Regular Meeting - August 22, 2005

A regular meeting of the Liquor Licensing Authority was held on August 22, 2005 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated that Assistant City Attorney Ablao has reached stipulation agreements
with Trail Head Tavern and Thirsty's Liquor.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on
important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no
perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and
considered separately. Items pulled from the Consent Agenda will be considered under "Other
Business" at the end of the meeting.

Judge Lane adopted the Consent Agenda.
Show Cause Hearing for
Ratso Rizzo, Inc., dba
Trail Head Tavern, 148 West Mountain Avenue
Stipulation Agreement Approved
Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was
present to answer questions. She stated that the Licensee has agreed to a 15 day suspension, 5 days
served (paid fine in lieu of suspension $2000), 10 days held in abeyance for 1 year for violating C.R.S.
Section 12-47-901(1)(a), permitting the sale or service of alcohol beverages to a person under the age
of 21 years.
David Herrera, attorney representing Ratso Rizzo, Inc., stated his client understands the terms and
conditions of this stipulation agreement.
Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as
presented for Trail Head Tavern, 148 West Mountain Avenue.

Show Cause Hearing for Young Joo Park,
dba Thirsty's Liquor, 460 South College Avenue
Stipulation Agreement Approved
Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was
present to answer questions. She stated that the Licensee has agreed to a 45 day suspension, 20 days
actively served (consecutive days, excluding Sundays, commencing at 12:01 a.m. on August 23, 2005 and
ending at 12:01 on September 15, 2005), with 25 days held in abeyance for 1 year for violating C.R.S.
Section 12-47-901(1) (a), by permitting the sale or service of alcohol beverages to a person under the age
of 21 years.
Judge Lane approved the findings, conclusion, and order accepting the stipulation agreement as
presented for Thirsty's Liquor, 460 South College Avenue.
Transfer of Ownership of the New County Cork,
313 West Drake Road, from Athenian Gardens, LLC, to
Meracana, LLC and Trade Name Change to Fort Collins County Cork, Approved
Kelley Hammel, representative for Meracana, LLC, stated he has had several years of experience in the
sale and service of alcohol. He stated he will not be changing the premise or the hours of operation.
Mr. Hammel stated he will have monthly meetings with his employees to review policies and procedures
with regards to the sale and service of alcohol. He stated that he has a door person checking id's on
Friday and Saturday night. Mr. Hammel stated he will require all staff to attend Liquor Enforcement
Officer Younger's training. In response to a question from the Assistant City Attorney Ablao, Mr.
Hammel stated he will provide the necessary information to complete his Individual History Record.
He briefly described his background and the training he has received.
Judge Lane approved the Transfer of Ownership of the New County Cork, 313 West Drake Road, from
Athenian Gardens, LLC, to Meracana, LLC and Trade Name Change to Fort Collins County Cork.
Transfer of Ownership of The Avenue,
151 South College Avenue, from Versacorp, Inc.,
to the Shadow Bar. Inc., and Trade Name Change to Drunken Monkey, Approved
Tony Campana and David Jones, representatives for The Shadow Bar, Inc., stated they require all their
employees to be TIP's trained. Mr. Jones stated he is certified as a national TIP's training instructor.
Mr. Campana stated they are not making any changes to the premise other than cosmetic. In response
to a question from the Judge, Mr. Campana briefly described the premise. Mr. Jones stated the
mezzanine will be used mainly for private parties. He stated they have a doorperson each evening
checking each patron's id. Mr. Jones stated that any employee found in violation of the liquor code will
normally be terminated, giving consideration to the incident. He stated they have a current copy of the
liquor code on premise. In response to a question from Assistant City Attorney Ablao, Mr. Jones stated
they do not intend to darken the windows overlooking the patio.
Judge Lane approved the Transfer of Ownership of The Avenue, 151 South College Avenue, from
Versacorp, Inc., to the Shadow Bar, Inc., and Trade Name Change to Drunken Monkey.

Hearing on a New Application from Arness, Inc.,
for a Hotel -Restaurant Liquor License
at Silver Grill Cafe. 218 Walnut Street, Approved
John Amolfo, representative for Arness, Inc., was sworn. He stated he will be attending training offered
by Liquor Enforcement Officer Younger, as well as training given by the staff at Coopersmith's. Mr.
Amolfo stated he expects liquor sales will be less than 10% of gross sales. He stated that the catered
events will have a full bar available. Mr. Arnolfo said they will occasionally serve bloody mary's, screw
drivers and mimosa's during regular hours of operation. He stated that they will card anyone who
appears to be 30 years of age or younger. Mr. Arnolfo stated that any employee found in violation of
the liquor code will be suspended up to and including termination. He stated he has a current copy of
the liquor code on premise.
Mr. Arnolfo briefly described the petitioning process. He stated he received numerous positive
responses in support of this application. Mr. Amolfo stated he also received support for morning
service in addition to the evening catered events. Judge Lane accepted the petitions as Exhibit 1 and
Exhibit 2.
Jim Clark, executive director for the Fort Collins Visitors Convention Bureau, spoke in support of this
application.
Judge Lane adopted Resolution 2005 - 16 approving an application from Arness, Inc., for a hotel -
restaurant liquor license at Silver Grill Cafe, 218 Walnut Street, contingent upon the owner and manager
receiving TIP's or equivalent training.

Manager of the Silver Grill Cafe, 218 Walnut Street, Approved
Carrie Hartwell, manager applicant, stated she has several years of experience with the sale and service
of alcohol. She briefly described the type of training all employees will receive. Ms. Hartwell stated she
will respond to any issues regarding visible intoxication. She stated she is familiar with the liquor code.
Judge Lane approved Carrie Hartwell as Manager of the Silver Grill Cafe, 218 Walnut Street.
