A regular meeting of the Liquor Licensing Authority was held on Wednesday, February 22,
1995, in the Council Chambers of the Fort Collins Municipal Building. The following
members were present: Cooper, Haggerty, Norton, Poncelow, Schroeer, and Wawro.

Authority Members Absent: Crowfoot.
The Consent Calendar is intended to expedite the meeting and allow the Authority to
spend its time and energy on the important items on a lengthy agenda. Items on the
Consent Calendar are (1) routine items; and (2) those of no perceived controversy.
Anyone may request that an item be "pulled" off the Consent Calendar and considered
separately. Items pulled from the Consent Calendar will be considered separately
immediately following adoption of the Consent Calendar.
1 Report of Change of CoEporate Structure for The Sandtrap. Inc,. dba MacKenzie's
Pub and r South Lemay.
The Sandtrap, Inc., the tavern licensee for MacKenzie's Pub and Grill, 5750 South
Lemay, is reporting a change of corporate structure. Kristi Olson has resigned as
president, treasurer, and director of the corporation. In addition, Ms. Olson has sold
her shares in the corporation to Daniel Bruntz. Mr. Bruntz is now vice-president and
secretary, as well as a director. Derek Cordova has assumed the positions of
president and treasurer.

SouthRidge Golf Course. 5750 South Lemay.
The Sandtrap, Inc., the 3.2% beer licensee for Sandtrap at SouthRidge Golf Course,
5750 South Lemay, is reporting a change of corporate structure. Kristi Olson has
resigned as president, treasurer, and director of the corporation. In addition, Ms.
Olson has sold her shares in the corporation to Daniel Bruntz. Mr. Bruntz is now
vice-president and secretary, as well as a director. Derek Cordova has assumed the
positions of president and treasurer.
Authority member Schroeer made a motion, seconded by Authority member Norton, to
adopt and approve all items on the Consent Calendar. Yeas: Cooper, Haggerty, Norton,
Poncelow, Schroeer, and Wawro. Nays: None.
THE MOTION CARRIED.
Report of Change of Manager for Albertson's
Food Center #862. 3660 South Mason. Approved
Bob Pfankuch, manager, indicated he took over as manager of this store on December 5,
1994. He spoke of his experience with the sale of alcoholic beverages, noting he managed
a store in Lafayette for the last 5 years. Prior to his employment with Albertson's, he
worked for Toddy's for 10 years. He stated there have been no violations of the beer code
under his management. Mr. Pfankuch stated beer sales are less that 1 %. He described
the alcohol training provided to employees.
Authority member Schroeer made a motion, seconded by Authority member Norton, to
approve Bob Pfankuch as manager of Albertson's Food Center #862, 3660 South Mason.
Yeas: Cooper, Haggerty, Norton, Poncelow, Schroeer, and Wawro. Nays: None.

Hearing on a New Application for a Beer and Wine
License at Italian Classics. 159 West Mountain. AR r� oved
Authority member Norton stated she knows Mr. Chiachiera but does not believe it would
affect her ability to make an objective decision in this matter.
Vincent Chiachiera and James Whelan introduced themselves and were sworn. Mr.
Chiachiera described minor remodeling that is being done at the restaurant. He stated he
will continue to manage the establishment and spoke of his experience with the sale of
alcohol. Mr. Chiachiera approached the Authority to describe the layout of the premises.

James Whelan indicated that he is planning to move to Fort Collins. He responded to
questions from the Authority regarding his DUI conviction. Mr. Whelan provided the
Authority with copies of their menu.
Assistant City Attorney John Duval stated he had reviewed Applicant's Exhibits A through
C. He stated Exhibit C, identified as a petition, is not admissible into evidence because the
verification of circulator has not been completed and the circulator is not present to testify.
He stated the verification of circulator on Exhibits A and B are signed, but not notarized.
He stated he could question Mr. Chiachiera and Mr. Whelan, who circulated the petitions,
to correct the deficiency.
In response to questions from Mr. Duval, Mr. Whelan testified that the persons whose
signatures appear on Exhibit A signed the petitions in his presence after indicating they
were at least 21 years of age and after reading the petition. Mr. Whelan testified to other
particulars contained in the verification of circulator.
In response to questions from Mr. Duval, Mr. Chiachiera also testified to the particulars
contained in the verification of circulator as it relates to Exhibit B.
Mr. Duval stated Applicant's Exhibits A and B are admissible into evidence.
Authority member Cooper made a motion, seconded by Authority member Poncelow, to
adopt Resolution 95-03 approving the application of Italian Classics, Inc., dba Italian
Classics, for a beer and wine license at 159 West Mountain. Yeas: Cooper, Haggerty,
Norton, Poncelow, Schroeer, and Wawro. Nays: None.
THE MOTION CARRIED.
Registration of Christopher Loved as Manager
of Archer's. 3524 South Mason. Approved
Christopher Levad, manager, stated at the time he completed his application he did not
remember any traffic violations. He stated that he has recently received information from
the Department of Motor Vehicles about a traffic violation in 1994. He indicated he has
had no violations since then. Mr. Levad stated he was previously an assistant
manager/bartender at Old Town Ale House and described his prior experience with the
sale of alcohol. He indicated he will be responsible for training the employees at Archers.
Authority member Poncelow made a motion, seconded by Authority member Schroeer, to
approve Christopher Levad as manager of Archer's, 3524 South Mason. Yeas: Cooper,
Haggerty, Norton, Poncelow, Schroeer, and Wawro. Nays: None.

Transfer of Ownership of P.D.S. Food
and Gas 382 East Mountain, AForoved
Gurmit Shahi, applicant, spoke of his employment history and noted he has experience
selling alcohol at convenience stores. He stated he also owns a convenience store and
gas station in Lafayette. He stated he will manage the store in Fort Collins. He estimated
alcohol sales to be approximately 3%.
In response to a question from Authority member Schroeer, Assistant City Attorney Duval
stated the Authority could condition its approval upon the applicants fully answering the
questions on the individual history record, specifically relating to employment history.
Authority member Schroeer made a motion, seconded by Authority member Haggerty, to
approve the transfer of ownership of P.D.S. Food and Gas, 382 East Mountain, from Karm
Jit to Paramdeep Salh and Gurmit Shahi, contingent upon the applicants providing
additional information relating to employment history. Yeas: Cooper, Haggerty, Norton,
Poncelow, Schroeer, and Wawro. Nays: None.
THE MOTION CARRIED.
Authority member Schroeer asked if staff is aware of all actions taken by the State
regarding local liquor licenses.
Liquor Licensing Specialist Rita Harris advised the Authority that the State forwards
documentation each time action is taken.
Authority member Schroeer noted the severity of penalties imposed by other jurisdictions
and suggested that this Authority is "too soft".
Authority member Norton made a motion, seconded by Authority member Haggerty, to
adjourn. Yeas: Cooper, Haggerty, Norton, Poncelow, Schroeer, and Wawro. Nays:
None.

The meeting was adjourned at approximately 7:20 p.m.
These minutes were prepared in July, 1997 and were not submitted to the Authority
for approval. The majority of the Authority members present at this meeting were
no longer on the Authority when the minutes were prepared.
