Minutes
The regular meeting of the Zoning Board of Appeals was held on
Thursday, February 10, 1994 in the Council Chambers of the City of
Fort Collins City Hall. Roll was answered by Perica, Cuthbertson,
Anastasio, Gustafson, Michelena, Clark, Huddleson.
The meeting was called to order by Chairman Gustafson.

The minutes from the January meeting were approved.
Anneal 2093, 938 Maple Street by Sue Amador and Chris Christiansen,
approved with condition. Section 29-167 (4).
The variance would reduce the required rear yard setback
from 15 feet to 1013" in order to allow a 2-story
addition to a single family home in the NCR zone. The
2nd floor will comply with the required setback,
however, the first floor addition requires the variance.
The existing home is set back 913" from the rear
property line.
Petitioner's statement of hardship: The lot is very
shallow and quite small. The home is also quite small.
Existing mature trees and landscaping make it difficult
to build in another location on the lot. The existing
house is already closer to the rear lot line than the
proposed addition will be.
Staff comments: None
Zoning administrator, Peter Barnes, stated this lot was part of one
or more lots in the older part of town, and is an odd shape,
501deep and 86' wide. He stated, usually the depth of lots in this
area of town is 1901.

Owners, Sue Amador and Chris Christiansen appeared before the
Board. Sue stated the yard is already very small and the back yard
is really the side yard.
No one was present in favor or in opposition of this appeal.
Board member Michelena stated he thought this would be a nice
addition to the house and increase the looks of the neighborhood.
Board member Anastasio agreed.
Board member Huddleson moved to approve Appeal 2093 for the
hardship stated, with the condition that the addition be built
according to the plans submitted. Board member Perica seconded the
motion. Yeas: Perica, Cuthbertson, Anastasio, Gustafson, Michelena,
Clark, Huddleson. The motion passed.
Appeal 2094, 225 N Meldrum, by Randy Wick, contractor, approved.
Section 29-210(2), 29-210(5).
----- The variance would reduce the required lot width from
40 feet to 25 feet and the side yard setbacks along the
north and south lot lines from 5 feet to 4.5 feet. The
variances are necessary in order to demolish the older
existing house and construct a new home on this lot
in the NCB zone.
----- Petitioner's statement of hardship: The lot is only
35 feet wide. The existing home is in bad condition
and can't be remodeled. The existing house is at a
zero setback from the north and south lot lines, so
the new home, being at 4.5" setbacks, will be an
improvement.
Staff Comments: None
Zoning Administrator, Peter Barnes, stated this house was located
in the older part of town, is in bad repair and not worth
restoring. The proposed new home will comply with the front and
rear setbacks. The 25 foot lot width is extremely narrow.

No one was present in favor or in opposition of this appeal.
Board chair Gustafson stated the lot width was a hardship and he
felt it was good for the neighborhood to approve this appeal.
Board member Anastasio stated he saw the hardship as the narrowness
of the lot and was in favor of this appeal.
Board member Michelena moved to approve Appeal 2094 for the
hardship stated. Board member Clark seconded the motion. Yeas:
Perica, Cuthbertson, Anastasio, Gustafson, Michelena, Clark,
Huddleson. The motion passed.
Appeal 2095, 820 South Shields, by David Massey, approved with
condition. Section 29-595(c), 29-595(d).
The variance would allow a 45 square foot freestanding
sign to be setback 7.5 feet from the right-of-way line
instead of 12 1/2 feet. The variance would also reduce
the required setback from the interior side lot line
on the south side from 15 feet to 10 feet for the same
sign. The variances are requested due to the need to
move the existing sign further west as the result
of the Shields Street widening project.
Petitioner's statement of hardship: The property line
of this lot is being moved approximately 45 feet to the
west as the result of the City acquiring additional
right-of-way for the new right turn lane being installed
as part of the Shields Street widening. This means
that the existing sign will be in the right-of-way and
must be moved. The Espresso building must also be moved
and it is necessary for the sign to be located in front
of that building in order to be visible. The Espresso
building can't be moved further, otherwise much needed
parking will be lost. The sign needs to be closer than
15 feet from the side lot line in order to be out of
the driveway. Since the lot has 2 curb cuts, there is
no other place to put the sign. The loss of the
property for the right turn lane is forcing every-
thing to be moved back, and in order to maintain
adequate parking and circulation, this is the best
location for the sign.

Mr. Huddleson was excused from the meeting.
A letter was read from Tom Haisten, owner of the mini -mart on the
corner of Shields and Elizabeth opposing the appeal.
No one was present in favor or in opposition of this appeal.
Zoning Administrator, Peter Barnes, stated Choices 95, which will
widen Shields Street will start approximately in the spring of
1994. The sign will comply with the height requirements, but needs
a variance for the front and side setbacks.
David Massey, owner, appeared before the Board. He stated the way
the cars exit the lot as well as other alternatives were
considered, when looking at relocating the sign. He stated the sign
will be brought down two feet and a base will be put on the pole.
Zoning Administrator, Peter Barnes stated presently the property
line is in the middle of Shields, so it is difficult to place the
sign according to the property line.
Mr. Massey stated he thought a fair compromise would be for him to
lower the sign two feet, keep the sign in the same proximity to the
Expresso Building ans the street as it is presently, and line it up
with the current sign next door. Mr. Massey stated he explored
other locations for the sign, and the only other place would be in
the middle of a landscaped island and then stacking of cars would
be affected as well as taking out a tree.
Boars Discussion
Board chairman Gustafson stated when the City takes the right-of-
way away, it does present a hardship and he agreed with the
compromise Mr. Massey proposed. Board members Michelena and
Anastasio agreed there were no other options.
Board member Michelena moved to approve Appeal 2095 for the
hardship stated with the condition that the pole be enclosed when
the sign is moved, lowered two feet and the appeal is only valid
until the property changes use or redevelops. Board member Perica
seconded the motion.
