Regular Meeting - February 27, 2006

A regular meeting of the Liquor Licensing Authority was held on February 27, 2006 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated there are no changes to the agenda.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on
important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no
perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and
considered separately. Items pulled from the Consent Agenda will be considered under "Other
Business" at the end of the meeting.

Judge Lane adopted the Consent Agenda.
Agenda Review
Deputy City Clerk Jensen stated the manager registration application for Flambe's International Grill
and Lone Star Steakhouse have been withdrawn. She stated Assistant City Attorney Ablao has reached
a stipulation agreement with Wine & Liquor Specials, and Consuelo's New Mexican Restaurant. Deputy
City Clerk Jensen stated Park Central Liquors has been continued to March 20.

dba Wine and Liquor Specials,
2439 South College Avenue Stipulation Agreement Approved
Roger Morris, attorney representing the licensee, stated Ramsey Schueweihat was available to answer
any questions the Judge may have. He stated they have finalized a stipulation with Assistant City
Attorney Ablao. Mr. Morris stated the manager and employees will attend Liquor Enforcement Officer
Younger's training.
Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was
present to answer questions. She stated that the Licensee has agreed to a 15 day suspension, 5 days
served (paid fine in lieu of suspension $2233), 10 days held in abeyance for 1 year for violating C.R.S.
12-47-901(1)(a) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a
visibly intoxicated person.
Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as
presented for Wine and Liquor Specials, 2439 South College Avenue.

Assistant City Attorney Ablao requested this hearing be continued to March 20, 2006.
Show -Cause Hearing for Salvador and Consuelo Trujillo,
dba Consuelo's New Mexican Restaurant,
1401 West Elizabeth. Stipulation Agreement Approved
Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was
not present to answer questions. She stated that the Licensee has agreed to a 10 day suspension, 3 days
served (paid fine in lieu of suspension $220), 7 days held in abeyance for 1 year for violating C.R.S. 12-
47-901(a.5)(I) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a
person under the age of 21 years.

Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as
presented for Consuelo's New Mexican Restaurant, 1401 West Elizabeth.
Hearing on a New Application from
Sha-Fer, Inc., for a Beer and Wine License at
Gustavo's Market, 2567 South Shields, Suite 4D Approved
Shana Judd, representative for Sha-Fer, Inc., was sworn. She briefly described her background. Ms.
Judd stated she has received many requests for alcohol service. She stated the establishment will
primarily serve food and that they do not intend to stay open late in the evening. In response to a
question from the Judge, Ms. Judd stated the hallway behind the premise is not accessible by the public.
Ms. Judd detailed the licensed premise. She stated the alcohol will be stored in the office. Ms. Judd
stated she and her husband will attend T.I.P.'s training.
Ms. Judd briefly described the petitioning process. She stated petitioning the residences was very
difficult. Ms. Judd stated only a few individuals were against the issuance of this application. She stated
there are many no solicitations neighborhoods within the designated neighborhood.
Judge Lane adopted Resolution 2006 - 01 approving an application from Sha-Fer, Inc., for a beer and
wine license at Gustavo's Market, 2567 South Shields, Suite 4D, contingent upon the owner and her
husband attending T.I.P.'s or equivalent training within 60 days.
Other Business
Liquor Enforcement Officer Younger stated he has received a grant from the federal government that
will be shared with Colorado State University to conduct compliance checks.
