Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on July 7, 2003 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Robert Younger, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated there are no changes to the agenda. Registration of Le'o Bouasone Outhenthapanya as Manager of Romano's Macaroni Grill, 4627 South Timberline, Approved Le'o Bouasone Outhenthapanya, manager applicant, stated he is T.I.P.'s trained. He stated he will require his employees to be T.I.P.'s trained. Mr. Outhenthapanya stated that all patrons that order liquor will be carded. He stated he has a copy of the liquor code on premise. Judge Lane approved the registration of Le'o Bouasone Outhenthapanya as manager of Romano's Macaroni Grill, 4627 South Timberline Road. Registration of Leesa Johnson as Manager of The Town Pump,124 North College Avenue. Approved Leesa Johnson, manager applicant, briefly described her background. She stated that the owner will be responsible for training any new employees. Ms. Johnson stated she cards every patron and that she has a device that can detect fake i.d.'s. She stated any employee found in violation of the liquor code is terminated. Judge Lane approved the registration of Leesa Johnson as manager of The Town Pump, 124 North College Avenue. July 7, 2003 Request from Farshad Nojoumi, dba The Avenue to Change, Alter, or Modify the Licensed Premises at 151 South College Avenue, Denied Farshad Nojoumi, licensee, briefly described the proposed modifications. He stated he has an encroachment permit from the City. Mr. Nojoumi stated that this proposed patio is similar to patio's previously approved at this location. He stated the entire patio is visible from inside the bar. Mr. Nojoumi stated he will have an employee monitoring the patio. He stated he does not have written permission to use the atrium area, but that it is easily obtainable. In response to a question from the judge, Liquor Enforcement Officer Younger expressed concerns with Mr. Nojoumi adequately controlling the sale and service of alcohol in the atrium. judge Lane denied the modification of premise as the Licensee had not established that he has exclusive right to possession of the kitchen or atrium areas that he now wishes to include in the licensed premises or the indoor (atrium) area between the front door of his establishment and the proposed outdoor patio area and that the Licensee has not established why certain of those indoor areas are proposed for inclusion in the licensed premises since he has indicated that alcohol would not be stored or served in a large portion of the indicated indoor area. Hearing on a New Application from FitzGerald's, LLC Rick Thomas, representative for FitzGerald's, LLC, was sworn. Mr. Thomas stated his food sales are 23% of gross sales. He stated he will continue to sell food and maintain the same hours for the kitchen. Mr. Thomas stated he has the liquor code on premise. In response to a question from the judge, Mr. Thomas briefly described the current premises. He stated he continually monitors the occupancy of the front bar area. Mr. Thomas stated he does not have problems with occupancy in the patio area. Bret Mansur, representative for Liquor Petitioning Professionals, was sworn. He briefly described the Petitioning process. Mr. Mansur stated most of the signatures were in support of this application. judge Lane adopted Resolution 2003-04 approving an application from Fitzgerald's, LLC, for a tavem liquor license at The Vault, 146 North College Avenue, contingent upon the licensee abiding by all local rules and regulations. Hearing on a New Application from MAST Enterprises of Wyoming, Inc., for a Hotel -Restaurant Liquor License at HuHot Mongolian Grill, 259 South College Avenue, Art Thiele, representative for MAST Enterprises of Wyoming, Inc., was sworn. He stated he has held many liquor licenses. Mr. Thiele stated he anticipates that alcohol sales will be approximately 5.5% of the gross sales. He briefly described a liquor violation that occurred 25 years ago. July 7, 2003 Bret Mansur, representative for Liquor Petitioning Professionals, was sworn. He briefly described the petitioning process. He stated he received many positive comments in support of this application. Judge Lane adopted Resolution 2003-07 approving an application from MAST Enterprises of Wyoming, Inc., for a hotel -restaurant liquor license at HuHot Mongolian Grill, 259 South College Avenue. Registration of Kristian R. Steinwart as Manager of HuHot Mongolian Grill, 259 South College Avenue, Approved Kristian R. Steinwart, manager applicant, briefly described his background. He stated any employee found in violation of the liquor code will be immediately terminated. Mr. Steinwart stated it will be their policy to ID any patron requesting an alcoholic beverage. He stated he has a copy of the liquor code on premise. Judge Lane approved the registration of Kristian R. Steinwart as manager of HuHot Mongolian Grill, 259 South College Avenue. Hearing on a New Application from the Board of Governors CSU System for a Hotel -Restaurant Liquor License at Mike Ellis, Robert Peters, Sheldon Godkin, and Dr. Cook, representatives for the Board of Governors, were sworn. Mr. Ellis stated he is familiar with the liquor code and intends to keep a copy of the liquor code in each area where liquor will primarily be served. He stated that food sales will represent 90% of their gross sales. Sheldon Godkin briefly described his background. He stated he has been the manager of the University Club for 17 years and has not had liquor code violation. Robert Peters, catering manager, briefly described his background. He stated he has worked on college campuses for 22 years. Mr. Peters stated he is a certified TIP's trainer and that he is responsible for training all employees involved in the sale and service of alcohol. Assistant City Attorney Ablao stated that she has stipulated to the testimony from Max Scott, representative for Oedipus, Inc., with regard to the petitions. Judge Lane adopted Resolution 2003-08 approving an application from the State Board of Agriculture for a hotel -restaurant liquor license at the Lory Student Center, Colorado State University.
