Regular Meeting - October 1, 2001

A regular meeting of the Liquor Licensing Authority was held on Monday, October 1, 2001, in
Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated the Police Department will present a stipulation agreement for The
Matrixx, 450 North Linden Center Street under Police Report.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authorityto spend its time and
energy on the important items on a lengthy agenda. Items on the Consent Agenda are (1) routine items;
and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the
Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered
separately immediately following adoption of the Consent Agenda.

Judge Lane adopted the Consent Agenda.
Registration of David Cannon as Manager
of Chipotle Mexican Grill,
649 South College Avenue, Approved
David Cannon, manager applicant, stated he has been in the restaurant industry for over ten years. He
brieflydescribed the training he has received in the sale of alcohol. Mr. Cannon stated he has contacted
Officer Richard Johnson for classes for his entire staff. He stated the cashier is the only employee
serving alcohol. Mr. Cannon stated he is on premise 55 - 60 hours a week. He stated they will card
everyone who purchases alcohol. Mr. Cannon stated any employee violating the liquor code will be
terminated. He stated he does not have the liquor code on premise.
Judge Lane approved the registration of David Cannon as Manager of Chipotle Mexican Grill, 649
South College Avenue.

Transfer of Ownership of the Carousel Dinner Theatre,
3509 South Mason, from
Carousel Dinner Theatre, Inc., to KT Productions, Inc.. Approved
Kate Terrio, representative for KT Productions, Inc., stated theyhave been open for 1 week She stated
she received training in the sale of alcohol from previous employment and is currently receiving training
from the previous owners. Judge Lane encouraged Ms. Terrio to contact Officer Richard Johnson for
training. She stated they have not modified the premise. Ms. Terrio stated there is a bartender on duty
when they are open. She briefly described the training the employees have received. Ms. Terrio stated
the liquor code is on premise.
Judge Lane approved the transfer of ownership of the Carousel Dinner Theatre, 3509 South Mason,
from Carousel Dinner Theatre, Inc., to KT Productions, Inc.
Transfer of Ownership of The Western Coffee Bar,
144 North Mason Street, from Western Coffee Bar, LLP,
to The Chefs Recipes, LLC, Approved
Greg Gadwa, representative for The Chef's Recipes, LLC, stated he plans on being on premise 20-30
hours per week He briefly described the training he has received. Mr. Gadwa stated he does not
anticipate a large percentage of his sales to be beer and wine. He stated the premise has not been
modified. Mr. Gadwa stated there will be two employees on premise at all times. He stated hours of
operation are 6:30 a.m. to 6:30 p.m., six days a week Mr. Gadwa stated he will card all patrons
requesting alcohol. He stated he does not have the liquor code on premise. Mr. Gadwa briefly
described his background.
Judge Lane approved the transfer of ownership of the Western Coffee Bar, 144 North Mason Street,
from Western Coffee Bar, LLP, to The Chef's Recipes, LLC.

1113 West Drake Road, from TNG Associates,
to Multiple Ventures, LLC and Trade Name Change to

Assistant City Attorney Ablao requested that this item be continued to October 15, 2001, as the
investigating officer Ernie Tellez was not available to testify today.
David Dechant, representative for Multiple Ventures, LLC, stated he has no objection to continuing
the hearing to October 15, 2001.
Judge Lane continued the transfer of ownership of The Colorado Grill, 1113 West Drake Road, from
TNG Associates, to Multiple Ventures, LLC, and Trade Name Change to Abuelo's Cantina, and the
registration of Paul Dechant as manager of Abuelo's Cantina to October 15, 2001.

Hearing on a New Application from Thai Pepper, LLC
fora Beer and Wine License at Thai Peover,
Sathien Tongbua, representative for Thai Pepper, LLC, was sworn. He stated he has been in the
restaurant business since 1970. Mr. Tongbua stated he has had numerous requests from patrons to
serve alcohol. He stated alcohol sales will be less than 5% of his gross sales. Mr. Tongbua stated he
has had no training in the sale of alcohol. He stated he will contact Officer Richard Johnson for
training. Mr. Tongbua stated they are open for lunch and dinner, six days a week He stated he is the
only one that will be serving alcohol. Mr. Tongbua stated the seating capacity for Thai Pepper is 40.
He stated alcohol will not be served on the patio.
Mr. Tongbua briefly described the petitioning process. He stated he received unanimous support for
the granting of this license.
Judge Lane adopted Resolution 2001-11 approving an application from Thai Pepper, LLC, for a beer
and wine license at Thai Pepper, 109 East Laurel.
Police Report
The Matrixx
Assistant CityAttomeyAblao summarized the stipulation agreement and stated that the Licensee was
present to answer questions. She stated that the Licensee has agreed to a 5 day suspension, $1971 paid
in lieu of serving 2 days, with the remaining 3 days to be held in abeyance for 1 year.
Andy Gavaldon, attorney representing The Matrixx, stated his client understands the details of this
stipulation agreement.
