A regular meeting of the Liquor Licensing Authority was held on Monday, October 2, 2000, in
Municipal Court, Justice Center, 201 Laporte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated that the transfer of ownership of Everyday Store # 5015 and the
registration of manager Cindy Babnick has been postponed to October 16, 2000.

Judge Lane adopted the Consent Agenda.
Registration of Kimberly Guthert
as Manager of Spirits,
2601 South Lemay, # 18, Approved
Kimberly Guthert, applicant, briefly described the training she has received. She stated she supervises
3 people and that she is on premise 45-50 hours per week Ms. Guthert stated she has had no liquor
code violations. She stated every patron who appears to be under 35 is carded. Ms. Guthert stated each
identification is scanned to verify its validity. She stated she has the liquor code on premise and will
terminate any employee found in violation of the liquor code.
Judge Lane approved the registration of KimberlyGuthert as the Manager of Spirits, 2601 South Lemay,
# 18.

Report of Change of Corporate Structure
for Two Guys from Naples, Inc.,
dba Pulcinella Ristorante,
2100 West Drake Road, # 1, Received and Examined
Zachary Wilson, attorney representing the Licensee, stated he is prepared to proceed.
Antonio Race, licensee, was swom in.
In response to questions from Mr. Wilson, Mr. Race stated he has been employed by Pulcinella
Ristorante for 9 years. He stated he has transferred ownership in Baco Imports to MaryRace. Mr. Race
stated the transfer of ownership has been approved by -the State. Mr. Race detailed his criminal history.
In response to questions from Assistant City Attorney Greg Tempel, Mr. Race stated Ms. Race is
currently registered as the manager for Pulcinella and that he is no longer the owner of Baco Imports.
He stated he will appoint a different manager in the near future.
Judge Lane instructed Mr. Race to amend his application to correctly reflect his criminal history.
Deputy City Clerk Jensen confirmed that Ms. Race is the registered manager.
Judge Lane received and examined the report of change of corporate structure for Two Guys from
Naples, Inc., dba Pulcinella Ristorante, 2100 West Drake Road, # 1.

Ciao Vino. 126 West Mountain, Approved
Zachary Wilson, attorney representing the Licensee, called Joseph Zimlich to testify. Mr. Zimlich was
swom. He stated he is employed byBohemian Companies. Mr. Zunlich briefly described his interest
in other liquor licenses. He stated he and Tommy Short are investor members only and that Antonio
Race is the managing member.
Bret Mansur, representative for Liquor Petitioning Professionals, was sworn. He described the
petitioning process and indicated the petitions represent 280 (97%) in favor and 8 (30/6) in opposition.
Mr. Mansur noted that this is a very high approval rating, that normal approval ratings in Fort Collins
are between 90-95%.
Antonio Race was swom. He stated the concept for Ciao Vino will be similar to Pulcinella Ristorante.
Mr. Race stated all full and part-time employees will be TIP's trained. He stated he will have an
employee at the front door to monitor the patio. In response to Judge Lane's questions, Mr. Race
detailed the diagram He stated he will require employees sign a contract that they will not violate the
liquor code.
In response to Assistant CityAttomeyTempel's questions, Mr. Race detailed his criminal history. He
stated he is aware that any modifications to the premise would require prior approval from the Liquor
Licensing Authority.

Judge Lane adopted Resolution 2000-17 approving the application from Ciao Vino, LLC, for a hotel -
restaurant liquor license at Ciao Vino, 126 West Mountain.
Motion to Impose Additional 7-day Suspension
for Harmony Liquors 115 East Harmony Road Suspension Imposed
Assistant CityAttomey Greg Tempel submitted the signed stipulation agreement dated September 28,
2000 for the Judge to review. He stated he has spoken with the Licensee's attorney, Mr. J.Y. Kang, and
that Mr. Kang is in agreement with this motion to impose the additional 7 day suspension.
Deputy City Clerk Jensen stated she will send the stipulation agreement and letter to Mr. Kang and the
Licensee. She noted the days to be served are (Sunday excluded) from 12:01 a.m. on Wednesday,
October 18, 2000, through 12:01 a.m., on Thursday, October 26, 2000.
Judge Lane adopted the Motionto Impose Additional7-daysuspension forHarmonyLiquors,115 East
Harmony Road.
Police Report
Assistant CityAttomeyTempel stated Officer Richard Johnson will present stipulation agreements from
Beau Jo's, 100 North College, Tosh's Hacienda, 200 Jefferson Street, and 3 Margaritas, 3400 South
College at the October 16, 2000 meeting.
Johnny Carino's Italian Kitchen
Assistant CityAttomeyTempel summarized the stipulation agreement and stated that the Licensee was
present to answer questions. He stated that the Licensee agreed to a 5 daysuspension, 2 days actively
served, and 3 days held in abeyance for 1 year. Assistant City Attorney Tempel stated the Licensee
opted to pay $397.00 in lieu of serving the 2 day active suspension. He noted that the Licensee has also
agreed to train all employees within 6 months.
Judge Lane approved the Findings and Order accepting the Stipulation Agreement as presented for
Johnny Carino's Italian Kitchen, 4235 South College.
Other Business
Judge Lane adopted the Liquor Licensing Authorities schedule for 2001.
