HomeMy WebLinkAboutCitizen Review Board - Minutes - 07/21/1999Citizen Review Board Special Meeting Wednesday, 07-21-99, 18:30 Teledyne Human Resources Conference Room Present: Greg Tempel -City Attorney's Office, Chuck Wanner -Council Liaison, Hal Dean -Staff Liaison, Donald Colby, Carole Stansfield, Monica Garcia, Rick Aulino, Becky Richardson Absent: Sam Blanco, Brian Carroll Introductions Introductions were made for Greg Tempel, representative from City Attorney's Office and Chuck Wanner, Council Liaison. Questions/ Can CRB be sued? concerns Yes open to civil suit, if you act outside parameters of raised Board, if you discuss case or investigate outside of Board. If you are sued, the city will defend or hire an attorney and pay judgment providing what you do is in course and scope of charge and you don't act willfully or wantonly to violate anyone's rights. Taking files home to be reviewed. Confidential files can be taken home for review. Reasonable steps must be taken to ensure that they are kept confidential. Will CRB receive feedback related to results of investigation and disciplinary action or appeal? Will know if allegation is sustained, exonerated, etc. Public and complainant will also be told, some specific details may be confidential. Comments upon discipline will remain confidential. If complainant does not agree with advisement, will they be told they can appeal to CRB? A letter will accompany advisement stating that CRB is available. By-laws Greg Tempel will compose first draft of by-laws. Selection of Random shall mean drawing names out of a hat. No rotation, Subcommittee no names left out of drawing unless CRB member feels there may be a conflict of interest. If this is the case, CRB member 0 .• CRB Special Meeting 07-21-99, 6:30 p.m. page 2 can asked that name not be included in drawing. Alternate will have no voting privileges except if one of the three subcommittee members should have to be excused due to illness or emergency. When selected for a subcommittee, all subcommittee members, including alternate, should attend all meetings. Question was raised that if drawing of names by chair was done in private there could be accusations of impropriety. Discussion ensued. Greg Tempel will address this issue when creating by-laws. A motion was made by Rick that if cases were received before by-laws were drafted Hal Dean will notify the chair. Chair will call committee for conflict of interest, obtain population sample, and draw four subcommittee members. First three drawn will be voting members, fourth will be alternate. First name drawn will be chair of this subcommittee. Monica seconded. No discussion. Vote was taken, motion carried 5-0. Meetings If three or more CRB members meet, it will be considered a meeting and open to public, minutes must be taken and filed appropriately. A motion was made by Carole that regular meetings be held third Wednesday of every month at 6:30 p.m., alternating sites between City Human Resources Conference Room and Teledyne Human Resources Conference Room. Monica seconded. Discussion that first regular meeting will be held at City Human Resources Conference Room. Vote was taken, motion carried 5-0. Rick will be responsible for public postings and meeting notifications. Election of Donald, Monica and Becky all said they would be willing to be chair/vice- chair. Vote was taken. Donald was selected as chair and chair Becky as vice -chair. It was decided that chair will act as spokesperson. City attorney's office will be resource regarding advice about legal content related to public statements. Conflict of Greg stated that he provides legal advise to CRB. He also interest provides legal advice to FCPD. If CRB ever sees this as conflict of interest, considerations will be made. Meeting adjourned at 8:40 p.m. Next Meeting The next regular meeting of CRB will be Wednesday, 08-18 @ 6:30 p.m. at City Human Resource Conference Room, 200 West Mountain. ADonald Colby Date
