Regular Water Board Meeting
March 10, 1982

Chairman Ward Fischer opened the meeting. The following items were discussed:
Minutes Approved.
In -Lieu -of Water Rights
By recommendation from the staff and consensus from the Board, the In -Lieu -of
Water Rights will remain at $1700 since nothing has changed to alter that decision
made at the meeting last month.
Raw Water Rental Rates
Dennis Bode explained on a memo that was distributed to Board Members, that each
year after the irrigation companies have established the annual assessment rates
for their water, the Water Board recommends to the City Council the rental rates
for the City's surplus water. The staff recommended that the following rental
rates be adopted:

Pleasant Valley & Lake Canal Co.
New Mercer Ditch Co.
Larimer County Canal No. 2
Arthur Irrigation Co.

* For late season rentals, rates may be adjusted to reflect the proportional
remaining yield of the waterstock being rented (if applicable).
Following a brief discussion, Ev Richardson moved that the Water Board accept
the staff's recommendation to adopt these rates. After a second from Bernie Cain,
the motion carried unanimously.

A. Study of Water Treatment Plant No. 1 in Poudre Canyon
Mike Smith suggested that the Board meet in a work session to discuss the
report and provide the staff with some ideas and suggestions,

particularly in conjunction with the budget process for 1983.
Out -of -City Service Request
The Native American Vocational and Training Institute is in the process
of acquiring the Atlas E. Missile Site located approximately 1k miles
northwest of Ted's Place. Webb Jones explained that the Institute has
requested a new tap on the City's 24 inch concrete transmission line.
The tap will provide water to an existing pump station which delivers
water to the missile site through an existing 2-inch water line. The
staff and the Water Board Members had some concerns which have been in-
corporated in the motion. Bruce Price and Greg Adams, representatives
from the Institute, explained the background for their requrest and
what the plans are for use of the water. Should some of the staff's or
the Board's concerns become reality, they feel that they would still
have sufficient time to investigate alternate sources of water.
After the discussion and some reservations from the Board, Ev Richardson
offered the following motion with a second from Bernie Cain: The Board
recognizes the considerable community benefit that will result from this
request for out -of -city service. In view of that and because it is
supported by the office of the governor, the Board recommends to the
Council, an exception to its general policy, and therefore, would allow
this request to the Institute without any water right surrender require-
ments, but the Board's recommendation would be based upon the following
conditions: 1) that they would be subject to all other ordinances and
charges of the City of Fort Collins; 2) that the line would be used for
no other purpose but the serving of water to the Institute; 3) that,
at the discretion of the City, service could be cut off either because
there is not potable water in that line in the future or because this
particular tap interferes with pressures and other elements of the dis-
tribution of water within the City. 4) that the tap must be installed
at a different location as selected by the Water Utilities Department
and constructed with a check valve to prevent the backflow of water.
Upon these conditions and these conditions only, does the Water Board
recommend approval. There were six yes votes and one no vote from Ray
Anderson.
It is the Board's understanding that the conditions expressed are
acceptable to the Institute.
The Board then went into executive session to consider legal matters.
