A regular meeting of the Liquor Licensing Authoritywas held on Monday, April 16, 2001, in Municipal
Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated there were no changes to the agenda.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authorityto spend its time and
energyon the important items on a lengthyagenda. Items on the Consent Agenda are (1) routine items;
and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the
Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered
separately immediately following adoption of the Consent Agenda.
1. Aporoval of revised Petition Guidelines and Petition form samples.
Assistant City Attorney Tempel requested that item k 1 be pulled from the Consent Agenda for
discussion.
Judge Lane and Assistant City Attorney Tempel briefly discussed minor changes to the Petition
Guidelines and Petition form samples.
Judge Lane adopted the Petition Guidelines and Petition form samples.

Report of Change of
Corporate Structure from Rubio's Restaurants, Inc.,
dba Rubio's Baia Grill, 4709 South Timberline Road, Approved
Adam Stapen, attorney representing the applicant, briefly described the change of corporate structure.
He noted that the current manager, Kyle King, was appointed the manager January, 2001.
Judge Lane acknowledged receipt of the Report of Change of Corporate Structure from Rubio's
Restaurants, Inc., dba Rubio's Baja Grill, 4709 South Timberline Road, # 103.
Request from Rio Grande Mexican Restaurant, Inc.,
dba Rio Grande Mexican Restaurant,
143 West Mountain, to
Change, Alter, or Modify the Licensed Premise, Approved
PatrickMcGaughrin, president of Rio Grande Mexican Restaurant, Inc., brieflydescribed the proposed
changes. He stated they are expanding the food preparation area and adding a cooler to the south end
of the building. Mr. McGaughrin confirmed that the only change is the addition of the cooler and that
there is no change in occupancy load, or changes to entrances or exits.
Assistant CityAttorney Tempel requested Mr. McGaughrin provide a diagram of the entire fast floor.
Judge Lane approved the request from Rio Grande Mexican Restaurant, Inc., dba Rio Grande Mexican
Restaurant,143 West Mountain Avenue, to Change, Alter, or Modify the Licensed Premise contingent
upon receipt by the City Clerk's office a diagram of the entire first floor.
Transfer of Ownership of City Park Nine Golf Course,
411 South Bryan from
Dale Smigelsky, to Mike William Goff,
and Trade Name Change to
Mike Goff, applicant, stated he has been a golf professional for 30 years. He stated he has had no liquor
violations. Mr. Goff noted that there are some minor changes to the pro -shop from when Mr.
Smigelsky held the 3.2% beer license. He briefly described the changes. Mr. Goff stated there will be
at least 1 employee in the pro -shop. He stated he has instructed his staff that anyone that looks 30 and
younger will be carded. Mr. Goff stated he has the Colorado Revised Statutes on premise.
Judge Lane approved the Transfer of Ownership of CityParkNme Golf Course, 411 South Bryan from
Dale Smigelsky, to Mike William Goff, and Trade Name Change to Goff's Golf Shop at CityPark Nine
Golf Course.

Hearing on a New Application from
Conway Oil Company, for a
3.2% Beer- Off Premise License at
Texaco Start Mart,1675 North College Avenue, Approved
Manual Martinez, attorney representing the applicant, called Marty Raglin to testify.
Mr. Raglin, operations manager, was sworn. He brieflydescribed the concept forthe Texaco Start Mart.
Mr. Raglin stated that part of the building will have a McDonalds, but will not be part of the licensed
premise. He stated Conway Oil Company is in the process of applying for 2 more 3.2% Beer licenses
elsewhere in Colorado. Mr. Raglin stated he has been in the convenience store business for manyyears.
He stated Ramona Schrabel will be the manager for this establishment and that all employees will be
required to attend server training. Mr. Raglin stated selling to an underage individual is automatic
temvnation of employment.
Kelly Pietrs, representative for Esquire Petitioning Services, LLC, was swom. She described the
petitioning process and indicated the petitions represent 212 (70%) in favor and 89 (30%) in opposition.
Ms. Pietrs stated this was a strong survey in support of this application.
The petitions were marked as Exhibit # 1.
Judge Lane adopted Resolution 2001-04 approving the application from Conway Oil Company, for a
3.2% Beer - Off Premise License at Texaco Start Mart, 1675 North College Avenue.

G & R of Rhythms, Inc., for a
Hotel -Restaurant Liquor License at
Rhythms Bar & Grill, 334 East Mountain, Approved
Patrick Glatz, representative for the applicant, was sworn. Mr. Glatz briefly described his background.
He stated he is in the process of purchasing the building. Mr. Glatz brieflydescribed the training he will
require of all his employees. He stated he will initially be the registered manager and that he has the
liquor code on premise. Mr. Glatz stated he will have approximately 14 employees with an additional
8 employees as security personnel.
The menu for Rhythms Bar & Grill was marked as Exhibit # 1.
Mr. Glatz brieflydescribed the petitioning process. He noted he acquired approximately700 signatures,
with the majority in favor of this application. Mr. Glatz stated the primary complaint from people he
petitioned were concerned about trash and public intoxication in the Old Town area. The petitions
were marked as Exhibit # 2.
Letters of reference were marked as Exhibit # 3.

Assistant City Attorney Tempel stated the application still needs corporate paperwork from the
Secretary of State's office, a revised diagram, and updated figures for questions # 12 and # 31 on the
Individual History Records for Patrick and Jay Glatz.
Judge Lane adopted Resolution 2001-03 approving the application from G & R of Rhythms, Inc., for
a hotel -restaurant liquor license at Rhythms Bar & Grill, 334 East Mountain, contingent upon the City
Clerk's office receipt of current corporate paperwork, a revised diagram, and updated figures for
questions # 12 and # 31 on the Individual History Records for Patrick and Jay Glatz.
Police Report
Fort Collins Hooters
Liquor Enforcement Officer Richard Johnson summarized the stipulation agreement and stated that
the Licensee was present to answer questions. He stated that the Licensee has agreed to a 3-day
suspension (paid fine in lieu of serving all 3 days, $771.).
Judge Lane approved the findings and order accepting the stipulation agreement as presented for Fort
Collins Hooters, 2631 South College Avenue.
