Present: Dave Evans, Subcommittee Chairperson, Glen Strunk, Subcommittee Vice Chairperson,
Chris Kahler, Subcommittee Member, Harry Edwards, Subcommittee Alternate Member
Absent: No members of the Subcommittee were absent
Staff: Greg Tempel, Senior Assistant City Attorney, Sgt. Russell Reed
Public: No members of the public were in attendance
Call to
Order: The meeting was called to order at 6:36 p.m. by Subcommittee Chairperson Evans
Case
No. 2007.03: Subcommittee Chairperson Evans advised that, pursuant to the provisions of Sections 2-138 et
seq. of the Code of the City of Fort Collins, the Citizen Review Board Subcommittee would
undertake a review of an internal investigation conducted by the Office of Police Services, Case
No. 2007-03, relating to alleged events of police officer actions in violation of administrative policy
or applicable law occurring on January 4, 2007.
Subcommittee Chairperson Evans requested that all parties wishing to address the Subcommittee
be identified and advise the Subcommittee of the form of materials to be presented and the time
required for such presentation. No public members were identified within the meeting room.
Subcommittee Chairperson Evans exited the meeting room and sought out interested members of
the public who may have been present in the lobby area of City Hall West. No persons wishing to
address or participate were identified.
Executive
Session: At 6:40 p.m. Subcommittee Vice Chairperson Strunk offered the following motion: "As authorized
by City Code section 2-71 (d)(2) and 2-31(a)(2), I move to go into executive session for the
purpose of receiving and considering evidence relating to internal investigation Case Number
2007-03 conducted by the Office of Police Services, and for the purpose of meeting with the City
Attorney to receive legal advice regarding the manner in which the Subcommittee's actions may be
affected by existing law." Subcommittee Member Kahler seconded the motion. There was no
discussion and the motion carried 3-0. Another motion was made by Vice Chairperson Strunk to
allow new CRB member Jim Dubler to attend the executive session for training purposes.
Subcommittee Member Kehler seconded the motion. There was no discussion and the motion
carried 3-0.
Prior to adjourning into executive session, Subcommittee Chairperson Evans advised that no final
policy decision will be made, nor will any resolution be passed or other formal action taken by the
Subcommittee while in executive session.

Executive
Session: Without objection, Sgt. Russell Reed, investigating officer for this case was requested to remain for
the purposes of Subcommittee inquiries.
Regular
Session: At 8:01 p.m. Subcommittee Member Kahler moved to adjourn from executive session.
Subcommittee Vice Chairperson Strunk seconded the motion. There was no discussion and the
motion carried 3-0.
At 8:01 p.m. Subcommittee Vice Chairperson Strunk moved that the internal investigation, Case
Number 2007-03, prepared by the Office of Police Services is sufficient for the purposes of each
accusation set forth and that the Subcommittee concurs with the findings set forth by the Office of
Police Services with respect to Allegation #1 (Expectations of Individuals and Organization
Conduct GD A-2: Unfounded) and Allegation #2 (Colorado Revised Statute 25-1-310 Emergency
Commitment: Exonerated) and expresses no additional comment.
Subcommittee Member Kahler seconded the motion. There was no discussion and the motion
carried 3-0.
Adjourn: At 8:02 p.m. Subcommittee Vice Chairperson Strunk moved to adjourn. Subcommittee Member
Kahler seconded the motion. There was no discussion and the motion carried 3-0.
