The following members were present: Cooper, Crowfoot, Duffy, and Oldham. Absent: Schmitz. Consent Calendar The Consent Calendar is intended to expedite the meeting and allow the Authorityto spend its time and energy on the important items on a lengthy agenda. Items on the Consent Calendar are (1) routine items; and (2) those of no perceived controversy. Anyone mayrequest that an item be "pulled" off the Consent Calendar and considered separately. Items pulled from the Consent Calendar will be considered separately immediately following adoption of the Consent Calendar. 1. Approval of minutes from January 26, 2000. Authority member Crowfoot made a motion, seconded by Authority member Duffy, to adopt and approve the items on the Consent Calendar. Yeas: Cooper, Crowfoot, Duffy, and Oldham Nays: None. THE MOTION CARRIED. Registration of Tonya Louise Hutchison as Manager of Chuck E. Cheese's, 105 West Prospect Approved Tonya Louise Hutchison, applicant, stated that the licensee, CEC Entertainment, Inc., limits each customer to two beers. She noted that everyone is carded and that she has the liquor code on premise. Ms. Hutchison stated she has worked at Chuck E. Cheese for 8 years and that her only experience serving liquor is with Chuck E. Cheese. Authority member Oldham made a motion, seconded by Authority member Crowfoot to approve Tonya Louise Hutchison as the Manager of Chuck E. Cheese's, 105 West Prospect. Yeas: Cooper, Crowfoot, Duffy, and Oldham Nays: None. THE MOTION CARRIED. February 23, 2000 Transfer of Ownership of Vincent's Old Town Cigar, 238 Linden, from VY & N Trading Company, Inc., to Celli, Inc., and Trade Name Change to The East Coast, Approved William Chelales, applicant, stated he has been in the restaurant business for 6 years. He stated he managed the Mishiwaka Inn and that he has never had a liquor violation and no major driving offenses. Greg Clay, applicant, stated has had no liquor violations. Assistant City Attorney Tempel stated this transfer of ownership is being done byorder of law and that the current license holder VY & N Trading Company, Inc., has abandoned the premises. He noted the applicant does not have a consent form from VY & N Trading Company, Inc., to transfer the liquor license. The Authority noted that no-one was present from VY & N Trading Company, Inc. Mr. Chelales stated theywill be opening in April. He noted they will be adding a second bathroom per the requirements of the Latimer County Health Department. Mr. Chelales stated he will submit a revised diagram. Authority member Crowfoot made a motion, seconded by Authority member Duffy, to approve the transfer of ownership of Vincent's Old Town Cigar, 238 Linden Street, from VY & N Trading Company, Inc., to Celli, Inc., and Trade Name Change to The East Coast. Yeas: Cooper, Crowfoot, Duffy, and Oldham Nays: None. THE MOTION CARRIED. Transfer of Ownership of Sullivan's Tavern, 820 City Park Avenue from Front Range Restaurant Concepts, Inc., to First Fish, LLC, Approved Assistant City Attorney Tempel stated the application was deficient and still needed an article of good standing, an operating agreement, and a description of the fence surround the patio. Art McDaniel, applicant, stated he should be receiving the articles of good standing within 1 week He stated that they have contracted with the current owners for training for one year. Mr. McDaniel stated he has had no experience selling liquor. He stated theywill have staff posted at the door starting at 9:30 p.m. on busy evenings. He stated the patio has the seating capacity for the patio is 30 and that the establishment has an occupancy of 150. Peter Borba, applicant, stated he has had no experience selling liquor. He stated they have a copy of the liquor code on hand. Authority member Oldham made a motion, seconded by Authority member Crowfoot to approve a temporary permit for Fast Fish, LLC, contingent upon receipt of the operating agreement and a valid E • February 23, 2000 certificate of good standing with an expiration date of March 22, 2000. Yeas: Cooper, Crowfoot, Duffy, and Oldham. Nays: None. THE MOTION CARRIED. Hearing on a New Application from Western Coffee Bar, LLP, for a Beer and Wine License at The Western Coffee Bar, 120 North Mason Street. #3. Approved Dan Robinson, applicant, was sworn. He gave a brief history of his employment. He stated he is no longer a professor at Colorado State University. Mr. Robinson stated he has had no experience serving liquor. He stated he will not be open past 7:00 p.m. and will open in approximately 3 weeks. He stated he plans on being on premise everyday. In response to a question from the Authority, Mr. Robinson stated he has no pending civil or criminal matters. He noted he may have patio seating in the future. The Authority reminded that he will be required to apply for a modification of premise if he wants to include a patio area as part of his licensed premise. Assistant City Attorney Greg Tempel stated Applicant's Exhibit A, identified as petitions, is admissible into evidence. Mr. Robinson described the petitioning process. He indicated he received few negative responses. Authority member Crowfoot made a motion, seconded by Authority member Oldham to adopt Resolution 2000-03, approve the application from Western Coffee Bar, LLP, doing business as The Western Coffee Bar, for a beer and wine license at 120 North Mason Street, #3. Yeas: Cooper, Crowfoot, Duffy, and Oldham. Nays: None. THE MOTION CARRIED. Adjournment Authority member Crowfoot made a motion, seconded by Authority member Schmitz, to adjourn.
