Council Liaison: Ray Martinez II Staff Liaison: Aimee Jensen Aregular meeting of the LiquorLicensing Authoritywas held on Monday, March 12, 2001, in Municipal Court, Justice Center, 201 North College. Judge Kathleen M. Lane presiding. Staff in attendance: Greg Tempel, Assistant CityAttorney Richard Johnson, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda The Consent Agenda is intended to expedite the meeting and allow the Authorityto spend its time and energyon the important items on a lengthy agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and considered separately. Items pulled fromthe Consent Agenda will be considered separately immediately following adoption of the Consent Agenda. 1. Minutes from Februar3� 5. 2001 meeting 2. 3. Judge Lane adopted the Consent Agenda. Registration of Shane Sandman as Manager of the Colorado Grill, 1113 West Drake, Approved Shane Sandman, manager applicant, stated he has been the assistant manager for 1 year. He stated all employees are required to attend T.I.P.'s training. Mr. Sandman briefly described the training he has received. He stated wait staff card patrons at the table. Mr. Sandman stated employees that violate the liquor code will be terminated. Judge Lane approved the registration of Shane Sandman as Manager of the Colorado Grill,1113 West Drake. E March 12, 2001 Request from DJH, Inc., dba Diamond Billiards & Pub, 1213 West Elizabeth, to Change, Alter, or Modify the Licensed Premises, Continued to March 19, 2001 Dan Holcomb, President of DJH, Inc., brieflydescribed the proposed changes. He stated he has been unable to secure a lease from his landlord for the patio. Judge Lane continued the request from DJK Inc., dba Diamond Billiards & Pub, 1213 West Elizabeth, to change, alter, or modify the licensed premises to March 19, 2001. Registration of Somsakul Santanachote as Manager of Sri Thai Restaurant, 950 South Taft Hill Road, Continued to March 19, 2001 Deputy City Clerk Jensen stated the applicant was not present. Judge Lane continued the registration of Somsakul Santanachote as Manager of Sri Thai Restaurant, 950 South Taft FU Road to March 19, 2001. Hearing on a New Application from Club Fusion, Inc., for a Tavern Liquor License at Club Fusion,159 West Mountain Tim Dow, attorney representing the applicant, stated his client is present and ready to proceed. Tina Scott, representative for Oedipus, Inc., was swom. She described the petitioning process and indicated the petitions represent 183 (92%) signatures in favor and 15 (8%) signatures in opposition. Ms. Scott stated this was a strong survey. The petitions were marked as Exhibit 1. Steve Baltich, President of Club Fusion, Inc., was swom. Mr. Baltich brieflydescribed his background. He stated he is currently the assistant manager at The Matrixx. Mr. Baltich described the type of establishment dub Fusion is, the expected clientele, and howthe premises will be monitored. He stated he has reviewed the liquor code. Mr. Baltich stated patrons will be carded before they enter the establishment. Hie stated they -will have snack foods available. Mr. Baltich stated dub Fusion will be a 21 and over establishment. He stated any employee that violates the liquor code will be terminated. In response to questions from Assistant GtyAttomeyTempel, Mr. Baltich confirmed that he has been affliated with The Matrixx since it was opened. He brieflydescribed previous problems at The Matrixx. Assistant GtyAttomeyTempel submitted the lease as Exhibit A, the application as Exhibit B, and Mr. Baltich's Individual History Record as Exhibit C • March 12, 2001 In response to questions from Assistant atyAttomeyTempel, Mr. Baltich confirmed that no one else, besides himself, will loan or give money, inventory, furniture orequipment. Mr. Baltich stated the initial amount of moneyinvested listed on his Individual HistoryRecotd has increased to $30,000. He stated the moneyhe has invested in Club Fusion is his personal money -he received as payfrom The Matrixx in the form of bonuses. Mr. Baltich stated he is the sole signatory on the Club Fusion, Inc. account. He confirmed that the lease submitted as Exhibit A is the most current lease. Assistant City Attorney Tempel submitted Exhibit D, checks written on various checking accounts; Exhibit E, checks written on the Club Fusion, Inc., account signed byMr. Tad Buonamici; and Exhibit F, the building permit application for the location signed by Mr. Tad Buonamici. Assistant City Attorney Tempel entered signed checks on Club Fusion, Inc., as exhibit F. Mr. Baltich stated he left several blank checks for Mr. Buonamici to sign as needed. He stated that Mr. Buonamici is helping him with the construction of the establishment unpaid. Mr. Baltich detailed the sequence of events leading up to him taking over the Club Fusion project from Mr. Buonamici. Mr. Dow objected to Exhibits D, E, and F. He stated he had no objection to Exhibits A, B, and C. Assistant City Attorney Tempel stated all these exhibits were relevant to demonstrate that he is being assisted by Tad Buonamici. Judge Lane admitted the exhibits and ruled them relevant. In response to further questioning, Mr. Baltich stated his investment is now closer to $45,000 and moves money into the business account from his personal account as needed. Mr. Dow stated his applicant has met all the requirements of the code and that there is no other financial interest of any kind other than Steve Baltich. Assistant City Attorney Tempel requested that the Authority take into consideration that Mr. Baltich did not give information on his application fully, faithfully, truthfully, and fairly. Judge Lane ordered Mr. Baltich revise his application to more clearly reflect the amount of money he has invested in Club Fusion, Inc. Judge Lane adopted Resolution 2001-02 approving the application from Club Fusion, Inc., for a tavern liquor license at Club Fusion,159 West Mountain Avenue. 9 March 12, 2001 Registration of Andrea Davis as Manager of Club Fusion, 159 West Mountain, Approved Andrea Davis, manager applicant, briefly described her background. She stated she recently was employed by The Matrixx. Ms. Davis stated she will be supervising approximately 12 people and will be on premise every night. She stated the occupancy load is 275. Ms. Davis stated she will have staff carding patrons at the door. She stated she has the liquor code on premise and -is familiar with it. Ms. Davis stated that if an employee violates the liquor code, they will be immediately terminated. Judge Lane approved the registration of Andrea Davis as manager of Club Fusion,159 West Mountain Avenue. Adjournment The meeting adjourned at 3:15 p.m Municipal Judge
