Regular Meeting - December 1, 2003

A regular meeting of the Liquor Licensing Authority was held on December 1, 2003 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated there were no changes to the agenda.
Consent Agenda
a. Change in Corporate Structure for the D. Martin Group, Inc., dba Elliot's Martini Bar,
234 Linden Street.
b. Change in Corporate Structure for Suite 152, Inc., dba Suite 152, 23 Old Town Square.
Judge Lane adopted the Consent Agenda.
Request from The D. Martin Group, Inc., dba Ellioes Martini Bar to
Change, Alter or Modify the Licensed Premises located at 234 Linden Street, Approved
Max Scott, representative for Oedipus, Inc., was sworn. Mr. Scott briefly described the petitioning
process. He stated this petition is used specifically for a private club.
Ron Leonhard, representative for The D. Martin Group, was sworn. In response to questions from Tim
Dow, attorney representing the Licensee, Mr. Leonhard briefly described the proposed changes. He
stated he has not received approval from the City's Building and Zoning Department.
Judge Lane approved the request from The D. Martin Group, Inc., dba Elliot's Martini Bar to change,
alter, or modify the Licensed Premises located at 234 Linden Street, contingent upon approval from the
City's Building and Zoning Department as well as a new diagram to include the patio.

Request from Suite 152, Inc., dba Suite 152, to Change, Alter, or Modify
the Licensed Premises located at 23 Old Town Square, Approved
David C. Jones, representative for the applicant Suite 152, Inc., briefly described the proposed
modifications. He stated this application is very similar to the original layout. Mr. Jones stated many
of the changes are cosmetic. He stated adding the upstairs to the licensed premise will require the
addition of 12 employees. Mr. Jones stated the building department is currently reviewing these plans.
He briefly described his petitioning process. Mr. Jones stated they received support for this application.
He stated they do not intend to have the upstairs function as a nightclub, that it will remain a restaurant.
Judge Lane approved the request from Suite 152, Inc., dba Suite 152, to Change, Alter, or Modify the
licensed premises located at 23 Old Town Square, contingent upon a correct diagram submitted.
Hearing on a New Application from Speakeasy Pizzeria, LLC,
for a Beer and Wine License at Speakeasy Italian Pizzeria,103 West Harvard, Approved
Darin Wieker, representative for the applicant Speakeasy Pizzeria, LLC, was sworn. He stated he will
contact Officer Younger for training. Mr. Wieker stated the restaurant is currently open and that
customers are requesting they serve beer and wine. He stated they expect 80% of their gross sales from
the sale of food. Mr. Wieker stated the dining area is easily monitored by staff. He briefly described
the petitioning process. Mr. Wieker stated that they have a current copy of the liquor code on premise.
Judge Lane adopted Resolution 2003-20 approving a new application from Speakeasy Pizzeria, LLC,
for a beer and wine license at Speakeasy Italian Pizzeria, 103 West Harvard, contingent upon receiving
T.I.P.'s training or equivalent.
Show Cause Hearing for Fort Collins 8, LLC,
dba CB & Potts,1415 West Elizabeth, Stipulation Approved
Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has
agreed to a 15 day suspension, 5 days served, and 10 days held in abeyance for 1 year for violating C.R.S.
12-47-901(1)(a) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a
person under the age of 21 years.
Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as
presented for C.B. & Potts, 1415 West Elizabeth, contingent upon proof of training filed with the City
Clerk's Office within 60 days.
Show Cause Hearing for Bullfrog Wine and Spirits, Inc.,
dba Bullfrog Wine and Spirits,1624 North College Avenue, Stipulation Approved
Dwight Whitney, representative for the Licensee, stated he has reviewed the Stipulation Agreement.
Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has
agreed to a 15 day suspension, 5 days served (by paying a fine in lieu of suspension of $3000), and 10
days held in abeyance for 1 year for violating C.R.S. 12-47-901 (1) (a) of the Colorado Liquor Code,
permitting the sale or service of alcohol beverages to a person under the age of 21 years.

Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as
presented for Bullfrog Wine and Spirits,1624 North College Avenue, contingent upon proof of training
filed with the City Clerk's Office within 60 days.
Show Cause Hearing for County Cork, Inc.,
County Cork Pub, 313 West Drake Road, Stipulation Approved
Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has
agreed to a 15 day suspension, 1 day served (by paying a fine in lieu of suspension of $200), and 14 days
held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a) of the Colorado Liquor Code, permitting
the sale or service of alcohol beverages to a person under the age of 21 years.
Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as
presented for Bullfrog Wine and Spirits, 1624 North College Avenue.
