Council Liaison: Ray Martinez II Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on July 21, 2003 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Robert Younger, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated that there were no changes to the agenda. Consent Agenda The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered under "Other Business" at the end of the meeting. a. Consideration of an Application from the Fort Collins Symphony Association for a Special Events Permit at the Museum of Contemporary Art, 201 South College Avenue. Judge Lane adopted the Consent Agenda. Show Cause Hearing for FitzGerald's, LLC dba The Vault,146 North College Avenue, Stipulation Agreement Approved Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was present to answer questions. She stated that the licensee has agreed to a 5 day suspension, 5 days served (3 days to be served concurrently from a prior violation), for violation Regulation 47-900 (unreasonable noise). Judge Lane approved the findings, conclusion, and order accepting the stipulation agreement as presented for The Vault, 146 North College Avenue. July 21, 2003 Hearing on a New Application from Mugs Coffee Lounge, LLC for a Hotel -Restaurant Liquor License at Mugs Coffee Lounge, 261 South College Avenue, Approved McCabe Callahan, representative for the applicants, was swom. He briefly described his background and the proposed premise. Mr. Callahan stated that there is no access to the patio from the first floor. He stated they plan to open in September. Mr. Callahan briefly described the menu. He stated he will only be serving alcohol after 5:00 p.m. He briefly described his training procedures. Mr. Callahan emphasized that he will have no tolerance for visibly intoxicated individuals on the premise. He briefly described the petitioning process. Mr. Callahan stated many of the residents were in support of this application. He stated the objections to this application were due to religious reasons and downtown businesses. Judge Lane adopted Resolution 2003 - 10 approving the application from Mugs Coffee Lounge, LLC, for a hotel -restaurant liquor license at Mugs Coffee Lounge, 261 South College Avenue. Hearing on a New Application from Choice City Butcher & Deli, LLC for a Beer and Wine License at Choice City Butcher & Deli,104 West Olive Street, Derek Kennedy and Russ Robinson, representatives for Choice City Butcher & Deli, LLC, were swom. Mr. Robinson and Mr. Kennedy briefly described their backgrounds. Mr. Kennedy briefly described the establishment and the premise. In response to a question from the Judge, Mr. Robinson stated that any violation of the liquor code would result in an immediate suspension and possibly lead up to termination. Mr. Kennedy stated he will contact Officer Younger for training. Jessica LaPatton was sworn. She briefly described the petitioning process. Ms. LaPatton stated that she surveyed business' as well as residences. She stated most of the people polled were in favor of this application. Judge Lane adopted Resolution 2003 - 09 approving the application from Choice City Butcher & Deli, LLC for a beer and wine license at Choice City Butcher & Deli, 104 West Olive Street. Hearing on a New Application from Home for Dinner, LLC for a Tavern Liquor License at Home for Dinner, 212 East Monroe Drive, Approved Marta Hawk, representative for Home for Dinner, LLC, was swom. She briefly described her background. Ms. Hawk stated this establishment is a combination cooking school and meal preparation deli. She stated she will be T.I.P.'s trained. Ms. Hawk stated she has contacted Officer Younger to provide training for her employees. She stated she will always be present when alcohol will be served. Ms. Hawk stated patrons are required to list their age on the cooking school application. Kelly Pietrs, representative for Esquire Petitioning Services, was swom. Ms. Pietrs briefly described the petitioning process.
