Minutes of the July meeting were approved as published.
ADDeal 2037 - 1802 North College Avenue by Frank Perez, owner,
approved.
----- The variance would reduce the required lot width in
the HB zone from 75 feet to 70 feet. The lot and the
building have existed in the same manner for
approximately 24 years. This variance would allow the
the petitioner to plat the parcel.
Hardship: The parcel in question has existed at a 70
foot width for a very long time. The owner is wishing
to put an addition on the building and the Zoning
Code requires that he plat the parcel that is now
described only by meets and bounds. The HB zone requires
a 75 foot lot width, therefore, the lot does not conform.
The neighboring properties are already developed and
the owner is unable to acquire any property to attain
the 75 foot requirement. At the time the property was
purchased there was no requirement for the 75 width.
Staff comments: Until 1977, when the City rezoned
North College Avenue, this property was in the BG
zone which does not have a width requirement.
Dan Coldiron, acting Zoning Administrator, stated this property was
located in the General Business Zone. When the City re -zoned North
College Avenue, the property required a 75 lot width. Now, because
the owner wishes to put on an addition, he needs to apply for a
variance so this land can be platted.

Mr. Perez, owner of the property, appeared before the Board. He
stated the building has been there approximately 30 years and he
has owned it for the past 24 years. He would like to put an
addition on of approximately 1000 square feet directly behind his
present building.
No one was present in favor or in opposition of this appeal.
Board member Lancaster moved to approve Appeal #2037 for the
hardship stated. Board member Cuthbertson seconded the motion.
Yeas: Gustafson, Huddleson, Cuthbertson, Lancaster. Nayes: None.
The motion passed.
Appeal 2038 , 907 West Mountain Avenue, by Gordon Haszier, owner,
approved.
The variance would allow a two -stall garage to be located
within 1 foot of the side lot line where a 5 foot set-
back is required and within 3 feet of the rear lot line
where a 5 foot setback is required.
Hardship: The lot is in the older part of town where the
lots were originally platted very narrowly. The owner
has explored the options of placing the garage on another
part of the lot, but the narrowness of the lot and the
existence of mature landscaping makes it impossible to
locate the building anywhere else. The applicant feels
that this is in keeping with the character of the
neighborhood as most every property already has a
similar situation.

Acting Zoning Administrator, Dan Coldiron, stated this was in an
older part of town. Many garages were built on the property line or
within a few feet.
Gordon Haszier, owner, appeared before the Board. He stated if he
put the garage in the middle of his lot, mature landscaping would
have to be cut down. To reserve lawn space he wanted to put the
garage on the corner of his lot.
No one was present in favor or in opposition of this appeal.
Board member Lancaster stated putting the garage on the corner of
the lot was good for the community, keeping the landscaping.

Board member Gustafson moved to approve Appeal 2038 for the
hardship stated. Board member Cuthbertson seconded the motion.
Yeas: Gustafson, Huddleson, Cuthbertson, Lancaster. Nayes: None
The motion passed.

approximately 24 years. This variance would allow the
