Council Liaison: Ray Martinez 11 Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on June 2, 2003 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Robert Younger, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated there are no changes to the agenda. Consent Agenda The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered under "Other Business" at the end of the meeting. a. Change in Corporate Structure for JuWu. Inc.. dba the Taj Mahal, 148 West Oak Street. Judge Lane adopted the Consent Agenda. Registration of Todd Orlando as Manager of Old Chicago, 4709 South Timberline Road, Approved Todd Orlando, manager applicant, stated he has been in the restaurant business for 10 years. He briefly described the training all employees are required to attend. Mr. Orlando stated that all staff attend monthly Bar Code training. He stated he meets monthly with his employees to specifically discuss the sale and service of alcohol. Mr. Orlando stated that they card any patron that appears to be 30 years or older. He stated he has the liquor code on premise. Judge Lane approved the registration of Todd Orlando as manager of Old Chicago, 4709 South Timberline Road. June 2, 2003 Request from T.E.H. Enterprises, Inc., dba Boomer's Beef 634 South College Avenue to Change, Alter, or Modify the Licensed Premises. Approved with Contingencies Anthony Emerich, representative for T.E.H. Enterprises, Inc., briefly described the proposed modification. In response to a question from the Judge, he stated he will increase the chain fence in the breeze way to 42 inches. Mr. Emerich stated the occupancy inside is less than 50 people and 29 on the patio. He briefly described the petitioning process. Mr. Emerich stated he encountered no opposition in petitioning. Judge Lane approved the request from T.E.H. Enterprises, Inc., dba Boomer's Beef, 634 South College Avenue to change, alter, or modify the licensed premises contingent upon approval from the Poudre Fire Authority. Transfer of Ownership of Residence Inn by Marriot,1127 Oakridge Drive, from Oakridge Hotels, LLLP to Oakridge Hotels, LLLP, Approved Brad March attorney representing Oakridge Hotels, LLLP, briefly describing this transaction. He stated there was a change in the general partner, therefore the State required a transfer of ownership. Mr. March stated that the day to day operations will not change. Judge Lane approved the transfer of ownership of Residence Inn by Marriot, 1127 Oakridge Drive, from Oakridge Hotels, LLLP to Oakridge Hotels, LLLP. Hearing on a New Application from UP Bigfoot, LLC, for a Tavern Liquor License at Mackey's Still & Grill, 2439 South College Avenue, Unit C3, Approved Tim Dow, attorney representing Lil' Bigfoot, LLC, stated they are ready to proceed. Max Scott, representative for Oedipus, Inc., was sworn. He briefly described the petitioning process. Mr. Scott stated the survey shows that the neighborhood wishes that this license be granted, and that the needs and desires of neighborhood is not currently being met. John Kincaid, representative for Lil' Bigfoot, LLC, was sworn. He briefly described his background. Mr. Kincaid stated he will maintain a current liquor code on premise. He stated he will be the registered manager. Mr. Kincaid stated he has had 2 prior violations of the liquor code. He stated he has a training program for his employees. Mr. Kincaid stated the carding policy will be any patron that appears to be 35 and under. He stated the seating capacity is 140. Mr. Kincaid briefly described the premise. He stated he anticipates his food sales will be approximately 40%. Judge Lane asked about prior violations. Mr. Kincaid stated they all attended T.I.P.'s training after the • June 2, 2003 violations. He stated there are changes to this manual from what was previously used. Mr. Kincaid clarified financial information. He stated the patio will be monitored at all times. Vicki Feekan, owner, was sworn. Ms. Feekan briefly described her background. She stated she will be working on premise full-time. Ms. Feekan stated she has never had a liquor code violation. Judge Lane adopted resolution 2003 - 05 approving the application from Lil' Bigfoot, LLC for a Tavern Liquor License at Mackey's Still & Grill, 2439 South College Avenue, Unit C3, contingent upon the receipt by the City Clerk's Office of the final promissory note between Lil' Bigfoot, LLC and the landlord. Hearing on a New Application from FitzGerald's, LLC, for a Tavern Liquor License at The Vault,146 North College Avenue. Continued to July 7. 2003 Assistant City Attorney Ablao requested that this hearing be continued to July 7, 2003. She stated the applicant has agreed to this continuance. Show Cause Hearing for the D. Martin Group, Inc., dba Elliot's Martini Bar, 235 Linden Street Violation Stipulated. Penalty Set Ronald Leonard, representing D. Martin Group, Inc., stated that Elliot's Martini Bar is a family run business. He requested that the Judge not impose the 7 day suspension from the prior violation. Mr. Leonard stated he and his staff have received TIP's training. He stated he has stipulated to the violation, but has requested this hearing for the Judge to determine the penalty. Mathew Hustee, manager, briefly described the incident. In response to a question from the Judge, Liquor Enforcement Officer Younger stated that employees must finish any shift drink by 2:00 a.m. Assistant City Attorney Ablao stated that Section 3-55 of the City Code allows the Judge to take into consideration mitigating factors, such as the seriousness of the violation. Judge Lane ordered that the D. Martin Group, Inc., serve the 7 days held in abeyance from their previous violation and assessed an additional 14 days of which, all to be held in abeyance for 1 year.
