Regular Meeting - May 28, 1980
7:30 P.M.
A regular meeting of the Liquor Licensing Authority was held on Wednesday,
May 28, 1980, in the Council Chambers of the City of Fort Collins Municipal
Building. Roll call was answered by the following members: Bean, Long,
Renz, Seegmiller and Wilson.

Minutes of the Regular Meeting of
April 30, 1980, Approved as Published
Authority member. Wilson made a motion, seconded by Authority member Seegmiller
to approve the minutes of the regular meeting of April 30, 1980, as published.
The Chairman put the motion which was unanimously adopted.
Renewals Approved for the Following Locations:
Riverside Kwik Stop, 710 Magnolia
Pizza Inn, 820 City Park Avenue
Prime Minister, 3905 S. College Avenue
Sportsman Bar, 210 Walnut
Spring Creek Runoff, 1006 Spring Creek
Authority member Long made a motion, seconded by Authority member Renz to approve
the above listed renewal applications. The Chairman put the motion which was
unanimously adopted.
3.2% Special Events Permit Approved for
Eyeopener's Kiwanis for October 4, 1980
Jack Gianola, 700 Winchester Drive, appeared and explained the events that are
planned for the Third Annual Oktoberfest to be held in the Oak Street Plaza on
October 4th. He noted that the activities would include music, food and special
promotion groups and that the sale of beer would be restricted to an area of the
Plaza set aside for the serving of food and beverages.
Authority member Renz made a motion, seconded by Authority member Long to approve
the 3.2% Special Events Permit for the Eyeopener's Kiwanis for October 4th. The
Chairman put the motion which was unanimously adopted.

Expansion of Premises for Washington's
132 Laporte Avenue, Deemed not Substantial
Glenn J. Hester,! 2943 C Rams Lane, manager of Washington's, appeared to explain
the plans for expansion noting that they consisted of an uncovered patio area
in the front of the building. He explained the type of fencing that would be
installed.
Authority member Renz made a motion, seconded by Authority member Bean to
determine that the expansion is not substantial. The Chairman put the motion
which resulted in the following vote: Yeas: Authority members Bean, Renz,
Seegmiller and Wilson. Nays: Authority member Long.
THE MOTION CARRIED.
Authority member Renz made a motion, seconded by Authority member Long to specify
that the spaces between the slats of the fence not be more than 2" and that the
fence be constructed in such a way that nothing can be placed on top of it. The
Chairman put the motion which was unanimously adopted.
Expansion of Premises for University
Theatre, C.S.U., Deemed not Substantial
Morris Burns, 2112 Essex Ct., Associate Director of University Theatre, appeared
on behalf of the applicant. Mr. Burns explained that their request was to add
a row of eight tables, seating approximately 32, to the rear of the present final
row of existing seating.
Authority member Long made a motion, seconded by Authority member Bean to determine
that the expansion is not substantial. The Chairman put the motion which was
unanimously adopted.
New Application Accepted for
a 3.2% Fermented Malt Beverage License for the
Upper Crust, 2601 S. Lema_y Avenue
David Miller, Timnath, and Cindy Smith, 3201 Colony Drive, appeared and stated
that the 2,000' boundaries were acceptable to them.
Authority member Renz made a motion, seconded by Authority member Long to accept
the application and set the final hearing date for June 25, 1980. The Chairman
put the motion which was unanimously adopted.
New Application Accepted for a
3.2% Fermented Malt Beverage License
for Cafe Columbine, 647 S. College Avenue
Nick LoRusso, 2707 Trenton, appeared on behalf of the applicant, Columbine
Enterprises.

Authority member Bean made a motion, seconded by Authority member Renz to
accept the application and set the final hearing date for June 25. The
Chairman put the motion which was unanimously adopted.
Preliminary Hearing on a Tavern
License for the Bear and Whale Tavern,
244 Pine Street
The boundaries as proposed by the administration were as follows:
North from the subject premises to City Limits;
West from the subject premises to Shields;
South from the subject premises to Prospect Street;
East from the subject premises to City Limits.
Richard Lippman, 239 N. McKinley, noted that the boundaries were acceptable
to him.
Authority member Renz made a motion,

The Chairman read the hearing procedure at length before proceeding with the
three final hearings.
Final Hearing on a Change of
Location for VFW Club,
603 Lesser Drive, Change Approved
The Resolution outlining the results of the preliminary hearing was read by
title only.
Authority member Renz made a motion, seconded by Authority member Long to
approve the Resolution as presented. The Chairman put the motion which was
unanimously adopted.
B. J. Sapp, 2211 W. Mulberry and William Way, 821 E. County Rd. #70, were
sworn before describing their club operation. They explained the floor plan
of the new location and noted that they wanted the whole building to be
considered as the licensed premises.
They presented petitions containing approximately 158 signatures that were
circulated on behalf of the application.
Authority member Long made a motion, seconded by Authority member Bean to approve
the change of location of the Club Liquor license of the VFW Club to 603 Lesser
Drive. The Chairman put the motion which was unanimously adopted.

Final Hearing on a 3.2% Fermented Malt Beverage
License for Sub Center, 1232
West Elizabeth, License Granted
Tim Poynter, 400 Towhee, appeared and was sworn before describing his
sandwich 'shop operation. He noted that his customers had requested beer
and that he planned to serve beer as a compliment to his sandwiches. He
presented petitions containing 456 signatures that he had circulated on
behalf of his application.
Authority member Renz made a motion, seconded by Authority member Wilson to
approve the 3.2% Fermented Malt Beverage license for Consorts, Inc. dba
Sub Center, 1232 W. Elizabeth. The Chairman put the motion which was unanimously
adopted.
Final Hearing on a 3.2% Fermented Malt Beverage
License for Toddy's Supermarket,
2601 S. Lemay Avenue, License Granted
Tom Metcalf, attorney representing the applicant, introduced Stanley Small,
1130 Oakmont Ct., who was sworn and stated that he was presently the store
manager for the Greeley Toddy's store and would be the manaqer for the new
supermarket. Mr. Small noted that the store would be 47,000 sq. ft. in size
and explained the procedures that would be followed in checking identifications.
He presented petitions containing 229 signatures that had been circulated on
behalf of the application and noted that approximately 19 persons had refused
to sign for various reasons.
Authority member Renz made a motion, seconded by Authority member Long to
approve the 3.2% Fermented Malt Beverage License for Toddy's Supermarket,
2601 S. Lemay Avenue. The Chairman put the motion which was unanimously adopted.
Police Report
Sgt. Mason reported two alleged liquor law violations at B-cubed and the
7-Eleven Store at 505 S. Shields and asked that letters of reprimand be sent
to those outlets.
Authority member Wilson made a motion, seconded by Authority member Renz to
direct the City Attorney to write letters of reprimand to B-cubed and 7-Eleven.
The Chairman put the motion which was unanimously adopted.
Adjournment
Authority member Long made a motion, seconded by Authority member Bean to adjourn
the meeting. The Chairman put the motion which was unanimously adopted. The
meeting adjourned at 9:30 p.m.
