Regular Meeting - January 24, 2005

A regular meeting of the Liquor Licensing Authority was held on Jagnuary 24, 2005 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated the Show Cause Hearing for Versacorp, Inc., dba The Avenue has been
continued to January 31, 2005 at 1:00 p.m. She stated a disposition has been reached between the Fort
Collins Police Department and Manno's Bar and Grill and will be considered after the Consent Agenda.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on
important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no
perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and
considered separately. Items pulled from the Consent Agenda will be considered under "Other
Business" at the end of the meeting.
a. Request from Coopersmith Brewing Company, dba Coopersmith's Pub & Brewing, to
Alter, or Modify the Licensed Premises at #5 Old Town Square.
Judge Lane adopted the Consent Agenda.
Show -Cause Hearing for Braun's Bar & Grill at Collindale, LLC
dba Manno's Bar and Grill,1441 East Horsetooth
Stipulation Agreement Approved
Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was
present to answer questions. She stated that the Licensee has agreed to a 15 day suspension, 5 days
served (paid fine in lieu of suspension $523), with 10 days held in abeyance for 1 year for violating
Regulation 47-900(A), allowing a visibly intoxicated person on premise.

Scott Manning, representative for Braun's Bar & Grill at Collindale, LLC, stated he has already
scheduled training for his employees.
Judge Lane approved the findings, conclusion, and order accepting the stipulation agreement as
presented for Manno's Bar and Grill, 1441 East Horsetooth.
Hearing on a New Application from
Tte-Mark, Inc., for a Retail Liquor Store License
at Fabby's Wine & Spirits
2608 South Timberline Road. #112, Approved
Doug Fabschutz's, representative for Tre-Mark, Inc., was sworn. Mr. Fabschutz's stated he will be
attending Officer Younger's training on January 29, 2005. He stated they will card anyone who appears
to be under 30 years of age. Mr. Fabschutz's stated all his employees will be required to attend training.
He briefly described his background. In response to a question from the Judge, Mr. Fabschutz stated
this will be a neighborhood store. He stated he and his family live in this neighborhood. Mr. Fabschutz
stated at minimum there will always be 2 employees in the store. He stated he will be on premise most
of the time. Mr. Fabschutz stated any employee found in violation of the liquor code will be
immediately terminated.
Assistant City Attorney Ablao stipulated to the admission of the petitions. Judge Lane marked the
petitions as Exhibit 1.
Joe Koslosky, developer and landowner, was sworn. He briefly spoke of the development.
Judge Lane adopted Resolution 2005-01 approving the application from Tre-Mark, Inc., for a Retail
Liquor Store License at Fabby's Wine & Spirits at Fabby's Wine & Spirits, 2608 South Timberline Road,
#112.
Hearing on a New Application from
The Lazy M Ranch, Inc., for a Hotel -Restaurant Liquor License
at The Best Little Steakhouse in Fort Collins
103 West Harvard. Approved
Stephen Moritz, representative for The Lazy M Ranch, Inc., was sworn. He briefly described his
background. Mr. Moritz stated this restaurant will be similar to the restaurant he had in Estes Park. He
stated they will have a limited variety of alcohol available to patrons. Mr. Moritz stated he has not had
a liquor code violation in the past. He stated they will be opening February 19, 2005. Mr. Moritz stated
alcohol sales will be less than 20% of gross sales. He stated he will be on premise 6 days a week and
employ 10-12 wait and kitchen staff. Mr. Moritz stated they will card patrons that appear under 30 years
of age. He stated his staff will be fully trained prior to opening. Mr. Moritz stated he will contact
Officer Younger, Liquor Enforcement Officer, for training. He stated any employee found in violation
of the liquor code will be immediately terminated. Mr. Moritz stated he does not have the liquor code
on premise.
January 24, 2005
Judge Lane adopted Resolution 2005-02 approving the application from The Lazy M Ranch, Inc., for
a Hotel -Restaurant Liquor License at The Best Little Steakhouse in Fort Collins 103 West Harvard.
