HomeMy WebLinkAboutZoning Board Of Appeals - Minutes - 06/08/1995t�l ZONING BOARD OF APPEALS June 8,1995 Regular Meeting - 8:30am Minutes The regular meeting of the Zoning Board of Appeals was held on Thursday, June 8, 1995 in the Council Chambers of the City of Fort Collins City Hall. Roll was answered by Perica, Shannon, Breth, Cuthbertson. Board members absent: Huddleson, Gustafson. The meeting was called to order by Board member Perica. Council Liaison: Ann Azari Staff Liaison: Peter Barnes Staff Support Present: Peter Barnes Ann Chantler The minutes were approved with correction. Appeal 2134 1534 West Oak Street by Alice Mares approved with condition. Section 29- 119(5). ----- The variance would reduce the required side yard setback along the east lot line from 5' to 1' to allow a 15' wide carport to be added onto the side of the house. Petitioner's statement of hardship: The driveway already exists at this location. The lot is only 50 feet wide. This is the only feasible location for the carport. Staff comments: None Zoning Administrator, Peter Barnes, stated this house was located across from City park. The house has an alley behind the back yard. Two letters were received in support of this appeal. Joe Jarmillo, brother-in-law to Alice Mares, appeared before the board representing Ms. Mares. He stated if this carport was approved, he would be building the structure. He said he talked with the neighbors and they did not have a problem with the addition. Zoning Board of Appeals June 8, 1995 Page 2 Mr. Jarmillo added the old garage is used for storage, and because it sets way back on the lot is not safe for his sister-in-law to walk from the garage to the house at night.. He said with the addition, it would help shield the front of the house from the wind, and the branches that blow on the driveway. He said the carport would match the structure of the building. No one was present in favor or in opposition of this appeal. Board member Shannon asked if the east side of the carport would be enclosed. Mr. Jarmillo said it would not. Mr. Barnes said because the carport would be closer than 3', the Building Department may require the carport to be one hour construction. Board member Perica said he was failing to see a hardship in this case other than the owner wanted more security. Board member Breth stated the lot was 50' wide and in newer subdivisions they are 60', so the narrowness of the lot could be considered a hardship. Board member Shannon said the lot was narrow and there was a limit to what could be done. Board member Cuthbertson said that because of the narrow lot and the existing concrete driveway that abuts to the property line, there was no other place to put the carport without a variance. Board member Shannon moved to approve Appeal 2134 for the hardship stated, the narrowness of the lot, with the condition that the building meets the codes by the Building Department, is constructed with materials approved by the Building Department, is open on 3 sides, and if these conditions could not be met, then the appeal needed to be heard again before this Board.
