Council Liaison: Ray Martinez 11 Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on February 3, 2003 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane Presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Richard Johnson, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated the Show Cause Hearing for Suite 152, Inc., dba Suite 152, Building 23, Suite 152, Old Town Square, was continued to March 3, 2003. Show Cause Hearing for Big D Ventures, dba Jungle Bay, 450 Linden Center Drive, Stipulation Agreement Approved Assistant City Attorney Ablao summarized the stipulation agreement and stated that Zach Wilson, attorney representing Ron Gray (building owner), is present to answer questions. He stated that the Licensee has forfeited its lease for the licensed premises and has assigned the liquor license to Ron Gray as of January 29, 2003. Mr. Wilson stated Mr. Gray is forming a legal entity to hold the liquor license and will be submitting a manager registration. Assistant City Attorney Ablao stated that the Licensee has agreed to a 3 day suspension, with all 3 days served and no days held in abeyance for violation of Regulation 47-902 (2 separate incidents) and C.R.S. 12-47-412(1), failing to post required signs and failed to have sandwiches and light snacks available. Judge Lane approved the findings, conclusion, and order accepting the stipulation agreement as presented for Big D Ventures, Inc., dba Jungle Bay, 450 Linden Center Drive. Show Cause Hearing for DRM Ventures, Inc. dba Johnny's Place, 103 LaPorte Avenue, Stipulation Agreement Approved Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was present to answer questions. She stated that the Licensee has agreed to a 90 day suspension, 45 days actually served (7 days from previous violation to run concurrently), 45 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1) (a), serving any person under the age of 21 years, as well as transfer the liquor license to within 60 days to someone who is not related by blood or marriage, and if the Licensee February 3, 2003 fails to comply with any terms of this stipulation, then the Authority shall, in addition to any other penalty imposed, order the Licensee to serve all the days of the suspension presently held in abeyance. Judge Lane approved the findings, conclusion, and order accepting the stipulation agreement as presented for The Island, 185 North College Avenue. Show Cause Hearing for Zydeco Grill, Inc., dba Zydeco's, 11 Old Town Square, Stipulation Agreement Approved Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was present to answer questions. She stated that the Licensee has agreed to a 4 day suspension, 1 day served (paid fine in lieu of suspension $539), with 3 days held in abeyance for 1 year.
