reporting (A-12): Sustained
Arrests, Transports, and Prisoner Handling (B-2): Sustained
Untruthfulness: Sustained"
Mr. Edwards seconded the motion. After some discussion, the motion carried 3-0.
Recommen- Mr. Greeb entered the following motion: "I move that the Subcommittee commends the Internal
dation: Affairs investigator for the thoroughness and professionalism of the investigation." Ms. Martinez
seconded the motion. There was no discussion, and the motion carried 3-0.
Adjourn: Ms. Martinez moved to adjourn. Mr. Greeb seconded the motion. There was no discussion, and
the motion carved 3-0. CMr. Edwards adjourned the meeting at 7:44 p.m.
