Regular Meeting - March 20, 2006

A regular meeting of the Liquor Licensing Authority was held on March 20, 2006 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated the show cause hearing for Park Central Liquors will be continued to
May 15, 2006 to allow the attorneys to prepare briefs for the Judge. She stated the show cause hearing
for Suite 152 and The Armadillo has been continued to April 17. Deputy City Clerk Jensen stated the
show cause hearing for Chuck E. Cheese has been re -scheduled for today's hearing from April 3.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on
important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no
perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and
considered separately. Items pulled from the Consent Agenda will be considered under "Other
Business" at the end of the meeting.

Show Cause Hearing for CEC Entertainment, Inc,
dba Chuck E. Cheese's,
105 West Prospect Road Stipulation Agreement Approved
Kevin Coates, attorney representing CEC Entertainment, Inc., stated the cause for violation has been
addressed. He stated there had been a breakdown in communication. Mr. Coates stated one employee
was terminated and the other was disciplined.
Judge Lane approved the finding, conclusion and order accepting the stipulation agreement as presented
for Chuck E. Cheese's, 105 West Prospect Road.
Show Cause Hearing for
Ernest and Kristine Schmidtberg,
dba City Park Liquor,
2016 West LaPorte Avenue Stipulation Agreement Approved
Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was
present to answer questions. She stated that the Licensee has agreed to a 15 day suspension, 5 days
served (paid fine in lieu of suspension $2358), 10 days held in abeyance for 1 year for violating C.R.S.
12-47-901(a.5) (1), permitting the sale or service of alcohol beverages to a person under the age of 21
years.
Ernest Schmidtberg stated he admits to the violation and detailed changes he has made so that this does
not occur again.
Judge Lane approved the finding, conclusion and order accepting the stipulation agreement as presented
for City Park Liquor, 2016 West Laporte.
Hearing on a Change of Location Application
from Stonehouse Pubs One, LLC, to move
a Hotel -Restaurant Liquor License from
160 West Oak Street to 125 South College Avenue, Approved
Kit Sutherland and Scott Kintz, representatives for Stonehouse Pubs One, LLC, were sworn. Ms.
Sutherland detailed why they are changing the location of their hotel -restaurant liquor license. Mr.
Kintz stated they will retain much of the prior tenant's finish. He stated the hours of operation and
general `feel' of the restaurant will not change. Mr. Kintz stated they are in the process of obtaining
their building permits. He stated they hope to be open by the end of May. Mr. Kintz stated the bar
service for the roof top patio will be from the banquet room.
Ms. Sutherland described the petitioning process. She stated she received wide support for this
application. Ms. Sutherland stated she talked extensively with business owners and residents within the
neighborhood.
Judge Lane approved the change of location application from Stonehouse Pubs One, LLC, to move a
hotel -restaurant liquor license from 160 West Oak Street to 125 South College Avenue.

Hearing on a New Application from
Cafe Mexicali, LLC, for a Hotel -Restaurant Liquor License
at Cafe Mexicali, 2925 South College Avenue, Approved
Richard Krammer and David Hoffman, representatives for Cafe Mexicali, LLC, were sworn. Mr.
Krammer stated their initial intention was to not have a liquor license. He stated they received an
overwhelming number of requests for alcohol service. Mr. Krammer stated he has had no liquor code
violations. He stated he and his staff will attend Officer Younger's training on April 7. Mr. Krammer
stated the seating capacity is 202. He stated he has 24 employees of which 5 will be involved in the sale
and service of alcohol. Mr. Krammer stated they will not have a full bar. He stated any employee found
in violation of the liquor code will be terminated. Mr. Krammer stated they will card any patron that
appears to be under the age of 30. He stated the hours of operation will not change once they receive
the liquor license. Mr. Krammer stated he does not anticipate liquor sales to be more than 2% of their
gross sales. He stated staff will be able to easily monitor the patio area.
David Hoffman briefly described the petitioning process. He stated most people were receptive and
supportive of this application.
Judge Lane adopted Resolution 2006-02 approving the application from Cafe Mexicali, LLC, for a hotel -
restaurant liquor license at Cafe Mexicali, 2925 South College Avenue contingent upon attending
training within 60 days.
