Council Liaison : Ray Martinez Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on December 15, 2003 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Robert Younger, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated the show -cause hearings for South College Liquors and Kevin's Pub have been continued to January 26, 2004, to allow time to finalize stipulation agreements. Request from Bisetti's Italian Restaurant, Inc., to Change, Alter, or Modify the Licensed Premises located at 120 South College Avenue and Trade Name Change to Bisetti's Ristorante, Approved Robert Bisetti's, representative for the Licensee, briefly described the proposed modifications. He stated the bar will seat 22 people and that the main entrance remains unchanged. Mr. Bisetti stated they will begin construction January 5, 2004 and take approximately 4 months. Judge Lane approved the request from Bisetti's Italian Restaurant, Inc., to change, alter or modify the licensed premises located at 120 South College Avenue and Trade Name Change to Bisetti's Ristorante. Hearing on a New Application from La costa Express, Inc., for a Hotel -Restaurant Liquor License at La Costa Express,111 West Prospect Road, #D, Approved Jesus Gonzalez and Matilu Gonzalez, representatives for the Licensee, was sworn. Mr. Gonzales briefly described the premises. He stated all employees involved with the sale and service of alcohol will attend Officer Younger's training. Ms. Gonzales stated any patron ordering alcohol will be carded. She stated any employee found in violation of the liquor code will be terminated. Mr. Gonzales stated they have a current copy of the liquor code on premise. He stated they have received numerous requests from their patrons to serve alcohol. Mr. Gonzales stated he expects 90% of his gross sales will come from the sale of food. December 15, 2003 Judge Lane received the petitions from Max Scott, representative for Oedipus, Inc., noting summary indicated the neighborhood was in support of this application. Judge adopted Resolution 2003-21 approving an application from La Costa Express, Inc., for a hotel - restaurant liquor license at La Costa Express, 111 West Prospect Road, #D. Show -Cause Hearing for Rich's Aggie Discount, Inc., dba Rich's Aggie Discount Liquor, 429 Canyon Avenue, Stipulation Agreement Approved Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee has agreed to a 15 day suspension, 5 days served (by paying a fine in lieu of suspension of $5000), with 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Rich's Aggie Discount Liquor, 429 Canyon Avenue. Show -Cause Hearing for Stump & Lump, Inc., dba Lucky Joe's Sidewalk Saloon, 25 Old Town Square, Stipulation Agreement Approved Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee has agreed to a 27 day suspension, 7 days served (served concurrently from previous violation), with 20 days held in abeyance for 1 year for violating C.R.S. 12-47-901 (h) (1) and Regulation 47-910, of the Colorado Liquor Code, permitting after hours consumption. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Lucky Joe's Sidewalk Saloon, 25 Old Town Square. Show -Cause Hearing for The Service Partners, dba The Service Bar,126A West Mountain Avenue Stipulation Agreement Approved Cathleen Fellen, representative for the Licensee, stated she will provide an accounting of their food sales within 60 days. Assistant City Attorney Ablao summarized the stipulation agreement and stated that the licensee has agreed to a 20 day suspension, 10 days served (served concurrently from previous violation), with 10 days held in abeyance for 1 year for violating C.R.S. 12-47-701 and Regulation 47-700 (A) and (B) of the Colorado Liquor Code, food sales less than 25%. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for The Service Bar, 126A West Mountain Avenue. December 15, 2003 Other Business Show -Cause Hearing for Farshad Nojoumi, dba The Avenue,151 South College Avenue, Suite 1 Stipulation Agreement Approved Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee has agreed to a 15 day suspension, 5 days served (by paying a fine in lieu of suspension of $5000), with 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a) of the Colorado Liquor Code, pertnitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for The Avenue, 151 South College Avenue.
