Regular Meeting - February 28, 2005

A regular meeting of the Liquor Licensing Authority was held on February 28, 2005 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane Presiding.

Agenda Review
Deputy City Clerk Jensen stated that there are no changes to the agenda.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on
important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no
perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and
considered separately. Items pulled from the Consent Agenda will be considered under "Other
Business" at the end of the meeting.

Judge Lane adopted the Consent Agenda.
Registration of Daniel J. Lefebvre
as Manager of Austin's American Grill,
100 West Mountain, Approved
Daniel Lefebvre, manager applicant, briefly described his background. He stated he is TIP's trained.
Mr. Lefebvre stated he has been involved in the sale of alcohol for 4'/2years. He stated he currently
supervises 35 employees. Mr. Lefebvre stated his employees attend training given by their vendors. He
stated they card any patron that appears to be 40 and under.
Judge Lane approved the registration of Daniel J. Lefebvre as manager of Austin's American Grill, 100
West Mountain Avenue.

Transfer of Ownership of The Starlight Venue,
167 North College Avenue, from DaBlack, LLC to
LLC, to FC5, Inc., and Trade Name Change to
The Starlight, Approved
Dan Kerig and Joe Vadar, representatives for FC5, Inc., stated they are ready to proceed. Mr. Vadar
briefly described the plans they have for this establishment. He stated there will be a variety of
entertainment. Mr. Vadar they will not make any structural changes to the premise. He stated they have
snacks and sandwiches available.
In response to a question for Assistant City Attorney Ablao, Mr. Vadar has introduced himself to the
neighbors. He stated he has instructed his employees to clean the sidewalk area in front of The
Starlight.
Judge Lane approved the transfer of ownership of The Starlight Venue, 167 North College Avenue,
from DaBlack, LLC to FC5, Inc., and Trade Name Change to The Starlight.
Registration of Kevin Kirchner as
Manager of The Starlight,
167 North College Avenue, Approved
Kevin Kirchner, manager applicant, stated he has worked in the liquor industry for over 10 years. He
stated he has received TIP's trained. Mr. Kirchner stated he will contact Liquor Enforcement Officer
Younger for training. He stated either he or one of the owner's is on premise while they are open. Mr.
Kirchner stated any patron that appears to be over 40 years old will be carded. He stated they will not
tolerate visibly intoxicated patrons on premise. Mr. Kirchner stated he has a current liquor code on
premise.
Judge Lane approved the registration of Kevin Kirchner as Manager of The Starlight, 167 North College
Avenue, contingent upon Mr. Kirchner attend training within 60 days.
Hearing on a New Application from Griller's Global Cafe, Inc.,
for a Hotel -Restaurant Liquor License at Griller's Global Cafe,
706 South College Avenue, Unit 102, Approved
Keith Wren and Kendall Wren, representatives for Griller's Global Cafe, Inc., were sworn. Mr. Kendall
Wren stated they have applied for this license in response to requests from their patrons. Mr. Keith
Wren stated they will continue to emphasize food sales. Mr. Kendall Wren stated they estimate their
alcohol sales will be no more than 5%. Mr. Kendall Wren stated the patio fencing is 2 '/z feet high
wrought iron. He stated the patio is fully visible from inside. Mr. Keith Wren stated they are both
scheduled to attend TIP's training. Mr. Kendall Wren stated he will be responsible for training the
employees in the sale and service of alcohol. He stated he has instructed his employees to card any
patron who appears to under 40 years of age. Mr. Kendall Wren stated he does not have a current
liquor code on premise.

Mr. Kendall Wren briefly described the petitioning process. He stated they have additional signatures
to present to the Judge.
Judge Lane adopted Resolution 2005-05 approving the application from Griller's Global Cafe, Inc., for
a Hotel -Restaurant Liquor License at Griller's Global Cafe, 706 South College Avenue, Unit 102.
Show -Cause Hearing for Janette's Pharmacy, Inc.,
dba Park Central Liquor, 1624 South Lemay Avenue, Bldg. #6 & #7. Vacated
Assistant City Attorney Ablao requested that the show -cause hearing for Park Central Liquor be vacated
as the sales tax issued has been resolved.
Show -Cause Hearing for MCRC, Inc.,
dba North College Discount Liquors,
814 North College Avenue, Stipulation Agreement Approved
Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was
present to answer questions. She stated that the Licensee has agreed to a 15 day suspension, 3 days
served (paid fine in lieu of suspension $994),12 days held in abeyance for 1 year for violation Regulation
47-700, making a locked area open to inspection and C.R.S. 12-47-901(5)(a)(1), serving a visibly
intoxicated individual.
In response to a question from the Judge, Mary Gregory, representative for MCRC, Inc., stated she
terminated the employee that sold to the visibly intoxicated individual and not opening the store to the
police officer.
Judge Lane approved the findings, conclusion, and order accepting the stipulation agreement as
presented for North College Discount Liquors, 814 North College Avenue.
