Chai erson: Charles Fielder hone: 484-0117(W), 207-0505 H) Council Liaison: Kelly Ohlson IlStaff Liaison: Felix Lee (221-6760) A regular meeting of the Building Review Board was held on Thursday, January 26, 2006 in the Council Chambers of the Fort Collins Municipal Building at 300 LaPorte Avenue, Fort Collins, Colorado. BOARDMEMBERS PRESENT: David Carr Charles Fielder Leslie Jones John McCoy Gene Little Michael Smilie BOARDMEMBERS ABSENT: Jim Packard STAFF MEMBERS PRESENT: Felix Lee, Building & Zoning Director Delynn Coldiron, Contractor Licensing Administrator Jenna Stieben, Staff Support AGENDA: ROLLCALL The meeting was called to order and roll call was taken. f►�� � �.:L�TIC�[�7 �►'�LIsl1� y�.9 Can made a motion to approve the minutes from the December 15, 2005 meeting. Fielder seconded the motion. The motion passed. 3. Andy Rex, d/b/a Rex General Contracting, License # 132-68 Lee introduced the appeal. He stated that Rex currently has a Class D2 license which allows him to construct residential additions up to 1,000 square feet of floor area. He noted that Rex was asking for a one time exemption for a residential remodel project that exceeds the square footage allowed by his license by 300 square feet. The appellant addressed the Board. He explained that this project is a 1,300 square foot addition. The explained that his clients are adding a 900 square foot second story addition along with a 400 square foot addition to the back of the house. BRB January 26, 2006 Pg. 2 Lee asked Rex to clarify his other work experience. Rex stated that he had 10 years of framing experience for new houses and had completed three other 2nd floor additions similar to the project that he is seeking approval to perform. Little asked if the appellant had taken the DI licensing exam. Lee answered that the appellant has only taken a D2 exam. Little asked Lee if a requirement for the appellant to document his experience would raise the level of comfort Building Services had with this request. Lee stated that would not be necessary and that the decision to approve or deny the request was a decision for the Board. Fielder made a motion to grant a one-time exemption to Rex's current D2 license that would enable him to perform the proposed 1,300 square foot addition as requested. Can seconded the motion. Vote: Yeas: Carr, Fielder, Jones, Little, Smilie (Note: McCoy had not yet arrived.) Nays: 4. Joseph Videll, Case # 02-06 Lee introduced the appeal. He stated that the appellant had applied for a DI license but did not have the prescribed amount of experience to enable staff to approve the licensing request. He noted that Videll had started a new construction business that specialized in the construction of energy -efficient, high-performance homes and that he had completed one home at 56435 Trade Wind Drive in Windsor, CO. Lee reviewed the ordinance requirement that a D1 applicant has to have completed the construction of a minimum of three single family homes or the equivalent thereof. Lee stated that appellant did pass the D1 exam with a 97%. Appellant addressed the Board. He stated the he has started a new business called Rock Solid Homes where his focus is to build environmentally friendly homes. He stated that energy - efficient construction principles were not typical of stick -built construction practices. Lee asked if the appellant had any other jobs he could obtain verification on. Appellant stated that he has done work in an advisory capacity for Habitat for Humanity and had remodeled his home in California. Lee asked if he had any experience working with the building code or if he had any certification from course work. Appellant replied that he had taken some classes but did not have any other certifications. Fielder asked the appellant for clarification on the reason he had come before the Board. Appellant stated that he was hoping to obtain a D 1 license with a waiver of the requirement that he had to have three completed D1 projects. Appellant also stated the he wanted to make sure that he could build on the lot that he is purchasing before he closes on it. In closing, Lee stated that we have one completed house for verification, but no other track record of the applicant's work. Smilie asked for clarification on whether Videll could build on the lot he plans to purchase if he was not planning to live there. Lee stated that under current ordinance requirements, this would have to be Videll's personal residence for him to be authorized to perform the construction on the lot. BRB January 26, 2006 Pg. 3 Little made a motion to approve a D1 license limited to the one project proposed for the Fort Collins lot he intends to buy based on the home he completed at 5434 Tradewind Drive in Windsor and based on his passing the D1 exam. Jones seconded the motion. Vote: Yeas: Carr, Fielder, Jones, Little, McCoy, Smilie Nays: 5. Contractor Appeal, Forest Glaser, d/b/a Rutt Construction, Case #03-06 Lee introduced the appeal and noted that Jones had excused himself due to a possible conflict. He stated that the appellant was seeking approval of a C2 license but did not have the prescribed amount of experience required to enable staff to approve his license upgrade request. Lee noted that although the applicant had multi -family building experience, he did not have a project that met the ordinance requirement for being over three stories in height and/or containing 16 or more units. Appellant addressed the Board. He stated the he currently holds a D1 license but was looking to upgrade his license to a C2. He offered that he had been on construction job sites since he was young and had gained a vast amount of experience this way. He also stated that he was a site supervisor for a project where a 6-plex was brought up to code and had supervised a number of single family homes and smaller multi -family projects. Lee asked if appellant he was seeking this upgrade to work on the projects going on at Harmony Ridge. Appellant confirmed this and stated that they are planning on constructing three more 4- plexes and one more 6-plex. There was some discussion about whether any of these buildings would qualify as a 3-story building. After discussion, it was determined that none of these buildings would qualify but that a C2 license was required to build them. Fielder stated that if they approve a restricted C2 license it would require the appellant to ask for an exemption every time he had a project like this. Smilie offered the he might be supportive of approving an unrestricted C2 license. Smilie made motion to approve a C2 license restricted to multi -family projects that are less than three stories in height. Carr seconded the motion. Vote: Yeas: Carr, Fielder, Jones, Little, McCoy, Smilie Nays: Smilie added that should the appellant have a project that exceeds two stories in height, he would need to come back to the Board for a one-time exemption for that project. Other Business A. Annual Report: Lee stated that all the Board members should have received a copy of the 2005 Annual Report. There was brief discussion. BRB January 26, 2006 Pg. 4 Fielder made motion to approve the Board's 2005 Annual Report. Jones seconded the motion. Vote: Yeas: Carr, Fielder, Little, McCoy, Smilie Nays: B. International Building Code: Lee stated that review of the IBC will begin soon. The intent is to recruit at least one member from the Board for involvement in this project.
