• MINUTES OF THE MEETING OF THE WATER BOARD HELD
MAY 252 19652 AT 7:00 O'CLOCK P. M. AT THE
FORT COLLINS COUNTRY CLUB
Present: President Ward Fischer, Vice President Frank Ghent, Mayor Harvey Johnson,
Secretary John Bartel and Board Member Fred Feit; also present were City
Manager R. F. Boos, City Engineer Adam Fischer, Assistant City Attorney
Arthur March, Jr., Members of the City Council --Dr. Thomas Bennett, Dr.
Karl Carson, L. J. McMillan, Lorraine Quinn; J. T. Banner and A. J. Hull,
Consulting Engineers.
The proposals for the 1965 Water Improvement program were studied and
discussed. The Engineers estimate being $1,013,973.50. Turnpike Construction of
Broomfield, Colorado was low bidder with $1,029,310.24, this bid was on Ductile Iron
pipe . Second low was Martin K. Eby of Denver.. Colorado, with a bid of $1,031,763.30
using prestressed concrete pipe in larger sizes and iron pipe in smaller sizes. Third
• bidder was Broserich & Gibbons of Pueblo, Colorado, with $1,075.853.00 also using
prestressed concrete and iron pipe.
After considerable discussion as to type of pipe to recommend and due to
the fact that Turnpike Construction CompaWl s bid was low and since their bid was on
Ductile iron only, the Water Board felt that additional information on the history of
Ductile pipe was necessary. Motion was made by John Bartel, seconded by Frank Ghent,
that recommendation of bidder be tabled and that Ward Fischer be authorized to gather
more data and present same for study at the next meeting.
The City Attorney stated that he was in the process of drawing a new
agreement for outside water users. This agreement would replace forms now in use.
The City Engineer presented the following letter which was read at length:

Dear Sir:
I am making this inquiry in writing subsequent to our telephone conversation this
morning. I have two items that I would like to have clarified in regard to water

rights. We are presently annexing a piece of property that is under the Ft. Collins -
Loveland Water district and this automaticly gives them the first right to purchase
the water on the property. Is it mandatory that we have water with the ground when
we annex it, and if so, how much will we be required to have for the 40 acres in
question?
Question Number two: After the first of the year when,the new regulations take
effect, what allowances will be assigned to a particular type water share in order to
qualify for the two acre feet requirement. In other words, will a share of Pleasant
Valley and Lake Canal that usually supplies about 60 acre feet per year, qualify as
enough water for 30 acres of annexed ground. I would also be interested in what
values are assigned to North Poudre and Horsetooth rights.

After discussion it was unanimously agreed that the water rights be offered
to the District, since this land lies within the District, then when annexing to the
City of Fort Collins the two acre foot units per acre of land as required by ordinance
be presented. If no water rights are available, the $100.00 payment per acre foot

unit would be required.
Since the Water Board was
not in existance when the City Charter was
adopted,
President Ward Fischer stated that he was preparing an amendment to the charter to
incorporate the Water Board's functions and responsibilities. This amendment to be
studied by the Council and the Water Board before adopting.
