Regular Meeting - July 16, 1986
7:31 P.M.
A regular meeting of the Liquor Licensing Authority was held on Wednesday,
July 16, 1986, in the Council Chambers of the City of Fort Collins
Municipal Building. The following members were present: Bullard,
Monaghan, Morgan, Sommermeyer, Spaulding, and Veazie. (Secretary's Note:
Authority member Bullard arrived at approximately 7:45 p.m.)

Minutes of the Regular Meeting of
June 18, 1986, Approved as Published
Authority member Spaulding made a motion, seconded by Authority member
Morgan, to approve the minutes of the regular meeting of June 18, 1986, as
published. Yeas: Monaghan, Morgan, Sommermeyer, Spaulding, and Veazie.
Renewal Application for a Retail Liquor Store
License for Harmony Discount Liquors 115E Harmony Road
Authority member Veazie made a motion, seconded by Authority member
Sommermeyer, to approve the renewal for Harmony Discount Liquors, 115 East
Harmony Road. Yeas: Monaghan, Morgan, Sommermeyer, Spaulding, and Veazie.
Nays: None.
Special Events Permit - 3.2%
Pi Kappa Aloha Fraternity - September 5 1986
Mr. Erick Loss, chairman, stated they are proposing to have another fund
raiser this year to kick off the beginning of the school year and to raise
funds for Muscular Dystrophy Association. He explained that the event will
consist of an all -day concert. He distributed a hand out regarding the
beer sales at the concert. Mr. Loss stated 10 CSU police officers will be
on the site. He explained how people will be carded and allowed entry into
the concert.
Authority member Sommermeyer made a motion, seconded by Authority member
Veazie, to approve the special events permit for Pi Kappa Alpha Fraternity
on September 5, 1986. Yeas: Monaghan, Morgan, Sommermeyer, Spaulding, and
Veazie. Nays: None.

Special Events Permit - 3.2%
Foothills Sertoma - August 15 & 16, 1986
Mr. Ed Lawson, events manager, stated this event will be similar to the
event held in May. He stated the event will be held in Old Town Square.
Mr. Lawson explained how the beer garden will be roped off. He stated that
the exit will be staffed with members of the club to ensure that no one
leaves the area with a beer.
Authority member Sommermeyer made a motion, seconded by Authority member
Veazie, to approve the special events permit for Foothills Sertoma or
August 15 and 16, 1986. Yeas: Monaghan, Morgan, Sommermeyer, Spaulding,
and Veazie.
Transfer of Ownership
Szechuan Star, 2427 South College Avenue
Mr. Mark Sun and Ms. Evelyn Sun, part-owners, stated they have operated the
restaurant under a management agreement since May. They stated there will
be no changes in the operation of the business. They also stated they will
obtain a copy of the Colorado Liquor Code from their attorney.
Mr. Wen-Huan Cheng, manager, stated he has had previous experience with
liquor licenses in New York. He stated he has never had any violations in
the 15 years of working in the business. Mr. Cheng explained the ID
checking policy for Szechuan Star.
Authority member Spaulding recommended that the owners and employees take
the course offered by Officer Ernie Tellez.
Authority member Sommermeyer made a motion, seconded by Authority member
Veazie, to approve the transfer of the liquor license from Hwei Y. Tu to
Ni-Ni Enterprises, Inc. Yeas: Monaghan, Morgan, Sommermeyer, Spaulding,
and Veazie. Nays: None.
(Secretary's Note: Authority member Bullard arrived at this time.)
Transfer of Ownership
Sportsman Boss Hogg's, 210 Walnut
Mr. Thomas Wahlberg, owner, stated he purchased the bar in September of
1985 and has been operating under a management agreement under the
advisement of his attorney. He stated he has cleaned and remodeled the
bar. Mr. Wahlberg stated there have been fewer disturbances since he has
managed the establishment. Mr. Wahlberg stated he and his employees have
attended the course offered by the Police Department.
Authority member Sommermeyer made a motion, seconded by Authority member
Veazie, to approve the transfer of the liquor license from Clifford

