February 9, 1989 Minutes The regular meeting of the Zoning Board of Appeals was held on Thursday, Feb- ruary 9, 1989 at 8:45 A.M. in the Council Chambers of the City of Fort Collins City Hall. Roll call was answered by Boardmembers Thede, Wilmarth (will be voting alternate today), Lancaster, Lawton, Nelson and Huddleson. Boardmembers absent: None Staff present: Barnes, Zeigler, and Eckman. Minutes of the Regular Meeting of December 8. 1988, Approved as Published The minutes of the December 8, 1988 regular meeting were unanimously approved. Appeal #1906. Section 29-133 (4) by Cardell Webster, Owner, 401 Briarwood- Approved "---The variance would reduce the required rear yard setback along the south lot line from 15 feet to 6 feet for a one -car carport addition to a home in the RL zone. ---Petitioner's statement of hardship: This is a corner lot wherein the house actually faces the legal side yard rather than the front. There- fore, the legal rear lot line, in actuality, is the interior side lot line, which requires only a 5 foot setback. The petitioner wanted to build the carport along the north side of the house, but in checking with the City years ago he was told he couldn't do so. He then installed a driveway and parking pad along the south side of the house in order to be able to build a carport there. ---Staff comments: This is a corner lot situation which the Board has dealt with a number of times in the past." No notices were returned, no letters were received. Petitioner Cardell Webster told the Board that fifteen years ago he had brought in plans to the City to add another garage onto his house which would convert the single car garage to a two car garage. He was told at the time that there wasn't enough room for the addition on this particular lot. He has decided since then to pour a concrete pad on the south side of his house to park his pick-up. He is now wanting to put a carport over this pad to provide some protection for his vehicle. He talked to his neighbors, Tom Peterson and George Sawczyn, and they are not opposed to the addition of the carport. Boardmember Nelson made a motion to approve the variance request for the hard- ship stated. The motion was seconded by Boardmember Lawton. I - Approved "---The variance would allow one property to have three freestanding signs when only two are allowed. Specifically, the Boardwalk PUD is platted as one lot, but is approved through a PUD for up to 14 buildings. There is already a freestanding sign at each of the two entrances, which use up the properties allowance. This request would allow an additional 32 square foot, single -face sign to be constructed on an existing base outside Building I, which is the building closest to Boardwalk Drive. The free- standing sign would be approximately 85 feet from the street. ---Petitioner's statement of hardship: See petitioner's letter. In addi- tion, if this PUD were platted into individual lots like most other com- mercial PUD's, a variance would not be needed. ---Staff comments: If the Board should decide to grant this variance, cer- tain conditions can probably be placed on the variance; e.g., there can be no signs on the walls of Building I." One notice was returned, no letters were received. Zoning Administrator Peter Barnes showed the Board a slide of the subdivision plat of the Boardwalk P.U.D.. All of the lines running through the plat were not lot lines but easements. The P.U.D. is one big subdivided lot and the P.U.D. approval for that one lot subdivision was approved so the lot could accommodate up to fourteen buildings. He said it is somewhat unusual to find a commercial P.U.D. platted as one lot. It is sometimes seen with residential townhome or multi -family P.U.D.s where it's one lot and a number of buildings on it. The proposal is to construct a 32 square foot single face freestanding sign on this existing brick base. The base was built when the building was constructed. The P.U.D. basically has two entrances, one on Boardwalk and one on Whalers Way. The entrance I.D. signs that exist on Boardwalk entrance and Whalers Way entrance take up all of the freestanding sign allowance for the property. Mitch Morgan with Horizon West Properties said his company is the property manager for the Boardwalk representing May Telemarketing who could not be pre- sent this mong. Buildings D, E, F and G have existing pedestal signs used as directs type signs for multiple tenants in a single building. As it happens, May -Tel: has leased the entire building and proposes to lease building H in its entirety also. Pedestals were installed and were intended for direc- tional signs at the time the buildings were leased. This particular pedestal was designed to be used for building H and I. It's against the covenants of the subdivision to place signage directly on any of the buildings. Mr. Barnes explained that some of the buildings at the rear of the project have free standing signs but since they are not visible from the street, they are not considered signs under the sign code. If each lot had been platted as a separate lot, each lot would have its own sign allowance and they wouldn't need avariance. 4 ZBA Minutes February 9, 1989 Page 3 Frank Lancaster stated he would much rather see the pedestal used for signage than to see signs put on the buildings themselves because it would detract from the area. The proposed sign would also screen the electric meters on the side of the building. After concerned questions regarding sign illumination, Sandra Cordova told the Board that only the lettering on this sign will be illuminated. Boardmember Thede made a motion to approve the variance for the hardship stated. Boardmember Wilmarth seconded the motion. Vote: Yeas: Thede, Wil- marth, Lancaster. Nays: Lawton, Nelson. Motion carried 3-2. Other Business Peter Barnes informed the Board that they would be receiving information from the City in respect to the March 7th City election dealing specifically with the sales tax issues.
