Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on May 16, 2005 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Robert Younger, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated that the request from Choice City Butcher & Deli, LLC, dba Choice City Butcher & Deli to modify the licensed premises at 104 West Olive will be heard at the end of the meeting. Transfer of Ownership of Canyon Avenue Restaurant, 211 Canyon Avenue, from Canyon Avenue Restaurant and Lounge, LLC, to DSMS Enterprises, LLC, and Trade Name Change to Canyon Chop House, Postponed to June 20, 2005 Matt Schump, representative for DSMS Enterprises, LLC, briefly discussed his background. He stated he will be adding a patio to the front and that he has no experience in the sale and service of alcohol. Judge Lane postponed consideration of the transfer of ownership of Canyon Avenue Restaurant, 211 Canyon Avenue, from Canyon Avenue Restaurant and Lounge, LLC, to DSMS Enterprises, LLC, and trade name change to Canyon Chop House to June 20, 2005 and directed Mr. Schump to provide Deputy City Clerk Jensen with a current diagram of the premise. Hearing on a New Application from Dillon Companies, Inc., for a 3.2% Beer - Off Premise License at King Soopers #97, 2602 South Timberline Road, Approved Alan Dill, representative for Dillon Companies, Inc., stated he is ready to proceed. Mr. Dill called Barb Osness, property manager for Dillon Companies, Inc., was sworn. She stated she has been with King Soopers for 30 years. Ms. Osness briefly described her background. She stated this store will be opening July 20, 2005. Ms. Osness stated that Dillon Companies, Inc., operates between 2200 and 2300 May 16, 2005 grocery stores throughout the country. She stated that all sales clerks will be required to attend T.I.P.'s certified training. Ms. Osness stated employees found in violation of the liquor code receive a suspension. She stated that less than .5% of their gross sales come from the sale of 3.2% beer. In response to a question from the Judge, Ms. Osness briefly discussed the violations of other stores in Colorado. Judge Lane adopted Resolution 2005-09 approving the 3.2%Beer - Off Premise application from Dillon Companies, Inc., at King Soopers #97, 2602 South Timberline Road. Hearing on a New Application from Toasty Mountain LLC, for a Beer and Wine License at Cheba Hut Toasted Subs, 104 East Laurel Street Scott Jennings, representative for Toasty Mountain, LLC, was sworn. He briefly described his background. Mr. Jennings stated many of his customers have requested that he provide beer and wine. He stated he will attend Liquor Enforcement Younger's training class. Mr. Jennings stated they intend to close by 10:30 p.m., each evening. He briefly described the premise. Stan Dobbs, manager, was sworn. He briefly described his background. Mr. Dobbs stated he will attend Liquor Enforcement Officer Younger's training class. He stated only the manager on duty will serve the beer and wine. Mr. Dobbs stated he will develop a training manual for each employee. He stated any employee found in violation of the liquor code will be terminated immediately. Mr. Dobbs stated he has a current liquor code on premise and is familiar with it. Mr. Dobbs briefly described the petitioning process. He stated he allowed anyone petitioned to sign in opposition to the application. Judge Lane adopted Resolution 2005-11 approved an application from Toasty Mountain, LLC, for a beer and wine license at Cheba Hut, 104 East Laurel, contingent upon Mr. Dobbs and Mr. Jennings attend training and provide proof of training to Deputy City Clerk Jensen. Request from Choice City Butcher & Deli, LLC, dba Choice City Butcher & Deli to Change, Alter, or Modify the Licensed Premises at 104 West Olive, Approved Russ Robinson and Derek Johnson, representatives for Choice City Butcher & Deli, LLC, briefly described the proposed changes. Mr. Robinson stated that the liquor storage and how it's served will not change. In response to a question from the Judge, Mr. Johnson stated he will submit an updated diagram to Deputy City Clerk Jensen. Mr. Robinson briefly described the petitioning process. He stated he received many positive comments in support of this application. Judge Lane approved the request from Choice City Butcher & Deli, LLC, dba Choice City Butcher & Deli to change, alter or modify the licensed premises at 104 West Olive.
