HomeMy WebLinkAboutZoning Board Of Appeals - Minutes - 01/14/1993• ZONING BOARD OF APPEALS January 14, 1993 Regular Meeting, 8:30am Minutes The regular meeting of the Zoning Board was held on Thursday, January 14, 1993 at 8:30am in the Council Chambers of the City of Fort Collins City Hall. Roll was answered by: Cuthbertson, Gustafson, Anastasio, Huddleson, Perica. Boardmembers absent: Wilmarth and Lancaster. The meeting was called to order by Chairman Gustafson. Staff Liaison: Peter Barnes Council Liaison: Susan Kirkpatrick Staff Support Present: Peter Barnes Ann Reichert Minutes from the December meeting were approved. Appeal 2051, 1507 Laporte Avenue by Beth Elshof, owner, approved with condition, (Section 29-459(1). The variance would allow an in -home seamstress business to be located in the detached shop located at the rear of the lot, instead of in the home on the property. The business owner lives in the home which is located in the NCL zone. Petitioner's statement of hardship: Most of the garments sewn in connection with this business are wedding dresses. Large work tables are required for such dresses and the only available room inside the house is a spare bedroom which is not large enough for the necessary equipment. The detached shop is existing and provides a more adequate work area. All other requirements of the home occupation ordinance will be complied with. Staff comments: None Zoning Board of Appeals January 14, 1993 Page 2 Zoning Administrator Peter Barnes, stated the garage and "shop" are detached from the house. It appears the shop has been there for some time. If this variance is granted all other requirements will be met for a home occupation license. Mr. Barnes stated if the shop was attached the owner would not be applying for a variance. Board member Anastasio asked Mr. Barnes how this variance was brought to his attention. Mr. Barnes stated the applicant contacted him regarding codes and requirements for a home occupation license. Board member Perica stated he saw two hardships, 1) the shop already exists and 2) the shop/garage is not attached to the home and this is a disadvantage. Beth Elshof, 1507 Laporte Avenue, owner, appeared before the Board. She stated he needed a large area to lay out fabric to make wedding and party dresses and the spare bedroom in the house is not large enough. Board chairman Gustafson asked Mrs. Elshof if there was adequate parking for her business. She stated there was a concrete slab in the back that was large enough for parking. Mr. Barnes stated the shop is basically a finished living space with carpeting and heat. No one was present in favor or in opposition of this appeal. Mr.Barnes stated this Board has approved variances like this in the past, especially when there is no need to build an additional building or there is no impact to the neighborhood. Mr. Elshof, 1507 Laporte Avenue, owner, appeared before the Board. He stated there is plenty of room to park. They just purchased the property in November and have plans to remove the chain link fence that is presently there and after clean-up, approximately 5-7 cars will be able to park in the back. Board member Anasastio stated he was in favor of the appeal. Board member Huddleson moved to approve Appeal 2051 for the hardship stated believing that this would not be detrimental to the neighborhood, with the condition that the shop be limited to seamstress. Board member Anastasio seconded the motion. Yeas: Cuthbertson, Gustafson, Anastasio, Huddleson, Perica. Nayes: None The motion passed. He will have specific materials to the members by March. It was decided to move the annual breakfast meeting to March. Discussion was held regarding conflict of interest. It was decided to ask questions of Paul Eckman at the breakfast meeting in March. The meeting was adjourned.
