HomeMy WebLinkAboutLiquor Licensing Authority - Minutes - 10/28/1998A regular meeting of the Liquor Licensing Authority was held on Wednesday, October 28, 1998, in the Council Chambers of the Fort Collins Municipal Building. The following members were present: Cooper, Crowfoot, Davis, Minton, Morris, and Schmitz. Absent: Oldham. Staff Members Present: Aimee Jensen, City Clerk's Office Greg Tempel, City Attorney's Office Sandra Gibson, Police Department Consent Calendar The Consent Calendar is intended to expedite the meeting and allow the Authority to spend its time and energy on the important items on a lengthy agenda. Items on the Consent Calendar are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Calendar and considered separately. Items pulled from the Consent Calendar will be considered separately immediately following adoption of the Consent Calendar. 1. Approval of minutes from the March 23, 1997, April 22, 1998, May 27, 1998, June 24 1998, July 22, 1998, August 26, 1998, and September 23, 1998 meetings. 2. Report of Change of Corporate Structure for Safeway Stores 46, Inc. dba Safeway - all Fort Collins locations. 3. Request from Rock Bottom Restaurants, Inc., dba Old Chicago, 147 South College Street to Change, Alter, or Modify the Licensed Premises. Authority member Cooper made a motion, seconded by Authority member Morris, to adopt and approve the items on the Consent Calendar. Yeas: Cooper, Crowfoot, Davis, Minton, Morris, and Schmitz. Nays: None. THE MOTION CARRIED. • October 28, 1998 Registration of Patricia Mae Whaley -Mauer as Manager of Convenience Plus, 1032 West Mountain Approved Patricia Mae Whaley -Mauer, manager, described her employment history. She stated she is responsible for training the employees at this store. She stated she has never sold alcohol to a minor. Ms. Whaley -Mauer stated she does have the liquor code on premise for reference. She stated it is store policy to terminate an employee that sells to a minor. Ms. Whaley -Mauer noted she is in the store 55-60 hours a week. Authority member Schmitz made a motion, seconded by Authority member Crowfoot, to approve Patricia Mae Whaley -Mauer as manager of Convenience Plus, 1032 West Mountain. Yeas: Cooper, Crowfoot, Davis, Minton, Morris, and Schmitz. Nays: None. THE MOTION CARRIED. Request from SportsCaster, Inc., dba SportsCaster Bar and Grill, Dan Huber, manager, stated they had enclosed the patio area last November. He stated he had become the manager, January, 28, 1998, and was unaware of the modification. He stated no exits or entrances were added or removed. Authority member Cooper made a motion, seconded by Authority member Schmitz, to approve the modification of premise for SportsCaster Bar and Grill, 165 East Boardwalk. Yeas: Cooper, Crowfoot, Davis, Minton, Morris, and Schmitz. Nays: None. THE MOTION CARRIED. Hearing on a Change of Location for a Retail Liquor License at The Right Wine, 3307 South College Avenue, #108 to #115B, Approved Jim Yamane, owner, was sworn. Mr. Yamane detailed the proposed change of location. He stated the new location will have approximately 200 square feet less than the original store. Mr. Yamane detailed how i.d.'s are checked and the configuration of the new location. He noted all doors will be secured. Assistant City Attorney Greg Tempel stated Applicant's Exhibit 1, identified as petitions, are admissible into evidence. Kelly Pietrs, representative for Esquire Petitioning Services, LLC, was sworn. Ms. Pietrs described the petitioning process and indicated the petitions represent 145 (99%) signatures in favor and 1 (10/6) signature in opposition. She noted the one opposing signature expressed concern for parking issues. Pi • October 28, 1998 Authority member Morris made a motion, seconded by Authority member Crowfoot, to adopt Resolution 98-10 approving the application to change location for The Right Wine, Inc., dba The Right Wine, from 3307 South College, #108, to 3307 South College, #115B. Yeas: Cooper, Crowfoot, Davis, Minton, Morris, and Schmitz. Nays: None. THE MOTION CARRIED. Hearing on a New Application for a Tavern Liquor License for Coyote Sunset, LLC, dba as The Buccaneer's Den, 3307 South College Avenue, Suite 106, Approved AND Registration of Robert W. Baker as Manager of The Buccaneer's Den, 3307 South College Avenue Suite 106 Approved Diane Goldenstein, attorney representing Coyote Sunset, LLC, (applicant), stated