ZONING BOARD OF APPEALS
September 10, 1992
Annual Meeting - 8:30am
The annual meeting of the Zoning Board of Appeals was held on
Thursday, September 10, 1992 in the Council Chambers of the City of
Fort Collins City Hall. Roll was answered by Gustafson, Huddleson,
Anastasio, Cuthbertson.

The minutes of the August meeting were approved as published.
The agenda was rearranged because the appellant for Appeal 2039 was
not present.
Appeal #2040, 400 N Roosevelt by Albert Yoxall, owner, approved,
Section 29-133(3).
----- The variance would reduce the front setback requirements
from 20 feet to 16 feet for a carport addition to the
front of the house. The house is located in the RL
zone.
Petitioner's Statement of hardship: If the carport is
built 4 feet shorter, then it wouldn't be long enough
to cover the car. Mature landscaping would need to be
removed in order to build it somewhere else on the lot.
Zoning Administrator Peter Barnes explained this home was located
on the corner of Cherry Street and Roosevelt. It presently has a
one car garage and driveway.
Mr. Yoxall appeared before the Board and stated he would like a
carport to protect his car from weather. He explained the design of
the carport would have no sides and six 4X4 posts. The roof will
not tie into the present roof of the house.

Board member Gustafson asked if other houses in this area had
carports like this one. Mr. Barnes stated there was a mixture in
the neighborhood of two -car garages, one car garages, one and two
car driveways. Mr. Yoxall stated a house three doors down had a
carport like the one he was proposing.
Board member Huddleson stated he needed to be clear about the
hardship of this appeal. Mr. Yoxall stated there was mature
landscaping in the back and side of the house and if the carport
was situated on the side a variance would be needed as well as
tearing out mature trees.
Board member Cuthbertson stated he saw the hardship as this house
being on a corner lot with no opportunity to put the carport on the
Cherry street side.
Board member Gustafson stated this may be a self-imposed hardship
and putting the carport in the front would make it very close to
the street.
Mrs. Yoxall appeared before the Board. She stated the present
garage is not really a garage, but their bedroom. There is only one
window in the bedroom on the side of the house and so the carport
could not be put on that side.
Board member Anastasio stated he saw the hardship as being a corner
lot with mature landscaping.
Board member Huddleson stated he would rather see the carport on
the side of the house. He could see the hardship as mature
landscaping, but thought this was stretching the hardship issue a
bit.
Board member Anastasio moved to approve Appeal 2040 for the
hardship stated. Board member Cuthbertson seconded the motion.
Yeas: Huddleson, Anastasio, Cuthbertson. Nayes: Gustafson The
motion passed.
Mr. Gile was still not present for Appeal 2039. The Board decided
to hear the appeal with the information provided by Mr. Barnes.
Appeal #2039. 618 West Mountain Avenue by Raymond Gile, owner,
approved, Section 29-167(5).

The variance would reduce the required side yard setback
from 5 feet to 1.5 feet along the west lot line for a
garage addition which will line up with the existing
structure. The property is located in the NCM zone.
Petitioner's statement of Hardship: The home is located
in the older part of town and was built on only a 50 ft.
wide lot. The home was also built at the setback of 1.5
ft. which is why this variance is necessary. To line up
this garage addition with the existing structure is the
only practical way to place the structure on the lot.
Placing the addition anywhere else on the lot would also
take up a great deal of yard space due to the narrowness
of the lot.
Zoning Administrator Peter Barnes explained this is in an older
part of town. The preposed addition would be 32' long.
Board president Huddleson asked Mr. Barnes if the lot width was
601, instead of 50' would a variance be needed. Mr. Barnes stated
a variance would not be needed. Board member Gustafson wanted to
know why the home owner needed 32' of garage space.
Board member Anastasio stated there were questions the Board needed
to ask the applicant and thought this appeal needed to be tabled.
He moved to table this appeal until next month. Board member
Cuthbertson seconded the motion. Yeas: Gustafson, Huddleson,
Anastasio, Cuthbertson. The motion passed.
Mr. Gile arrived, and asked the Board to hear his appeal. Board
member Gustafson moved to reconsider Appeal 2039. Board member
Anastasio seconded the motion. Yeas: Gustafson, Huddleson,
Anatasio, Cuthbertson. The motion passed.
Board member Gustafson moved to remove Appeal 2039 from the table.
Board member Cuthbertson seconded the motion. Yeas: Gustafson,
Huddleson, Anastasio, Cuthbertson. The motion passed.
Mr. Gile appeared before the Board. He stated he lived in this
house since 1960. He currently has four vehicles and has to rent a
lot to park his truck. He would like to be able to park all four
vehicles in one garage. He stated he plans to expand his garage on
the already paved driveway.

Board president Huddleson asked Mr. Giles what his plans were for
the roof line of the garage. Mr Gile stated he plans to tear off
the existing and match the roof line with the pitch of the house.
Mr. Gile also stated the neighbors have put up a trellis with
greenery growing on it so the garage will not be visible to them.
He stated there are many garages presently close to the alley.
Board member Gustafson stated the lot width was a hardship and had
no problem with this appeal. Board member Anastasio agreed.
Board member Gustafson moved to approve Appeal 2039 for the
hardship stated. Board member Cuthbertson seconded the motion.
Yeas: Gustafson, Huddleson, Anastasio, Cuthbertson. The potion
passed.
OTHER BUSINESS
Mr. Barnes reminded the Board of the workshop re -scheduled for
September 30, 1992 at 6:30pm.
Election of officers will be held next month. Hopefully the absent
members will be back in town at that time.

2. Appeal 2039. The variance would reduce the required side yard
setback from 5 feet to 1.5 feet along the west lot line for a
garage addition which will line up with the existing
structure. The property is located in the NCM zone. Section
29-167 (5) by Raymond Gile, 618 w. Mountain Ave..
3. Appeal 2040. The variance would reduce the front setback
requirement from 20 feet to 16 feet for a carport addition to
the front of the house. The house is located in the RL zone.
Section 29-133 (3) by Albert Yoxall, 400 N Roosevelt.
4. Appeal 2041. The variance would allow an outdoor storage
area for boats and R.V.'s to not be surfaced with asphalt or
concrete. Specifically, the variance would allow the lot to
be surfaced with compacted road base. The storage facility is
located in the IL zone. The variance would also reduce the
amount of required interior parking lot landscaping from 68 to