Holtcamp to Thomas Wahlberg. Yeas: Bullard, Monaghan, Morgan,
Sommermeyer, Spaulding, and Veazie.
Transfer of Ownership
Duds 'n Suds. 1427 West Elizabeth
Mr. and Mrs. Kent Hall, owners, stated they have operated the business
under a management agreement since October of 1985. They stated they own
another laundromat in Loveland without a beer license. Mr. Hall stated he
and his wife will be the on -site managers.
Authority member Veazie made a motion, seconded by Authority member
Sommermeyer, to approve the transfer of ownership of the beer license from
Tjelmar Enterprises, Inc., to Kent and Sue Hall.
Final Hearing for a 3.2% Fermented Malt Beverage
License (Class B) for Circle K. 949 Taft Hill Road
Mr. Jon Stonbraker, attorney representing the applicant, called his first
witness.
Ms. Paulette Stegeman, 2221 Clearview Avenue, was sworn and stated she is a
neighborhood resident within the designated boundaries. Ms. Stegeman
stated she feels the needs of the neighborhood are not being met and that
she would desire to see this license granted.
Ms. Eileen Swiers, owner of Market Services Associates, was sworn and
stated she was contacted to do a petition survey for the beer license.
Applicants Exhibit A was submitted and identified as a summary report of
the survey. Applicants Exhibits B through F were submitted and identified
as petitions. Ms. Swiers explained how the survey was conducted and its
results.
Ms. Emma Reno, Zone Manager for Circle K, was sworn, and spoke of her
duties and responsibilities for the 7-9 stores in her zone. Ms. Reno
stated that the new Fort Collins store will be in her zone. Applicants
Exhibit G was submitted and identified as the written company policy with
respect to beer sales. Applicants Exhibit H was identified as the job
description for store manager. Applicants Exhibit I was identified as the
job description for salesperson. Lastly, Applicants Exhibit J was
submitted and identified as an employee handbook. Ms. Reno stated that if
any employee violates the beer laws, they are immediately terminated.
Authority member Veazie made a motion, seconded by Authority member
Spaulding, to approve the license for Circle K, 949 Taft Hill Road,
contingent upon receipt by the City an acceptable fingerprint report from
the CBI. Yeas: Bullard, Monaghan, Morgan, Sommermeyer, Spaulding, and
Veazie. Nays: None.

Final Resolution
7-Eleven, 1600 South Lemav Avenue
Authority member Veazie made a motion, seconded by Authority member Morgan,
to approve the final resolution as presented. Yeas: Bullard, Monaghan,
Morgan, Sommermeyer, Spaulding, and Veazie. Nays: None.
Other Business
Select -A -Seat
Ms. Valerie Williams, program coordinator for Select -A -Seat, presented a
proposal for the Authority's information with regard to setting up a ticket
sales counter at the Fort Ram. Ms. Williams answered questions and
addressed concerns by the Authority.
The Authority thanked Ms. Williams for the presentation and stated the
proposal was well thought out. It was noted that the Fort Ram will be
responsible for controlling the crowd and contacting the Police Department
if there are any problems.

Attorney Paul Eckman stated that the City's beer and liquor
presently in two separate chapters of the Code. He stated
revised the Code in order to consolidate the two Chapters
to eliminate those provisions which are conflicting or
:ate law. In addition, he stated the changes add sections
in the State law for administration of beer and liquor
the City.
After having reviewed copies of the proposed ordinance, the Authority made
some suggestions and minor amendments to the ordinance.
Authority member Veazie made a motion, seconded by Authority member
Spaulding, to recommend that the City Council adopt the proposed revisions
to the City's beer and liquor codes. Yeas: Bullard, Monaghan, Morgan,
Sommermeyer, Spaulding, and Veazie. Nays: None.
Police Report
Authority member Spaulding made a motion, seconded by Authority member
Veazie, to determine probable cause and scheduled a show/cause hearing on
August 13 for Boss Hoggs, 210 Walnut. Yeas: Bullard, Monaghan, Morgan,
Sommermeyer, Spaulding, and Veazie. Nays: None.

The Chairman put the motion which was unanimously adopted.
