BOARDMEMBERS PRESENT: Charles Fielder Leslie Jones Gene Little Jim Packard BOARDMEMBERS ABSENT: • Bradley Massey John McCoy STAFF MEMBERS PRESENT: Felix Lee, Building and Zoning Director Delynn Coldiron, Contractor Licensing Administrator Stacie Soriano, Staff Support AGENDA: 1. ROLLCALL The meeting was called to order by Chairperson Fielder, and roll call was taken. 2. APPROVAL OF MINUTES Boardmember Little made a motion to approve the minutes from the November 21, 2002, meeting. Boardmember Jones seconded the motion. The motion passed. Vote: Yeas: Little, Fielder, Packard, and Jones. • Nays: None. 3. Contractor Appeal — Jim Vandress, d/b/a Partners Roofing, Case Number 24-02. BRB 12/1902 Page 2 Fielder explained the procedures for contractor appeals. Lee made an introduction to the appeal. Lee gave the following background information: (1) Partners Roofing had a license granted to them in 1995, and the license holder at that time was Jim Hauck; (2) a qualified supervisor was not required for specialty licenses at the time the license was originally issued; (3) Mr. Hauck left the firm within the past year, and City staff notified Partners roofing that a new license and certificate holder would have to be approved for the license to remain active; (4) Mr. Vandress, a partner of the company, was granted a temporary license and supervisor certificate for 30 days in order to complete testing and submit required documents; (5) Mr. Vandress successfully passed the roofing exam on December 7, 2002, and was working on obtaining the required documentation. Mr. Vandress was having difficulty obtaining the required documentation, so staff extended the temporary license until the end of the year. Lee stated shortly after being granted the second temporary license that work was being performed by Partners Roofing without a building permit. Staff immediately revoked the temporary license upon learning this information. Staff allowed Partners Roofing to obtain permits for and continue the work on the roofs that were in progress. Jim Vandress of Partners Roofing addressed the Board. Vandress stated his estimator had a family emergency, and was unable to obtain the building permits. Vandress stated he did not know that the building permits were not issued by the end of the day. Lee asked what W. Vandress' practice was for obtaining building permits and verifying that the building permit is on site. Vandress stated that Jim Hauck usually took care of the building permits, although Vandress has been obtaining the building permits himself the last couple of months. Lee asked if Mr. Vandress was on site. Vandress stated Sean runs the tear -off crew. There was a discussion held regarding which employee was responsible for obtaining the building permits. Lee asked how the crew would know that a building permit has been issued. Vandress stated Sean would have had the building permit. Lee asked Vandress what his position in the company was, and if he was responsible for the operations in the field. Vandress said he was trying. There was a discussion held regarding Mr. Vandress' business practices. Jones asked Mr. Vandress why he was running a tight schedule on obtaining the building permits. Mr. Vandress had no explanation. Little asked if the permits were posted on the property. Vandress stated yes. Vandress had no closing statements. Lee made his closing statements. Lee stated that everyone appreciates a family emergency. Lee stated that there appears to be a lack of supervision. Lee felt it was a knowing violation. Little asked if Partners Roofing had any other code violations in their file. Lee stated yes, a stop work order was issued on July 16, 2002, for work being done without obtaining a building permit. A warning letter was sent out to the license holder. Fielder asked Vandress what changes he could possibly make in his business to help assure that violations do not occur again. Vandress stated he would be responsible for obtaining and posting the building permits. X BRB 12/1902 Page 3 • Little made a motion to authorize the issuance of the license with a probationary period of six months. He noted that if the Appellant does not have any further violations during the six month probationary period, the license would be free of restrictions. Fielder asked if staff was able to track a probationary period. Lee stated yes. Little stressed to Mr. Vandress how important it is to have the building permit on the job site. Fielder stated regularly scheduled meetings may help the communication process. Lee asked what the consequence would be if a violation occurred during the six month probationary period. Little stated the Appellant would have to come before the Board, and a suspension would be discussed. Lee stated a suspension would probably occur if another violation was committed whether or not there was a probationary period. Little amended his motion to include an automatic thirty -day suspension (if another violation occurred) and the Appellant would have to come before the Board. Jones seconded the motion. The motion passed. Vote: Yeas: Little, Fielder, Packard, and Jones. Nays: None. �. Contractor Appeal — Tom Priester, d/b/a Finished Basement Company, Case Number 25-02. Lee provided an introduction to the appeal. Lee stated the Appellant is requesting a Class D2 license restricted to basement finish projects. Lee said the Appellant has applied for a Class D2 license, but the projects submitted do not meet the criteria for a Class D2 license, which requires structural work. Lee stated the requirement was three project verification forms. Lee stated the Appellant took the exam today. Tom Priester addressed the Board. Mr. Priester stated the Finished Basement Company is a design -build firm out of Denver. Priester stated he was seeking a limited D2 license with the restriction to perform only basement finish work. Lee asked the Appellant if his experience was limited to his company's work of basement finishes. Priester stated that was not true. Priester stated his background. He was in the commercial construction business for approximately six years in various positions. He has also worked for a real estate developer working on strip malls in Chicago. Priester also built semi - custom homes in Phoenix. Lee asked Priester if he would be the on -site supervisor. Priester stated no. He has five project managers that work for him, and the project managers are typically the on -site supervisors. Priester stated that he will visit projects at various stages. Lee advised that the Appellant read the ordinance regarding the requirement of on -site supervisors. Lee gave Mr. Priester a briefing regarding the licensing ordinance, specifically the requirement pertaining to on -site supervisors. Priester stated he fit the description. Lee stated that Mr. • Priester had the experience for a Class D2 license, if projects could be documented that relate to 0 BRB 12/1902 Page 4 building a complete home or significant structure alterations or additions. There was a discussion held regarding the required documentation. There was a discussion held regarding if the Applicant wanted to withdraw his application. Lee suggested that since Mr. Priester had the required experience he may want to submit those projects instead of seeking approval of a restricted license from the Board. Mr. Priester was in favor of seeking Board approval in lieu of paperwork, but was willing to submit paperwork if needed. Fielder stated the Board was in favor of the Appellant submitting paperwork. Mr. Priester withdrew his application. Other Business Lee gave an update regarding the IRC review. Lee stated the group has just finished Chapter 9 pertaining to roofing.