the applicant is prepared to answer questions for the Authority. Patricia Brandt, owner, was sworn. Ms. Brandt described the type of establishment Buccaneer's Den will be. She stated they have contacted Anheuser-Busch for T.I.P.'s training classes and that she has reviewed the liquor code. Ms. Brandt stated she is aware she is responsible for the actions of her employees. She stated she has had no experience selling liquor, but has managed staff in previous employment. Ms. Brandt noted they will be serving snacks and sandwiches. Ms. Brandt stated she and the proposed manager, Robert Baker, circulated the petitions. She described the petitioning process. Ms. Brandt indicated that 120 signatures were in favor and 1 signature in opposition of issuance of the tavern liquor license. She stated they knocked on approximately 300 doors. Assistant City Attorney Greg Tempel stated the Applicant's Exhibits 1 and 2, identified as letters of reference, and Applicant's Exhibit 3, identified as petition documents, are admissible into evidence. Authority member Schmitz made a motion, seconded by Authority member Morris, to adopt Resolution 98-12 approving the application of Coyote Sunset, LLC, for a tavern liquor license at The Buccaneer's Den, 3307 South College, Suite 106. Yeas: Cooper, Crowfoot, Davis, Minton, Morris, and Schmitz. Nays: None. THE MOTION CARRIED. • • October 28, 1998 Mr. Robert Baker, manager, was sworn. Mr. Baker described his employment history. He stated the storage cabinet for the liquor will be locked. Mr. Baker stated he received many positive comments while petitioning the neighborhood. Mr. Paul Reynolds, witness for the Applicant, was sworn. He testified that in his opinion, Ms. Brandt and Mr. Baker are of good moral character. Authority member Cooper made a motion, seconded by Authority member Morris, to approve Robert W. Baker as manager of The Buccaneer's Den, 3307 South College Avenue, Suite 106. Yeas: Cooper, Crowfoot, Davis, Minton, Morris, and Schmitz. Nays: None. THE MOTION CARRIED. Hearing on a New Application for a Hotel -Restaurant liquor license for Michelle's Restaurant, Inc., dba Tailgate Tommy's, 145 East Mountain, Approved Brad March, attorney representing Michelle's Restaurant, Inc., (Applicant), described the restaurant. Michelle Vandagriff, owner, was sworn. Ms. Vandagriff stated she is planning on attending T.I.P.'s training and has reviewed the liquor code. She stated they will be carding everyone and there will be no tolerance for selling to underage. Ms. Vandagriff noted she will require her employees attend T.I.P.'s training. She noted the patio area is visible from inside the restaurant and will be separated from the sidewalk by a wrought iron fence. Ms. Vandagriff described the configuration and decor of the restaurant. Assistant City Attorney Greg Tempel stated the Applicant's Exhibit 1, identified as petitions, are admissible into evidence. Kelly Pietrs, representative for Esquire Petitioning Services, LLC, was sworn. Ms Pietrs described the petitioning process and indicated the petitions represent 191 (95.5%) signatures in favor and 9 (4.5%) signatures in opposition. Authority member Cooper made a motion, seconded by Authority member Minton, to adopt Resolution 98-09, approving the application of Michelle's Restaurants, Inc., for a hotel - restaurant liquor license at Tailgate Tommy's, 145 East Mountain Avenue. Yeas: Cooper, Crowfoot, Davis, Minton, Morris, and Schmitz. Nays: None. THE MOTION CARRIED. Hearing for a New Application for a Beer and Wine license for South China Restaurant, LLC, dba South China Restaurant, 4613 South Mason, Continued 4 r� L • October 28, 1998 Assistant City Attorney Greg Tempel detailed the deficiencies of this application. He stated it is not approved as to form. He noted the application was amended after the application was initially submitted. Assistant City Attorney Tempel noted that since the application was amended, the public notices were incorrect. Munyee Lee, owner, stated she was unaware of the extent of the deficiencies. Authority member Cooper made a motion, seconded by Authority member Schmitz, to continue this hearing to the December 2, 1998, Liquor Licensing Authority meeting. Yeas: Cooper, Crowfoot, Davis, Minton, Morris, and Schmitz. Nays: None. THE MOTION CARRIED. Adjournment Authority member Crowfoot made a motion, seconded by Authority member Cooper to adjourn.
