Council Liaison: Ray Martinez Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on Monday, July 16, 2001, in Municipal Court, Justice Center, 201 North College. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant CityAttorney Richard Johnson, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated Items # 5 and # 7 have been added to the Consent Agenda. Consent Agenda The Consent Agenda is intended to expedite the meeting and allow the Authorityto spend its time and energyon the important items on a lengthyagenda. Items on the Consent Agenda are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered separately immediately following adoption of the Consent Agenda. 1) Approval of minutes from the June 18, June 4, March 19, and March 12, 2001 meetings. 2) 3) 4) Consideration of an Application fromthe Poudre Landmarks Foundation, fora Special Events Permit at 320 East Mulberry. 5) and 18, 2001. 6) Judge Lane adopted the Consent Agenda. July 16, 2001 Consideration of an Application from the Downtown Business Association, for a Special Events Permit at Library Park for the New West Fest for August 18 and 19, Approved David Short, representative forDowntown Business Association, submitted a newdiagram. He detailed the changes on the new diagram. Judge Lane approved the application from the Downtown Business Association, for a Special Events Permit at Library Park for the NewWest Fest for August 18 and 19, 2001. of Mandy Miller as Manager of Mandy Miller, manager applicant, briefly described her background. She detailed the training she has received in the sale of alcohol. Ms. Miller stated she supervises 4-8 people each shift. She stated she has instructed her employees to card each patron. Ms. Miller stated Noodles & Company's alcohol service policies are in each employee's handbook Judge Lane approved the registration of MandyMiller as Manager of Noodles & Company, 4733 South Timberline Road. of Dane Klingbeil as Manager of Dane Klingbeil, manager applicant, stated he has worked in the restaurant and bar industry for approximately 15 years. He stated he was required to take a 5-hour class every 3 years as part of receiving his license to serve alcohol in Tennessee. Mr. Klingbeil brieflydescribed the required training provided employees regarding the service of alcohol. He stated patrons are carded at the table. Judge Lane approved the registration of Dane Klingbeil as Manager of Lone Star Steakhouse & Saloon, 100 West Troutman Parkway. Hearing on a New Application from CRS - MOR, Inc., for a Beer and Wine License at Christopher's Pizza & Pasta, 700 South College Avenue, Unit B, Approved Christopher Morales, representative for the applicant, was sworn. He stated he has been in the restaurant business for 12 years. He brieflydescribed the training he has received and stated he has had no liquor violations. Mr. Morales stated he has received numerous requests from his customer to provide beer. He stated he will not be open past 10:00 p.m., and estimates that his liquor sales will be approximately25% of his gross sales. Mr. Morales stated he will use the office and dry storage area to store alcohol. He stated carding of patrons will be at the cash register when an order is placed. Mr. Morales stated he will terminate any employee found violating the liquor code. July 16, 2001 In response to questions from Judge Lane, Mr. Morales stated the gaming area is not physically separated from the dining area. He stated he will amend the diagram Mr. Morales briefly described the petitioning process. He stated he received very little opposition to this application. Judge Lane marked the petitions as Exhibit 1. Judge Lane noted that there were no parties in interest present to speak for or against this application. Judge adopted Resolution 2001-05 approving the application from CRS - MOR, Inc., for a beer and wine license at Christopher's Pizza & Pasta, 700 South College, Unit B. Consideration of an Application from the Food Bank for Latimer County, for a Special Events Permit at 1301 Blue Spruce, for October 6, 2001, Approved Wendie Robinson, Executive Director for the Food Bank for Larimer County, briefly described the proposed event. Ms. Robinson submitted a revised diagram. She brieflydescribed the proposed event. Ms. Robinson stated they anticipate approximately 250 attendees. She stated they have not had any problems at previous events. Ms. Robinson stated Toast of the Town will be serving alcohol. She stated they will have a certificate of occupancy by the end of August. Judge Lane approved the application from the Food Bank for Larimer County, for a Special Events Permit for October 6, 2001, at 1301 Blue Spruce, contingent upon receipt bythe City Clerk's office of a Certificate of Occupancy from Ms. Robinson. on a New Application from Positano's, Inc., Diane Saathoff, attorney representing the applicant, stated they are ready to proceed. Doug Blardo, representative forPositano's, Inc., was swum. Mr. Blardo brieflydescribed the restaurant. He stated hours of operation are 10:30 a.m. to 9:30 p.m. and that theyanticipate alcohol to be 10 - 15% of gross sales. Mr. Blardo stated everyone will be carded and employees will be terminated if found in violation of the liquor code. He stated he will have Liquor Enforcement Officer Johnson conduct a training class for the owners as well as all the employees. Mr. Blardo confirmed that the diagram submitted is correct. He stated he will limit each patron to 3 drinks. In response to questions from Judge Lane and Assistant City Attorney Teresa Ablao, Mr. Blardo detailed his background. Mr. Blardo described the petitioning process. He stated he primarily petitioned managers and owners, as they compromise the majority of his immediate neighborhood. Judge Lane marked the petitions as Exhibit # 1. 11 • July 16, 2001 Mr. Blardo stated he legallychanged his last name to Bellardo, but has not used it extensively. He stated he will submit a new set of finger prints with that name to do an additional background check Judge Lane noted that there were no parties in interest to support or oppose this application. OtyAttomeyAblao asked the Authorityto denythis application based on insufficient petitions and Mr. Blardo's criminal history. Diane Saathoff gave closing arguments in support of issuance of this license. Judge Lane cited 12-47-301, Colorado Revised Statutes, stating that the statute does not give clear guidance as to what is deemed to be good character and that 24-5-101, Colorado Revised Statutes, allows the Local Liquor Licensing Authority to take into account rehabilitation of an applicant. Judge Lane adopted Resolution 2001-06 approving the application from Positano's Inc., for a beer and wine license at Positano's, 3645 South College. Police Report Teriyaki Wok Officer Richard Johnson briefed the Judge on alleged violations at Teriyaki Wok, 829 South Shields. He requested the Judge schedule a show cause hearing for August 20, 2001. Judge Lane found that probable cause exists to schedule a show cause hearing on August 20, 2001, for Teriyaki Wok, 829 South Shields, for alleged violation of Regulation 47-410, Colorado Code of Regulations. Judge Lane also instructed Deputy City Clerk Jensen to issue necessary subpoenas. The Matrixx Officer Richard Johnson briefed the Judge on alleged violations at The Matrixx, 450 Linden Center Road. He requested the Judge schedule a show cause hearing for August 20, 2001. Judge Lane found that probable cause exists to schedule a show cause hearing on August 20, 2001, for The Matrix, 450 North Linden Center Road, for alleged violation of Regulation 47-918, Colorado Code of Regulations.
