Council Liaison: Ray Martinez Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on Monday, July 10, 2000, in Municipal Court, 123 North College. Judge Kathleen M. Lane presiding. Staff in attendance: Greg Tempel, Assistant City Attorney Richard Johnson, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen noted Tad Buonamici will request that the hearing on a change of class of license for The Matrix be continued to the August 7, 2000 meeting. Ms. Jensen stated that the attorney representing Tony%s Restaurant, 224 South College Avenue, will request that the show cause hearing be postponed to August 21, 2000. No other changes were reported. Hearing on a Change of Class of License Application from Buonamici Ventures, Inc., dba The Mattixx, 450 Linden Center Road. Continued to August 7 2000 Tad Buonamici, owner, requested that the Judge continue the hearing for the change in class of license to the August 7, 2000 meeting due to errors on the petitions. Assistant City Attorney Tempel stated that he had no objections to the continuance of this hearing. Judge Lane noted that no party -in -interest appeared to speak for or against this application. Judge Lane granted the motion to continue the hearing on a change in class of license from Buonamici Ventures, Inc., dba, The Matrixx, 450 Linden Center Road. Show Cause Hearing for Tony's Restaurant, 224 South College Avenue. Continued to August 21 2000 Assistant City Attorney Greg Tempel stated he had no objection to the granting of the motion to continue the hearing. E July 10, 2000 Judge Lane signed the order granting the motion to continue the show cause hearing for Tony's Restaurant, 224 South College Avenue, to August 21, 2000. Registration of Joel Richard Price as Manager of Lone Star Steakhouse and Saloon, 100 West Troutman Parkway, Approved Joel Richard Price, applicant, stated he has been the manager at this location for 4 years. He briefly detailed training employees are required to attend on a quarterly basis. He stated he has had no liquor code violations. Mr. Price stated he does not have a current liquor code on premise. Judge Lane approved the registration of Joel Richard Price as Manager of Lone Star Steakhouse and Saloon, 100 West Troutman Parkway. Hearing on a New Application from The Noodle Shop Co. - Colorado, Inc., for a Hotel -Restaurant Liquor License at Aaron Kennedy, applicant, was sworn. He stated he is the president and founder of The Noodle Shop Co. - Colorado, Inc. and that they have 11 restaurants. Mr. Kennedy noted their liquor sales are less than 2%. He stated they plan on opening mid -September. Mr. Kennedy stated that employees and managers will be continuallycirculating throughout the dining and patio area. He stated there have been no liquor violations at any of the 11 restaurants. Assistant City Attorney Tempel had no questions of Mr. Kennedy. Judge Lane noted that no parties -in -interest approached to question Mr. Kennedy. Bret Mansur, representative for Liquor Petitioning Professionals, was sworn. He described the petitioning process and indicated the petitions represent 228 (92%) signatures in favor and 20 (8%) in opposition. Judge Lane adopted Resolution 2000-13 approving the application from the Noodle Shop Co. - Colorado, Inc., for a Hotel -Restaurant Liquor License at Noodles & Company, 4733 South Timberline Road. Registration of David Rowan as Manager of Noodles & Company, 4733 South Timberline Road, Approved David Rowan, applicant, stated he has been in the restaurant business for 10 years, but has not been a server. He stated he will contact Liquor Enforcement Officer Johnson for training. Mr. Rowan stated there are usually 2 managers on duty. He described their carding policies. July 10, 2000 Marco Macchiaroh, regional director, stated he will be helping Mr. Rowan with training the employees. Assistant City Attorney Tempel had no questions for Mr. Rowan. Judge Lane approved the registration of David Rowan as Manager of Noodles &Company, 4733 South Timberline Road. Police Report Liquor Enforcement Officer Johnson stated the Fort Collins Police Department has worked out stipulation agreements with the licensees for the following establishments, regarding violations found during recent compliance checks. He asked the Judge to approve the stipulation agreements. Officer Johnson briefly reviewed how compliance checks are conducted. He noted that the underage operatives do not use false or altered ID's. Cozzola's Pizza Officer Johnson summarized the stipulation agreement and stated that the Licensee was present to answer questions. He stated that the Licensee agreed to (3) days activelyserved, with (4) days to be held in abeyance for (1) year. Officer Johnson stated the Licensee will require all his employees receive training within six months. He noted this Licensee failed a similar compliance check in 1997. Judge Lane approved the findings and order accepting the stipulation agreement as presented for Cozzola's Pizza, 241 Linden. S12ortsCasters Bar and Grill Officer Johnson summarized the stipulation agreement and stated that the Licensee was present to answer questions. He stated that the Licensee has agreed to a five (5) day suspension, two (2) days activelyserved, and three (3) days held in abeyance for one (1) year. OfficerJohnson stated the Licensee opted to pay $500 in lieu of serving the two (2) day active suspension. He noted that the Licensee has also agreed to train all his employees within 6 months. Derek Herleid, manager, stated he has scheduled training for all his employees with Officer Johnson. He submitted SportsCasters Bar and Grill training manuals to the Judge. Judge Lane approved the findings and order accepting the stipulation agreement as presented for SportsCasters Bar and Grill, 165 East Boardwalk. Bison Liquors Officer Johnson summarized the stipulation agreement and stated that the Licensee was present to answer questions. He stated the Licensee agreed to a five (5) day suspension, two (2) days actively served, with three (3) days to be held in abeyance for one year. He stated the Licensee has opted to pay July 10, 2000 $655 in lieu of the active suspension. He noted that the Licensee has agreed to train all employees within 6 months. Judge Lane approved the findings and order accepting the stipulation agreement as presented for Bison Liquors, 1015 West Horsetooth # E 101. Toddy's Officer Johnson summarized the stipulation agreement and stated that the Licensee was present to answer questions. He stated the Licensee agreed to a seven (7) day suspension, two (2) days actively served, with five (5) days to be held in abeyance for one year. Officer Johnson stated the Licensee has opted to pay $214 in lieu of the active suspension. He noted the Licensee has agreed to train all employees within 6 months. Officer Johnson stated this Licensee failed a similar compliance check in 1997. Judge Lane approved the findings and order accepting the stipulation agreement as presented for Toddy's of Fort Collins, 2601 South Lemay. B & Bs Pickle Barrel Officer Johnson summarized the stipulation agreement and stated that the Licensee was present to answer questions. He stated the Licensee agreed to a five (5) days suspension, two (2) days actually served, with three (3) days to be held in abeyance for one year. Officer Johnson stated the Licensee has opted to pay $210 in lieu of the active suspension. He noted the Licensee has agreed to train all employees within 6 months. Judge Lane approved the findings and order accepting the stipulation agreement as presented for B & B's Pickle Barrel, 122-124 West Laurel. The Matrixx Officer Rich Johnson briefed the Judge on alleged violations at The Matrixx, 450 Linden Center Road. He requested the Judge schedule a show cause hearing for August 7, 2000. Judge Lane found that probable cause exists to schedule a show cause hearing on August 7, 2000, for The Matrixx, 450 North Linden Center Road, for alleged violations of: Regulation 47-900(A), Section 12-47-41 1(1)(a), Section 12-47-701, Regulation 47-700(B), Regulation 47-310(D) (two incidents), Section 12-47-301(7), and Section 12-47-307(1)(a)(III) and M, Colorado Revised Statutes. Judge Lane also instructed Deputy City Clerk Jensen to issue the necessary subpoenas. The meeting adjourned at 2:45 p.m. Adjournment KK6"-,4 Municipal Judges July 10, 2000
