Regular Meeting - August 8, 2005

A regular meeting of the Liquor Licensing Authority was held on August 8, 2005, 2005 in Municipal
Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated there are no changes to the agenda.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on
important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no
perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and
considered separately. Items pulled from the Consent Agenda will be considered under "Other
Business" at the end of the meeting.

Judge Lane adopted the Consent Agenda.
Hearing on a New Application from Gelazzi, Inc.,
for a Tavern Liquor License at Gelazzi Gelato
Italiano Cafe. 128 South College Avenue, Approved
Jeremiah Unger, a representative for Gelazzi, Inc., was sworn. He briefly described the type of
establishment. Mr. Unger stated that alcohol sales will be less than 8% of gross sales. In response to
a question from the Judge, Mr. Jeremiah briefly described the premises. He stated that each employee
is required to attend a four day training and be TIP's trained. Mr. Unger stated the manager will be
required to be TIP's trained. He stated that any employee found in violation of the liquor code would
be terminated. Mr. Unger stated he has a current copy of the liquor code on premise. He stated the
owners are aware of their community responsibilities and the importance of following the liquor laws.
Judge Lane adopted Resolution 2005-14 approving an application from Gelazzi, Inc., for a tavern liquor
license at Gelazzi Gelato Italian Cafe, 128 South College, contingent upon all employees receiving
TIP's training.

Registration of Daniel Nicklas as Manager
of Woody's Wood -Fired Pizza,
518 West Laurel, Approved
Daniel Nicklas, manager applicant, stated he will be TIP's trained by the end of 2005. He stated the bar
area is closed to anyone under 21 after 9:00 p.m. Mr. Nicklas stated the kitchen manager also monitors
the restaurant. He stated he has experience dealing with visibly intoxicated individuals. Mr. Nicklas
stated that any employee in found of violation will be immediately terminated. He stated he has a
current copy of the liquor code on premise.
Judge Lane approved Daniel Nicklas as Manager of Woody's Wood -Fired Pizza, 518 West Laurel.
Registration of Kevin Mitts
as Manager of Texas Roadhouse,
4633 South Timberline Road, Approved
Kevin Mitts, manager applicant, stated he has nearly 30 years of restaurant experience. He briefly
described his background, noting that he is a TIP's trained leader. Mr. Mitts stated there are 89
employees involved in the sale and service of liquor at this location. He stated there are several
managers always on duty. Mr. Mitts stated patrons are carded at the table if they appear to be 40 years
of age and younger. He stated that any employee found in violation of the liquor code is terminated.
Mr. Mitts stated he a copy of the current liquor code on premise.
Judge Lane approved the registration of Kevin Mitts as manager of Texas Roadhouse, 4633 South
Timberline Road.
Request from Three Dagos, Inc.,
dba Buca to Change, Alter, or Modify
the Licensed Premises at 130 South Mason, Approved
Mr. Tessari, representative for Three Dagos, Inc., stated the entire patio is visible from inside the
restaurant. He briefly described the proposed changes. Mr. Tessari stated he has an encroachment
permit.
Judge Lane approved the request from Three Dagos, Inc., dba Buca to change, alter or modify the
licensed premises at 130 South Mason.
Transfer of Ownership of Lemay Liquors,
737 South Lemay, #B2, from
Lemay Liquors, Inc., to Father and Son Liquors, LLC, Apl2roved
Dennis Jensen and Michael Jensen, representatives for Father and Son Liquors, LLC, stated they are
ready to proceed. Mr. Dennis Jensen stated he is responsible for the day to day operations. Mr. Michael
Jensen stated he is a silent partner in this venture. Mr. Dennis Jensen stated he has not made any
physical changes to the premise. He stated they are open the same hours as the previous owner. Mr.

Dennis Jensen stated he emphasizes to his employees the importance of carding patrons that appear to
be 40 years of age or younger. He stated he would first give an employee a warning if found in violation
of the liquor code. Mr. Dennis Jensen stated he has a current copy of the liquor code on premise.
Mr. Michael Jensen detailed his background.
Judge Lane approved the transfer of ownership of Lemay Liquors, 737 South Lemay, #B2, from Lemay
Liquors, Inc., to Father and Son Liquors, LLC.
Other Business
Discussion ensued regarding allowing one day modifications of premise.
